Provisions of Haikou Municipality on the Administration of Bidding for Investment Projects

article 1 these provisions are formulated in accordance with the bidding law of the people's Republic of China, the procurement law of the people's Republic of China and other relevant laws and regulations, combined with the actual situation of this municipality, in order to standardize the bidding activities of government-invested engineering projects, protect the interests of the state, the interests of the public and the legitimate rights and interests of the parties involved in bidding and tendering, improve the investment efficiency and ensure the project quality. Article 2 These Provisions shall apply to the tendering and bidding activities of municipal government-invested projects.

the government investment projects mentioned in these provisions refer to government financial interest subsidies and subsidies that use budgetary funds or are included in financial management, various government special construction funds, and state financing projects that use funds from government bonds, policy loans, foreign loans or guarantees raised by the state. Article 3 The tendering and bidding activities of government-invested engineering projects shall follow the principles of openness, fairness, impartiality, selection of the best and good faith. Article 4 The tendering and bidding activities of municipal government-invested projects must be carried out in Haikou's physical construction market.

Article 6 The bidding for government-invested projects shall be organized and implemented by the tenderee or the entrusted bidding agency according to law. Article 7 If the overall project survey, design, construction, supervision and procurement of important equipment and materials related to the project construction of the municipal government-invested project meet one of the following standards, public bidding shall be conducted:

(1) The estimated price of a single construction contract is more than 2 million yuan;

(2) The estimated price of a single contract for the procurement of important equipment, materials and other goods is more than RMB 1 million;

(3) The estimated price of a single contract for the procurement of services such as survey, design and supervision is more than 511,111 yuan;

(4) the estimated price of a single contract is lower than the standards specified in items (1), (2) and (3), but the total investment of the project is more than 31 million yuan.

if an invitation to bid can be conducted in accordance with the relevant provisions, those provisions shall prevail.

for a government-invested project that should be subject to tender according to law, if the tenderer handles the tender matters by himself, it shall file with the relevant administrative supervision department. Article 8 A government-invested project shall meet the following conditions before bidding for construction:

(1) If the project needs to be examined and approved according to law, it has gone through the examination and approval procedures and obtained approval;

(2) A construction project planning permit has been obtained for the construction project within the planning area;

(3) Having a bank credit certificate or other documents proving that the source of project funds has been confirmed;

(4) having construction design drawings and technical data that meet the needs of bidding;

(5) The project budget compiled according to the design and construction drawings and relevant technical data has been completed;

(6) Other conditions stipulated by laws, regulations and rules. Ninth government-invested projects that must be subject to construction bidding according to law shall be priced by bill of quantities in bidding. Article 11 The tendering and bidding activities of government-invested engineering projects shall be conducted according to the following procedures:

(1) Issuing a tender announcement;

(2) prepare the tender documents and put them on record;

(3) The tenderer accepts the bid registration and sells the bidding documents or prequalification documents;

(4) site survey and pre-bid question-and-answer meeting;

(5) to examine the qualifications of bidding applicants and determine the short-listed bidders;

(6) bidders submit bid documents;

(7) The tenderer shall set up the bid evaluation committee according to the principle of random selection and on-site notification;

(8) bid opening, evaluation and selection. Eleventh in accordance with the provisions of the government investment projects that must be subject to public bidding, the tenderer shall publish a tender announcement in china economic herald, China Daily, china construction news, Hainan Daily, China Procurement and Bidding Network and Hainan Provincial People's Government website. Among them, the tender announcement of international bidding projects shall be published in China Daily.

on the premise of the tenderer's willingness, the tender announcement can be published in Haikou Evening News, Haikou Municipal People's Government Network and Haikou's tangible construction market at the same time.

the tender announcement shall be filed with the relevant administrative departments before it is issued. Article 12 A tenderer shall compile the tender documents by himself or entrust a tender agency to compile the tender documents. The tender documents shall include the following contents:

(1) an invitation to bid;

(2) Instructions to Bidders;

(3) main terms of the contract;

(4) format of bid documents;

(5) bill of quantities;

(6) technical terms and requirements;

(7) design drawings;

(8) evaluation criteria and methods. Article 13 A tenderer shall determine the reasonable time required for a bidder to prepare the tender documents, and it shall not be less than 21 days from the date when the tenderer starts to issue the tender documents to the date when the bidder submits the tender documents.

if a tenderer makes necessary clarifications or modifications to the issued tender documents, it shall notify all recipients of the tender documents in writing at least 15 days before the deadline for submission of tender documents. This clarification or modification is an integral part of the tender documents.
