Chapter I General Principles
Article 1 In order to strengthen the management of public health emergencies and infectious disease epidemic monitoring information reporting, provide scientific prevention and control decision-making information in time, effectively prevent, control and eliminate the hazards of public health emergencies and infectious diseases in time, and ensure public health and life safety, according to the Law of People's Republic of China (PRC) on the Prevention and Control of Infectious Diseases (hereinafter referred to as the Law on the Prevention and Control of Infectious Diseases) and the Emergency Regulations on Public Health Emergencies.
Article 2 These Measures shall apply to the management of public health emergencies and infectious disease epidemic monitoring information reporting as stipulated in the Law on the Prevention and Control of Infectious Diseases, Emergency Regulations and relevant national laws and regulations.
Third public health emergencies and infectious disease epidemic monitoring information report should adhere to the principle of management according to law, grading responsibility, fast and accurate, safe and efficient.
Article 4 The administrative department of public health of the State Council shall exercise unified supervision and management over the national information reports on public health emergencies and epidemic situation of infectious diseases.
The local health administrative departments at or above the county level shall supervise and manage the monitoring information reports of public health emergencies and infectious diseases within their respective administrative areas.
Article 5 The health administrative department of the State Council and the health administrative departments of provinces, autonomous regions and municipalities directly under the Central Government shall encourage and support the scientific and technological research and international exchanges and cooperation in the management of public health emergencies and the monitoring information report of infectious diseases.
Article 6 The people's governments at or above the county level and their health administrative departments shall commend and reward those who have made contributions to the management of public health emergencies and the information reporting of infectious disease epidemic monitoring.
Article 7 Any unit or individual must timely and truthfully report information on public health emergencies and epidemic situation of infectious diseases in accordance with regulations, and shall not conceal, delay reporting, make false reports or instruct others to conceal, delay reporting or make false reports.
Chapter II Organization and Management
Eighth disease prevention and control institutions at all levels shall, in accordance with the professional division of labor, undertake the monitoring, information reporting and management of public health emergencies and infectious diseases within the scope of their duties. Specific responsibilities are:
(a) according to the principle of territorial management, local disease prevention and control institutions are responsible for the monitoring, information reporting and management of public health emergencies and infectious diseases within their respective administrative areas; Responsible for collecting and verifying information materials such as public health emergencies and epidemic information within the jurisdiction; Set up a special hotline for reporting and consulting, and accept the reporting, consulting and supervision of public health emergencies and epidemics; Set up special personnel to collect public health emergencies and epidemic information from various channels.
(two) the establishment of epidemiological investigation teams and laboratories, responsible for on-site epidemiological investigation and handling, searching for close contacts, tracking the source of infection, and conducting isolated observation when necessary; Disinfection of epidemic spots and its technical guidance; Laboratory tests and reports of samples.
(three) responsible for the maintenance and management of public health information network, reporting, analysis, utilization and feedback of epidemic information; Establish a monitoring information database and carry out technical guidance.
(4) The epidemic reports of key foreign-related institutions or units shall be managed, inspected and guided by the disease prevention and control institutions at or above the provincial level.
(five) to be responsible for the training and guidance of personnel, and to carry out professional training for the staff of the disease prevention and control institutions at lower levels; Provide technical guidance on the epidemic situation report and information network management of hospitals and lower-level disease prevention and control institutions within their jurisdiction.
Article 9 The State establishes a public health information monitoring system, and constructs an information network system covering national, provincial, municipal (prefectural) and county (district) disease prevention and control institutions, medical and health institutions and health administrative departments, and extending to townships (towns), villages and urban communities.
The state has established a public health information management platform, a basic health resource database and management application software to meet the needs of information collection, summary, analysis and reporting of public health emergencies, legal infectious diseases, public health and special disease monitoring.
Tenth medical institutions at all levels shall undertake the task of reporting the monitoring information of public health emergencies and infectious diseases within the scope of their duties, and the specific duties are as follows:
(a) the establishment of public health emergencies and infectious disease epidemic information monitoring and reporting system, including report card and general register, epidemic report, inspection, self-examination, rewards and punishments.
