What are the provisions of the Food Safety Law on food inspection and inspector responsibility system?
Food inspection shall be carried out under the responsibility system of food inspection institutions and inspectors. The food inspection report shall be stamped with the official seal of the food inspection agency and signed or sealed by the inspectors. Food inspection agencies and inspectors are responsible for the food inspection reports issued.

Food standards include the following items:

1. Provisions on the limits of pathogenic microorganisms, pesticide residues, veterinary drug residues, heavy metals, pollutants and other substances harmful to human health in food-related products;

2 varieties, scope of use and dosage of food additives;

3. Nutritional requirements of infant's main and supplementary food;

4. Requirements for labels, labels and instructions related to food safety and nutrition;

5. Quality requirements related to food safety.

Food producers and operators need to be responsible for the food safety of their production and operation, the society and the public, and bear social responsibilities. Therefore, food safety standards are mandatory standards.

In food inspection, food inspection agencies and inspectors have corresponding rights and obligations, and once they violate their legal obligations, they will bear legal responsibilities. According to the provisions of relevant laws and regulations, food inspection agencies need to fulfill the following obligations:

First, we must have the corresponding testing conditions and capabilities, including establishing and improving the organization of the content department; The basic rules, working procedures and management system of inspection work are also implemented; Having inspectors who are familiar with relevant inspection business and relevant knowledge; Having instruments, equipment and other technical equipment suitable for the inspection business; Have an inspection environment to ensure the quality of inspection work. Once this obligation is violated, the inspection qualification of the food inspection agency will be revoked.

Second, we must ensure that science is fair, honest and efficient, and issue objective and fair inspection results. We must not falsify the inspection results or issue false certificates.

In previous laws and regulations, the responsibility of ensuring the objectivity and fairness of food inspection reports mainly belongs to food inspection institutions, and it is often not clearly stipulated whether inspectors have the responsibility to ensure the objectivity and fairness of food inspection reports. Knowing that the inspection results are forged or false certificates are issued, the inspectors, as other directly responsible persons, should also bear corresponding legal responsibilities. In order to strengthen the sense of responsibility of inspectors, balance the rights and obligations of inspection institutions and inspectors, and rationalize the responsibility sharing mechanism, the law clearly stipulates that food inspection institutions and inspectors are responsible for food inspection, food inspection institutions are responsible for food inspection reports issued, and food inspection institutions affix official seals to food inspection reports, and inspectors sign or seal them. The juxtaposition of food inspection institutions and inspectors is a continuation of the independent inspection right given to inspectors in the previous article. Changing the past practice that inspectors are completely subordinate to food inspection institutions will not only increase the responsibilities of inspectors, but also help to enhance their professional status, give play to their subjective initiative, and form a binding mechanism between food inspection institutions and inspectors, which will certainly promote the improvement of food inspection level and ensure food safety in China.

Article 86 Food inspection institutions and inspectors shall be responsible for food inspection. The food inspection report shall be stamped with the official seal of the food inspection agency and signed or sealed by the inspectors. Food inspection agencies and inspectors are responsible for the food inspection reports issued.

Article 2 Whoever engages in the following activities within the territory of People's Republic of China (PRC) shall abide by this Law:

(a) food production and processing (hereinafter referred to as food production), food sales and catering services (hereinafter referred to as food business);

(2) Production and operation of food additives;

(3) Production and operation of packaging materials, containers, detergents and disinfectants for food and tools and equipment for food production and operation (hereinafter referred to as food-related products);

(four) the use of food additives and food-related products by food producers and operators;

(5) Storage and transportation of food;

(6) Safety management of food, food additives and food-related products.

The quality and safety management of edible agricultural products (hereinafter referred to as edible agricultural products) shall comply with the provisions of the Law of People's Republic of China (PRC) on the Quality and Safety of Agricultural Products. However, the sales of edible agricultural products, the formulation of relevant quality and safety standards, the publication of relevant safety information and the provisions of this law on agricultural inputs shall abide by the provisions of this law.
