According to the regulations, land requisition compensation includes land compensation fee, resettlement fee, young crops compensation fee and ground attachments compensation fee. Unless otherwise stipulated by the state and the province, if the expropriated land is agricultural land, the total land compensation fee and resettlement subsidy shall not be less than 16 times of the annual output value (Weihai is not less than 30,000 yuan/mu); If the expropriated land is other land, it shall not be less than 10 times of the annual output value. In the last three months, two reports about land expropriation and demolition in Heze, Shandong Province (No.9 of China Quality Miles in 2006) and farmers' land loss in Heze Development Zone (China Business Daily, June 5438+1October 3 1) seriously raised this issue.

It is reported that Shandong Heze Development Zone was established in 1993. For more than a decade, relevant departments have made a big fuss about land.

At the beginning of the establishment of the development zone, there was nearly one mu of fertile land per villager in Duzhuang Village. By 1997, the villagers' land had been expropriated. It doesn't count that the cultivated land is expropriated, and finally the place where you live is expropriated. In 2003, the relevant departments of the Development Zone obtained the state-owned land use certificate and urban planning permit through the land acquisition procedures of Tuzi No.43 1No. Hezi [2002]No. 122, and forced the relocation of Duzhuang Village. "At first, we only knew that the economic compensation was small and we couldn't afford the relocated house. We don't know that the provincial and municipal land acquisition documents they are based on are not requisitioned from our village site. According to villagers, the compensation for requisitioning their cultivated land in the development zone is about 35,000 yuan/mu. But when these cultivated land were occupied by some enterprises, the price doubled. It is reported that the prices of land purchased by Starlight Industry and Chengxin Group are 78,000 yuan/mu and 68,000 yuan/mu respectively. After purchasing the land, the enterprise shall obtain the land use right for 50 years according to law.

After the cultivated land expropriated by farmers is used by enterprises, enterprises seem to be the beneficiaries and villagers in Duzhuang village are the victims. But on the land issue, enterprises eventually became victims.

In 2005, the Heze Municipal Party Committee and the Municipal Government made a decision to build a grand theater project, which was located in the location of 10 enterprises such as Chengxin Group and Xingguang Industrial Co., Ltd. ... which means that the land use right of enterprises should be recovered in advance and enterprises should move.

According to the relevant laws and regulations, if the land use right is recovered in advance according to law, the government should compensate the land users for the right to use and the attachments on the ground.

In March 2006, the local government issued a notice to recover the land use right, conducted a general survey and evaluation of the attachments on the ground in April, and signed an attachment compensation agreement with 9 enterprises in 19 in May, and made compensation on time.

However, there are differences between the local government and enterprises on the compensation of land use rights. The government insists on the reciprocal replacement scheme: the government takes back the land at the original price of the land purchased by the enterprise, and sells the same area of land to the enterprise at the price of 30 thousand yuan per mu in the eastern industrial zone of the development zone. In fact, the land where the enterprise is located has now become a prime location in Heze City, and the market price is much higher than the original purchase price. Of course, enterprises do not agree with the government's demolition plan and are unwilling to move. In order to complete the demolition task, in the process of working for enterprises, relevant officials even released the malicious words that "raising pigs is killing pigs". It is understood that the local government still adheres to the reciprocal replacement plan.

Farmers are forced to sell their cultivated land, and the government sells it to enterprises. This situation does not only appear in Duzhuang in the development zone. Pang Shaohai, former director of Pangzhuang Village, Diantun Office of Development Zone, told the reporter that their village has more than 330 mu of farmland, which was originally leased out by the local government at the price of 1 10,000 yuan/mu, and sold to Hengsheng Market at the price of10.2 million yuan/mu in less than two years, while the villagers only got 23,000 yuan per mu.

At present, the Changjiang East Road in Heze Development Zone is under intense construction. According to the villagers nearby, more than 2,000 mu of cultivated land in Zhangshendian Village where they are located was leased to a company by their Yuecheng office, and the compensation standard for them was per mu 1.500 kg of wheat per year.

It is reported that thousands of acres of cultivated land in Heze City are suspected of being rented and illegally occupied, which is even worse than the Zhengzhou illegal land grant case in which the relevant leaders of Henan Province were punished a few days ago.

Local insiders told reporters that if the government really needs to occupy farmers' land or enterprises' land for development needs, it can do so through legal procedures. However, the practice of the development zone makes people suspect that it is selling land for the sake of selling land: illegally occupying land at low prices and selling land at high prices. He told reporters that the development zone has occupied tens of thousands of acres of cultivated land since its establishment, but few decent enterprises have settled in.