(two) the implementation of the first diagnosis responsibility system, strict outpatient work log system and public health emergencies and epidemic reporting system, responsible for public health emergencies and epidemic monitoring information reporting.
(three) to establish or designate special departments and personnel, equipped with the necessary equipment, to ensure that public health emergencies and epidemic monitoring information through the network direct reporting.
Outpatient department, clinic, health center (room), etc. We should report to the disease prevention and control institution in the disease-stricken area by the fastest communication method within the prescribed time limit, and report the infectious disease report card at the same time.
The mailing envelope of the report card should be printed with obvious signs of "public health emergencies or epidemics" and the words accepted by XX disease prevention and control institutions.
(four) training for doctors and interns in public health emergencies and infectious disease epidemic monitoring information reporting.
(five) cooperate with the disease prevention and control institutions to carry out epidemiological investigation and sample sampling.
Eleventh clinics are responsible for reporting, handling, epidemic registration and statistics of public health emergencies and infectious disease patients, pathogen carriers and suspected infectious disease patients among floating personnel.
Article 12 When medical and health institutions affiliated to railways, transportation, civil aviation and factories (fields) and mines find public health emergencies and infectious diseases, they shall report to the local county-level disease prevention and control institutions in accordance with the principle of territorial management.
Thirteenth military public health emergencies and infectious diseases monitoring information, by the health administrative department of the China People's Liberation Army in accordance with the relevant provisions of the direct report to the health administrative department of the State Council.
The medical and health institutions affiliated to the army shall report to the local disease prevention and control institutions in accordance with the principle of territorial management when they find infectious disease patients, pathogen carriers and suspected infectious disease patients in local outpatient clinics.
Fourteenth medical and health personnel shall not disclose the names, addresses and personal medical histories of patients with infectious diseases and their families to the public in any form without the consent of the parties concerned.
Fifteenth health administrative departments of governments at all levels shall regularly supervise, inspect and guide the reporting of public health emergencies and infectious disease epidemic monitoring information that medical and health institutions at all levels within their respective jurisdictions are responsible for.
Chapter III Report
Sixteenth medical institutions at all levels, disease prevention and control institutions, blood collection and supply institutions are responsible reporting units; Personnel performing their duties, rural doctors and individual doctors are responsible epidemic reporters, who must report the epidemic situation in accordance with the provisions of the Law on the Prevention and Control of Infectious Diseases and fulfill their obligations as prescribed by law.
Seventeenth responsible reporters should fill in the infectious disease report card immediately after the first diagnosis of infectious disease patients.
Infectious disease report cards shall be kept by the card recording unit for three years.
Article 18 When the responsible reporting unit and the responsible epidemic reporter find patients or suspected patients infected with highly pathogenic avian influenza in Class A infectious diseases and Class B infectious diseases, or find other infectious diseases and unexplained disease outbreaks, they shall report the infectious disease report card through the network within 2 hours; The responsibility reporting unit that has not implemented direct reporting through the Internet shall report to the local county-level disease prevention and control institutions by the fastest communication method (telephone and fax) within 2 hours, and issue an infectious disease report card within 2 hours.
For other B and C infectious disease patients, suspected patients and infectious disease pathogen carriers who need to be reported, after diagnosis, the responsible reporting unit that implements direct online reporting shall conduct online reporting within 24 hours; The responsible reporting unit that has not implemented direct reporting on the Internet shall issue an infectious disease report card within 24 hours.
County-level disease prevention and control institutions shall report infectious diseases directly through the network within 2 hours after receiving the infectious disease report card submitted by the reporting unit without the conditions of direct network reporting.
