The term "environmental noise pollution" as mentioned in these Measures refers to the phenomenon that the environmental noise discharged exceeds the environmental noise standard stipulated by the state and hinders people's work, study, life and other normal activities. Article 4 All units and individuals who are in the standard area and enter the standard area must abide by these measures. Article 5 Basic requirements of standard areas:
(a) the average equivalent sound level of environmental noise in each functional area in the standard area must be controlled within the implementation of environmental noise emission standards;
(two) more than 90% of the fixed noise sources in the standard area shall not exceed the boundary noise standard of industrial enterprises implemented in this area; The boundary noise of fixed noise sources that do not meet the emission standards shall not exceed the standard 5db；;
(three) the construction noise in the standard area shall not exceed the noise limit of the construction site, and there are specific provisions on the management of construction noise in this area;
(four) there are specific and perfect control measures and management regulations for road traffic noise and social life noise in the standard area. Article 6 Ningbo Environmental Protection Bureau is the competent department in charge of unified supervision and management of the city's standard areas, and is responsible for the organization and coordination, business guidance, statistical summary, inspection and supervision of noise management. County (city, district) environmental protection department is responsible for the unified supervision and management of the standard areas within its jurisdiction. Seventh industrial noise, construction noise by the environmental protection department to implement specific management; Road traffic noise and social life noise are specifically managed by the public security department; Other traffic noise is managed by transportation, railway, civil aviation and other departments according to their respective responsibilities. Article 8 Sub-district offices in standard areas shall designate full-time or part-time environmental protection personnel to assist relevant departments in the supervision and management of industrial noise, construction noise and social life noise within their respective jurisdictions. Ninth city and county (city, district) environmental protection departments should set up signs in the standard area. Tenth all new construction, expansion, renovation and technical transformation projects that produce noise shall be attended by environmental protection departments. The facilities for the prevention and control of noise pollution must be designed, constructed and put into operation simultaneously with the main project in accordance with the corresponding regional environmental noise standards. Eleventh enterprises and institutions that may cause noise pollution, after monitoring unqualified, should be treated within a time limit. Before reaching the standard, the environmental protection department will levy excessive sewage charges; Fails to meet the standards, double the excessive sewage charges. Article 12 Units that cause environmental noise pollution shall report and register with the environmental protection department in accordance with the regulations, establish and improve the noise management rules and regulations of their own units, designate full-time (part-time) personnel to be responsible for regular inspection and timely maintenance of noise prevention facilities, so as to make them operate normally. Article 13 The radiated noise level of motor vehicles must conform to the National Allowable Noise Standard for Motor Vehicles (CB 1495-79-79), and it is strictly forbidden for motor vehicles whose noise level does not conform to the national standard to drive on the road. It is forbidden for all kinds of motor vehicles to use air horns, and it is not allowed to call people or doors with horns. Fourteenth kinds of ship transportation and operation noise must comply with the "urban regional environmental noise standard". Fifteenth tractors are prohibited from entering the standard area. Special circumstances must be approved by the public security organ, and the holder must drive according to the prescribed route within the prescribed time. Sixteenth streets, squares, parks, shops, theaters, video halls, dance halls, karaoke halls, schools and other public places must meet the environmental noise standards in this area. Seventeenth units and individuals in the standard area shall not affect the rest, work and study of others when using various audio equipment and carrying out other activities, and the sound level of their radiation must meet the environmental noise standards in this area. Eighteenth construction units to the surrounding environment noise emissions, shall not exceed the national provisions of the "construction site noise limit". Article 19 The construction unit shall submit a declaration to the 15 environmental protection department before the project starts, and fill in the registration form of noise declaration on the construction site as required, and take active and effective prevention and control measures. Twentieth in addition to emergency repair and rescue operations, it is forbidden to carry out construction operations that produce noise pollution and affect residents' rest at night. Because of the production process or special needs, it is really necessary to work continuously day and night, and it must be approved by the environmental protection department. Article 21 When the noise emitted by the construction unit exceeds the noise limit of the construction site stipulated by the state and endangers the surrounding living environment, the environmental protection department shall report to the people's government at the same level for approval and then adjust or limit its construction time.
