Article 21 Whoever engages in business activities such as gas production, storage, transmission and distribution, filling and supply shall obtain a gas business license issued by the municipal competent department. To obtain a gas business license, the following conditions shall be met:

(1) There is a gas business station that meets the requirements of the special plan for gas construction and has passed the acceptance;

(2) It has a stable gas source and a gas storage capacity suitable for the business scale, and the gas quality meets the national standards;

(3) Having operating facilities that meet the national standards, and engaging in the operation of liquefied petroleum gas, there shall also be a residual liquid recovery device;

(4) having professional and technical personnel and other personnel with corresponding qualifications suitable for the business scale;

(5) It has a perfect safety management system and operating rules, and full-time safety production management personnel;

(6) having complete information and files on engineering construction, production and operation, technical equipment and safety production;

(7) having emergency plans for gas supply and accident rescue, and having necessary equipment, spare parts, vehicles and testing instruments for emergency rescue and emergency repair;

(8) Having a safety evaluation report issued by a safety evaluation agency and meeting the requirements of safe operation;

(9) Other conditions stipulated by laws and regulations.

the municipal competent department shall make a decision of approval or disapproval within 21 working days from the date of accepting the application.

article 21 pipeline gas shall be franchised. Those who have not obtained the franchise right according to law shall not engage in pipeline gas business activities.

article 22 if a gas enterprise establishes branches such as gas receiving station, storage station, storage and distribution station, filling station and gas vehicle filling station, it shall be approved by the municipal competent department.

To set up a bottled gas supply station, it shall meet the following conditions and be approved by the local competent department:

(1) It has a Shenzhen gas business license and an enterprise legal person business license;

(2) The setting of the site conforms to the special plan for gas construction;

(3) It has a fixed place and facilities that are suitable for its business scale and meet the safety conditions;

(4) having a sound safety management system and an emergency plan for emergency repair of gas accidents;

(5) having professional and technical personnel and other personnel with corresponding qualifications suitable for the scale of operation;

(6) Other conditions stipulated by laws and regulations.

the municipal and district authorities shall make a decision of approval or disapproval within fifteen working days from the date of accepting the application.

Article 23 A gas enterprise setting up a bottled gas service point shall meet the following conditions:

(1) It has a Shenzhen gas business license and an enterprise legal person business license;

(2) It has a legal business place;

(3) The service point is located within five kilometers of the bottled gas supply station of this enterprise;

(4) The total volume of gas cylinders stored at service points shall not exceed 1.36 cubic meters;

(5) meeting the corresponding safety management regulations.

gas enterprises that set up bottled gas service points shall report to the local district authorities for the record, and go through industrial and commercial registration with the administrative department for industry and commerce. The district competent department shall send a copy of the filing information to the relevant competent departments such as fire protection and publish it on the relevant government websites.

article 24 if the equity, company name, registered address (business premises) and legal representative of a gas enterprise are changed, it shall be reported to the municipal competent department for the record within 31 days from the date of handling the change registration.

article 25 whoever engages in the installation and maintenance of gas appliances shall obtain the installation and maintenance license of gas appliances issued by the municipal competent department. To obtain a license for installation and maintenance of gas appliances, the following conditions shall be met:

(1) Having a business place suitable for the scale of installation and maintenance;

(2) having professional technicians and other employees suitable for the scale of installation and maintenance;

(3) having professional equipment, maintenance tools and spare parts suitable for the scale of installation and maintenance;

(4) having a sound management system and service standards;

(5) Other conditions stipulated by laws and regulations.

the municipal competent department shall make a decision of approval or disapproval within fifteen working days from the date of accepting the application.

article 26 gas enterprises, their branches, and gas appliance installation and maintenance enterprises shall not allow others to engage in gas business or installation and maintenance of gas appliances in their own names by means of leasing, lending, contracting or linking.

article 27 gas enterprises shall not provide operating gas sources to units and individuals that have not obtained gas business licenses.

no unit or individual may purchase gas from any unit or individual that has not obtained a gas business license.

article 28 implements the system of recording and publicizing bad behaviors of gas enterprises and employees. The specific measures shall be formulated separately by the municipal competent department.
