Legal analysis: selling fruit requires a business license. Fruit shops only need business licenses, such as circulation licenses, hygiene licenses and food business licenses. But if you want to sell candied fruit and dried fruit, you need to apply for a food business license. Business license is a certificate issued by the administrative department for industry and commerce to industrial and commercial enterprises and individual operators to engage in certain production and business activities. Its format shall be uniformly stipulated by the State Administration for Industry and Commerce.

Legal basis: Article 35 of the Food Safety Law of People's Republic of China (PRC), the state implements a licensing system for food production and operation. Engaged in food production, food sales, catering services, shall obtain a license according to law. However, sales of edible agricultural products and sales only in prepackaged foods do not require permission. Only selling prepackaged foods shall be reported to the food safety supervision and administration department of the local people's government at or above the county level for the record.
