article 2 these measures shall apply to the safety management of the production, storage, use, operation and transportation of hazardous chemicals within the administrative area of this province.
article 3 the safety management of hazardous chemicals shall adhere to the principle of safety first, prevention first and comprehensive management, establish and improve the mechanism of unified leadership by the government, supervision by departments according to law, overall responsibility of enterprises and social participation supervision, and strengthen and implement the main responsibility of enterprises.
article 4 the people's governments at or above the county level shall strengthen the leadership over the safety management of hazardous chemicals, formulate and organize the implementation of the safety development plan of hazardous chemicals, and establish the annual target of safe production of hazardous chemicals.
the responsibility system for the safety management of hazardous chemicals shall be implemented by the chief executive of the people's government, and the principal responsible persons of the people's government shall take overall responsibility for the safety management of hazardous chemicals.
article 5 the people's governments at or above the county level shall regard the safety supervision and management of hazardous chemicals as an important part of the annual assessment of the target responsibility system for safe production, and carry out administrative accountability for units and individuals that fail to implement the responsibility for safety supervision and management of hazardous chemicals.
article 6 the people's governments at or above the county level shall establish a joint meeting system for the safety supervision and management of hazardous chemicals, support and urge the relevant departments (hereinafter referred to as departments responsible for the safety supervision and management of hazardous chemicals) to perform their duties according to law, and coordinate and solve major problems existing in the safety management of hazardous chemicals.

Article 7 Departments responsible for the safety supervision and management of hazardous chemicals shall perform their duties in accordance with the following provisions:
(1) The safety production supervision and management department shall be responsible for the comprehensive work of the safety supervision and management of hazardous chemicals, conduct safety condition review on construction projects (hereinafter referred to as hazardous chemicals construction projects) that are newly built, rebuilt, expanded for production and storage of hazardous chemicals, and issue hazardous chemicals safety production licenses, hazardous chemicals safety use licenses and hazardous chemicals business licenses.
(2) The public security organs are responsible for the public safety management of hazardous chemicals, issuing purchase licenses and road transport passes for highly toxic chemicals, and for the road traffic safety management of vehicles transporting hazardous chemicals. The fire control institution of the public security organ shall supervise and inspect the compliance of units that produce, store, use, manage and transport dangerous chemicals (hereinafter referred to as dangerous chemicals units) with fire control laws and regulations.
(3) The quality supervision, inspection and quarantine department is responsible for issuing the industrial product production licenses of enterprises that produce dangerous chemicals and their packages and containers (excluding large fixed storage tanks for storing dangerous chemicals, the same below), supervising the quality of their products according to law, and inspecting the import and export of dangerous chemicals and their packages. Special equipment inspection and testing institutions shall inspect and test the special equipment involved in dangerous chemicals units according to law, and bear legal responsibility for their inspection and testing results and appraisal conclusions.
(4) The competent department of environmental protection shall, according to the Catalogue of Hazardous Chemicals under Key Environmental Management published by the Ministry of Environmental Protection, carry out environmental risk assessment of hazardous chemicals under key environmental management for enterprises producing and using hazardous chemicals, and be responsible for environmental management registration of hazardous chemicals and new chemicals; Investigate environmental pollution accidents and ecological damage incidents related to hazardous chemicals according to the division of responsibilities, and be responsible for emergency environmental monitoring at the scene of hazardous chemicals accidents.
(5) The competent department of transportation is responsible for the license of road transport and waterway transport of dangerous chemicals and the safety management of transport vehicles, supervising the safety of waterway transport of dangerous chemicals, and determining the qualifications of drivers, crew members, loading and unloading management personnel, escorts, declaration personnel and on-site inspectors of container packing enterprises. The competent railway department is responsible for the safety management of railway transportation of dangerous chemicals, and for the qualification examination and approval of the carriers and shippers of railway transportation of dangerous chemicals and the safety management of their means of transport. The competent civil aviation authority is responsible for the air transport of dangerous chemicals and the safety management of air transport enterprises and their means of transport. article 13 units that use hazardous chemicals shall meet the requirements of laws and administrative regulations, national standards and industrial standards, and establish and improve the safety management rules and regulations and safe operation procedures for the use of hazardous chemicals according to the types, hazardous characteristics, usage amount and usage mode of hazardous chemicals, so as to ensure the safe use of hazardous chemicals.

Article 15 A construction project of hazardous chemicals shall be put into trial production (use) according to law. Article 16 Units that produce, store and use hazardous chemicals shall set up safety production management institutions with relatively independent functions and separate from production scheduling, and be equipped with full-time safety production management personnel.
Full-time safety production management personnel shall be no less than 2% of the total number of employees, with at least 2 employees; Full-time safety production management personnel shall obtain the qualification certificate of dangerous chemicals safety management personnel. Units engaged in the production, storage and use of hazardous chemicals with more than 511 employees shall be equipped with registered safety engineers or registered assistant safety engineers for dangerous goods safety according to the proportion of not less than 31% of the safety production management personnel; If there are less than 511 employees, at least 1 registered safety engineers or registered assistant safety engineers shall be equipped.
Article 17 The principal responsible person, safety responsible person and technical responsible person of the production, storage and use unit of hazardous chemicals shall have certain chemical professional knowledge or have more than 3 years working experience in the chemical industry, and at least 1 of them shall have a bachelor's degree or above in chemical engineering, and have obtained the qualification certificate of hazardous chemicals safety management personnel.
Operators of hazardous chemical processes should receive professional training, obtain the qualification certificate of special operators and hold relevant certificates.
Article 18 Units producing, storing and using hazardous chemicals shall set up obvious safety warning signs on their workplaces, safety facilities and equipment; Places with major hazard sources of hazardous chemicals shall be equipped with safety warning signs for major hazard sources and well-known safety signs for hazardous substances.
article 19 dangerous chemicals pipelines and their ancillary facilities buried, on the ground and overhead by units producing, storing and using dangerous chemicals outside the factory area shall be clearly marked, a patrol system shall be established and improved, and special personnel shall be equipped for daily patrol. Article 22 A unit that produces, stores and uses hazardous chemicals shall entrust an institution with the qualifications stipulated by the state to conduct a safety evaluation on its safety production conditions every three years; Production units involved in petrochemical industry, synthetic ammonia, sulfuric acid and highly toxic chemicals shall entrust a safety evaluation institution with Grade A qualification for evaluation.
