Article 2 These Measures shall apply to the prevention and control of environmental noise pollution within the administrative area of this Municipality. Article 3 The prevention and control of environmental noise pollution shall follow the principles of overall planning, giving priority to prevention, comprehensive management and polluter's responsibility.

when making urban and rural construction plans, the people's governments of cities and counties (cities, districts) should fully consider the impact of noise generated by construction projects such as industrial production and commercial operation on the surrounding living environment, rationally arrange functional areas and construction layout, and prevent and reduce environmental noise pollution. Fourth city and county (city, district) ecological environment administrative departments to implement unified supervision and management of the prevention and control of environmental noise pollution within their jurisdiction.

in the area where comprehensive law enforcement of urban management is carried out according to law, the comprehensive law enforcement department of urban management is responsible for investigating and dealing with violations of the regulations on the prevention and control of construction noise and social life noise pollution within the scope of its duties.

The traffic management department, transportation and railway departments of public security organs are responsible for the supervision and management of the prevention and control of traffic noise pollution generated by motor vehicles (ships), railway locomotives and other means of transportation according to their respective responsibilities.

the departments of development and reform, natural resources and planning, urban and rural construction, urban management, public security, market supervision and management, culture, radio and television, tourism, health and health shall, within their respective functions and duties, do a good job in the supervision and management of noise pollution prevention and control. Article 5 Community residents' committees, owners' committees and other mass autonomous organizations shall strengthen the management of acoustic environment within their respective jurisdictions and the coordination of neighborhood noise disputes, and assist people's governments at all levels and relevant administrative departments to do a good job in the supervision and management of noise pollution prevention and control. Chapter II Supervision and Management of Prevention and Control of Environmental Noise Pollution Article 6 The municipal, county (city) and shangjie district eco-environmental administrative departments shall, jointly with the natural resources and planning departments, scientifically delimit the applicable areas of various acoustic environmental quality standards within their respective administrative areas according to the national acoustic environmental quality standards, and organize the implementation after reporting to the people's government at the same level for approval.

if the function of the area changes or the scope of the functional area changes, the applicable area of the acoustic environmental quality standard shall be redrawn according to the procedures specified in the preceding paragraph, and it shall be announced in time. Article 7 When determining the planning and site selection of construction projects, natural resources and planning departments shall reasonably delimit the noise-proof distance between noise-sensitive structures and enterprises, institutions and municipal infrastructure that may produce noise pollution, and put forward corresponding planning and design requirements.

when examining and approving a construction project that may cause noise pollution to the units and residents around the project site, the natural resources and planning department shall hold a hearing in accordance with relevant regulations or solicit the opinions of the units and residents around the project site in other appropriate forms. Eighth new construction, renovation and expansion of construction projects that may produce environmental noise pollution, the construction unit shall, in accordance with the provisions of the state on the classified management of environmental protection of construction projects, prepare environmental impact assessment documents and report them to the competent department of ecological environment administration for approval.

industrial production, processing, maintenance, catering, entertainment, bathing, fitness and other construction projects that may produce noise pollution that need to obtain a business license shall be submitted for approval before applying for a business license. Article 9 For construction projects such as processing, maintenance, catering, entertainment, bathing, fitness, etc., which may cause noise pollution, and construction projects that should prepare environmental impact reports, before the environmental impact assessment documents are submitted for approval, the construction unit shall solicit the opinions of the units and residents around the project location.

when examining and approving the environmental impact assessment document, the competent department of ecological environment administration may hold a hearing in accordance with relevant regulations or solicit the opinions of the units and residents around the project site in other appropriate forms. Tenth units and individual industrial and commercial households that produce noise pollution shall, in accordance with the relevant provisions of the state, declare to the municipal or county (city) and shangjie district ecological environment administrative department the types, quantity, noise value, pollution prevention measures and other matters of equipment that produce noise pollution. If the declared items need to be significantly changed, it shall go through the formalities of change at the competent administrative department of ecological environment 1.5 days in advance, and take effective prevention and control measures.

units and individual industrial and commercial households whose noise emission exceeds the national environmental noise emission standards shall pay the excessive sewage charges in accordance with relevant regulations. Measures for the collection, management and use of excessive sewage charges shall be implemented in accordance with relevant regulations. Eleventh in accordance with the requirements of environmental impact assessment documents, environmental noise pollution prevention facilities and on-line automatic monitoring equipment for key pollution sources of noise emission should be installed, and the installation project should be designed, constructed and put into use at the same time as the main project.

units and individual industrial and commercial households that produce environmental noise pollution must ensure the normal operation of environmental noise pollution prevention facilities and online automatic monitoring equipment. If it is really necessary to dismantle or leave idle, an application shall be submitted to the competent administrative department of ecological environment 5 days in advance, and it can be dismantled or left idle only after approval. The competent department of ecological environment administration shall not approve the removal or idleness of environmental noise pollution prevention and control facilities, which will aggravate the noise pollution.
