The term "halal food" as mentioned in these Measures refers to meat, meat products, dairy products, cold food, cakes, sweets and other foods made in accordance with the customs and habits of ethnic minorities who eat halal food. Article 3 These Measures shall apply to all kinds of enterprises, individual industrial and commercial households and Muslim restaurants set up in units that produce and operate Muslim food within the administrative area of this Municipality (hereinafter referred to as enterprises, units and individual industrial and commercial households that produce and operate Muslim food).
Enterprises, units and individual industrial and commercial households that produce and operate halal food must abide by the Food Hygiene Law of People's Republic of China (PRC), the Regulations of Inner Mongolia Autonomous Region on Food Vendors and Urban and Rural Fair Trade and other laws and regulations. Article 4 The ethnic affairs departments of the municipal and county people's governments are the administrative departments in charge of the supervision and management of halal food production and operation within their respective jurisdictions, and are responsible for organizing the implementation of these Measures. Health, industry and commerce, urban construction, public security and other departments, according to their respective functions, assist ethnic affairs departments to do a good job in the supervision and management of halal food. Article 5 Among the main leaders or leaders in charge of enterprises and units that produce and operate halal food, there must be an ethnic minority who maintains the customs of halal food, and the legal representatives of private enterprises and individual industrial and commercial households must be ethnic minorities who maintain the customs of halal food. Article 6 Enterprises, units and individual industrial and commercial households that produce and operate halal food shall have a certain proportion of employees of ethnic minorities who are used to muslim food. Engaged in meat products shall not be less than 40% of the total number of employees; Engaged in the catering industry, not less than 30% of the total number of employees; Others shall not be less than 5% of the total number of employees. Seventh enterprises and units that produce and operate halal food, the main personnel who purchase and store their raw materials and finished products must be ethnic minorities who maintain the habits of muslim food; Storage, production, processing, sales and other major posts and links must be supervised by ethnic minorities who maintain muslim food customs.
Muslim food transport vehicles, measuring instruments, production tools, storage containers and processing, storage and sales places must be dedicated. Eighth meat needed for the production and operation of halal food must be purchased from halal slaughterhouses or halal outlets; The source of halal meat allocated from other places shall be indicated, and the relevant certificates of halal food shall be held. Ninth bazaars of halal food and non halal food stalls should keep a certain distance, conditions should be divided into regions.
Non-halal shopping malls and shops selling halal food must set up counters, which are operated by ethnic minorities who maintain the custom of halal food. Tenth enterprises, units and individual industrial and commercial households that produce and operate halal food are prohibited from producing and operating non-halal food and opening non-halal restaurants. Eleventh enterprises, units and individual industrial and commercial households that produce and operate halal food must be approved by the local ethnic affairs departments at or above the county level, and receive halal food business licenses and halal signs (hereinafter referred to as halal cards and certificates). Without approval, the food produced and operated shall not be labeled as halal food. Twelfth halal cards, cards by the Municipal Ethnic Affairs Commission unified producer, halal signs should be hung in a prominent position in the production and business premises.
Muslim cards and certificates are verified once a year. If the Muslim card is lost or damaged, it shall be reissued and replaced at the original issuing department in time.
When enterprises, units and individual industrial and commercial households that produce and operate halal food close down or change jobs, they shall return the halal cards and certificates to the original issuing department and go through the cancellation procedures.
It is forbidden to transfer, sell, lease or forge halal cards and certificates. Thirteenth contracting or leasing non-halal catering places, offering halal catering, all cookers and tableware shall be replaced, and the examination and approval procedures shall be handled in accordance with the provisions of Article 11 of these measures. Fourteenth in violation of these measures, the municipal and county ethnic affairs departments shall be punished according to the following provisions:
(a) in violation of the provisions of article fifth, six or seven of these measures, given a warning and rectification within a time limit; If the circumstances are serious, the Muslim card and certificate shall be confiscated and a fine of 2,000 yuan or more from 500 yuan shall be imposed;
(two) in violation of the provisions of article eighth of these measures, the relevant leaders and the person directly responsible shall be fined from 500 yuan to 2000 yuan;
(three) in violation of the provisions of article ninth of these measures, the operator shall be ordered to make corrections within a time limit; If no correction is made within the time limit, the Muslim card and certificate shall be confiscated and a fine of more than 200 yuan 1000 yuan shall be imposed;
(four) in violation of the provisions of article tenth of these measures, confiscate the illegal income, confiscate the halal card and certificate, and impose a fine of 3000 yuan +65438 yuan;
(five) in violation of the provisions of article eleventh and thirteenth of these measures, it shall be ordered to make corrections within a time limit and impose a fine of more than 2000 yuan in 500 yuan;
(six) in violation of the provisions of the second and third paragraphs of Article 12 of these measures, it shall be ordered to make corrections within a time limit and impose a fine of more than 500 yuan 1000 yuan; In violation of the provisions of the fourth paragraph, the Muslim brand and certificate shall be confiscated and a fine of more than 3000 yuan 1000 yuan shall be imposed.
