Article 2 These Measures shall apply to the generation, collection, transportation, disposal and related supervision and management activities of kitchen waste in areas where urbanization management is implemented and areas where centralized management of kitchen waste is implemented.

Article 5 The people's governments of cities and counties (cities, districts) shall incorporate the management of kitchen waste into the joint meeting of the city appearance and environmental sanitation management of the governments at the corresponding levels, and study and solve major problems in the management of kitchen waste. Article 6 The urban management law enforcement department is responsible for supervising and managing the collection, transportation and disposal of kitchen waste, and organizing the implementation of these Measures.

the market supervision and management department is responsible for the supervision and management of food production, processing and circulation, and urges catering service units (catering enterprises, unit canteens and individual catering service operators) to implement the edible oil procurement inspection system, the system of obtaining certificates and tickets and the whole process traceability system. Investigate and deal with illegal acts of food production with kitchen waste as raw materials according to law, and investigate and deal with illegal acts of selling waste edible oil according to law.

the agricultural and rural departments are responsible for the supervision and management of livestock and poultry production sites, investigate and deal with illegal acts of feeding livestock and poultry with kitchen waste without harmless treatment or during the prevention and control of animal diseases, and supervise and manage the processing of fertilizers with kitchen waste as raw materials.

the departments of development and reform, public security, finance, ecological environment, health, commerce, education, etc. shall, according to their respective responsibilities, do a good job in the management of kitchen waste.

township people's governments and sub-district offices shall, according to the arrangement of county (city, district) people's governments, assist relevant departments to do a good job in the management of kitchen waste within their respective jurisdictions. Article 7 It is advocated to reduce the generation of kitchen waste by listing clean vegetables, improving food processing technology, reasonable dining and packaging after meals. Encourage and advocate residents and conditional communities to classify kitchen waste.

encourage and support all kinds of investors to develop and apply kitchen waste technology, and promote the resource utilization and harmless treatment of kitchen waste. Article 8 The kitchen waste disposal fee shall be incorporated into the urban living garbage charging system, and the specific measures and standards for its collection and management shall be formulated separately by the urban management law enforcement department of the city and county (city, district) in conjunction with the development and reform, finance and other departments, and shall be implemented after being reported to the people's government at the same level for approval. during the transitional period before franchise, the people's governments of cities and counties (cities, districts) may designate the sanitation department to be responsible for the collection, transportation and disposal of kitchen waste. Article 11 Urban management law enforcement departments shall sign franchise agreements with kitchen waste collection, transportation and disposal enterprises, and specify the business scope, business term, business area, service standards, liability for breach of contract, etc. Article 11 An enterprise applying for the collection and transportation of kitchen waste shall meet the following conditions:

(1) It has office space, machinery and equipment and parking places for vehicles;

(2) a sealed container for collecting kitchen waste with classified collection function;

(3) Fully-enclosed special kitchen waste collection and transportation vehicles with the functions of preventing odor diffusion, spillage and dripping, and equipped with driving and loading and unloading recorders;

(4) having a legal road transport business license and a vehicle driving license;

(5) Having corresponding technology, quality, safety and monitoring management systems and effectively implementing them;

(6) Other conditions stipulated by laws, regulations and rules. Article 12 An enterprise applying for the disposal of kitchen waste shall meet the following conditions:

(1) The technologies and processes adopted for the disposal of kitchen waste meet the relevant national standards;

(2) Having premises, equipment and relevant professional and technical personnel that meet the requirements of laws and regulations;

(3) It has a sound management system for process operation, equipment management, environmental monitoring and protection, production safety, financial management, metrology and statistics;

(4) It has a feasible technical scheme for the treatment of waste water, waste gas and solid waste in the process of kitchen waste disposal and a discharge scheme that meets the standards, and has installed and used online monitoring equipment in accordance with regulations;

(5) Having a plan for the prevention and control of environmental pollution and emergencies;

(6) Other conditions stipulated by laws, regulations and rules.
