Self-employed households refer to business units that are based on individual labor, the means of production are owned by individual workers other than farmers, and the fruits of labor are owned and dominated by individual workers.
According to relevant laws and regulations, self-employed persons include the following persons:
1. Individual industrial and commercial households registered by industrial and commercial administrative authorities at all levels and obtaining business licenses according to regulations. Specifically, it refers to individual workers engaged in industrial, commercial, construction, transportation, catering, service and other activities within the scope permitted by law;
2. A private non-enterprise unit approved by the civil affairs department of the State Council and the civil affairs department of the local people's government at or above the county level, registered and received the Registration Certificate of Private Non-enterprise Unit or the Registration Certificate of Private Non-enterprise Unit;
3, did not receive the "business license" but actually engaged in individual business activities of urban and rural individual business units. However, it does not include some part-time industrial and commercial activities carried out by peasant families to assist labor or use slack time.
Legal basis: Regulations on Individual Industrial and Commercial Households
Twenty-first individual industrial and commercial households can recruit employees according to business needs.
Individual industrial and commercial households shall conclude labor contracts with employed employees in accordance with the law, perform the obligations stipulated in laws, administrative regulations and contracts, and shall not infringe upon the legitimate rights and interests of employees.
Twenty-second individual industrial and commercial households submit false materials to defraud registration, or forge, alter, lease, lend or transfer their business licenses, and the registration authority shall order them to make corrections and impose a fine of less than 4,000 yuan; If the circumstances are serious, the registration or business license shall be revoked.
Twenty-third individual industrial and commercial households registered items change, did not apply for registration of change, the registration authority shall order it to make corrections within a time limit and impose a fine of 1500 yuan; If the circumstances are serious, the business license shall be revoked.