Nineteenth responsible reporting units and responsible reporters who have obtained information about public health emergencies shall report to the professional institutions designated by the local health administrative department by telephone or fax within 2 hours. With the conditions of online direct reporting, online direct reporting shall be carried out at the same time, and the direct reporting information shall be audited by designated professional institutions and entered into the national database. Responsibility reporting units and responsibility reporters who do not have the conditions for direct online reporting should use the fastest communication method to submit the information report card of public health emergencies to the professional institutions designated by the local health administrative department. The professional institutions that receive the information report card of public health emergencies should review the information to determine its authenticity, conduct direct online reporting within 2 hours, and report to the health administrative department at the same level by telephone or fax.
The health administrative department that receives the information report of public health emergencies shall organize relevant experts to conduct on-site investigation as soon as possible. If it is confirmed that a public health emergency does occur, it shall timely organize and take corresponding measures according to different levels, and report to the people's government at the same level within 2 hours, and also report to the health administrative department of the people's government at the next higher level. If the standard of public health emergencies has not been reached, professional prevention and control institutions will closely follow the development of the situation and report the changes at any time.
Twentieth public health emergencies and other matters of infectious disease information reporting in accordance with the relevant provisions of the "public health emergencies related information reporting management standards (Trial)" and "infectious disease information reporting management standards".
Chapter IV Investigation
Twenty-first after receiving the report of public health emergencies, the local health administrative department shall immediately organize forces to investigate and verify the nature of the reported matters, take necessary control measures, and report the investigation in time.
The investigation of different types of public health emergencies shall be conducted in accordance with the provisions of the national emergency plan for public health emergencies.
Twenty-second public health emergencies and infectious diseases on-site investigation should include the following work:
(a) epidemiological case investigation, follow-up investigation of close contacts and investigation of epidemic causes, incidence and possible factors of infectious diseases;
(2) Sampling, technical analysis and inspection of relevant specimens or samples;
(3) Confirmation of public health emergencies;
(four) health monitoring, including the scope and severity of pollution of living resources, should be carried out at the same time in the place where the emergency occurred and neighboring provinces and cities when necessary.
Twenty-third health administrative departments at all levels shall organize disease prevention and control institutions and professionals in other related fields to establish epidemiological investigation teams to be responsible for the epidemiological investigation of public health emergencies and infectious diseases.
Twenty-fourth disease prevention and control institutions shall take the following measures in time when they find the epidemic situation of infectious diseases or receive the report of the epidemic situation of infectious diseases:
(1) Conduct epidemiological investigation on the epidemic situation of infectious diseases, put forward suggestions on delineating epidemic spots and epidemic areas according to the investigation, carry out sanitary treatment on polluted places, conduct medical observation on close contacts in designated places and take other necessary preventive measures, and put forward epidemic control plans to the administrative department of health;
(2) When an infectious disease breaks out and spreads, carry out sanitary treatment on the epidemic spot and epidemic area, put forward an epidemic control plan to the administrative department of health, and take measures according to the requirements of the administrative department of health;
(three) to guide the disease prevention and control institutions at lower levels to implement the prevention and control measures of infectious diseases, and to organize and guide the relevant units to deal with the epidemic situation of infectious diseases.
Twenty-fifth disease prevention and control institutions at all levels are responsible for the management of the national information system for monitoring and reporting public health emergencies and infectious diseases, and reporting units at all levels use a unified information system for reporting.
Twenty-sixth medical institutions at all levels should actively cooperate with the professionals of disease prevention and control institutions to investigate, sample and deal with public health emergencies and infectious diseases.
Chapter V Information Management and Notification
Twenty-seventh medical institutions at all levels and departments related to the diagnosis and treatment of infectious diseases shall establish outpatient logs, hospitalization registers and epidemic registers of infectious diseases.
Twenty-eighth departments and personnel designated by various medical institutions at all levels are responsible for receiving, sending and checking the report cards of public health emergencies and infectious diseases in their own units, establishing a register of infectious disease reports, and uniformly filling out relevant reports.
Twenty-ninth county-level disease prevention and control institutions are responsible for receiving, sending, checking, reporting and managing the report cards and statements of public health emergencies and infectious diseases within their respective jurisdictions.
Disease prevention and control institutions at all levels shall, in accordance with the requirements of the national public health monitoring system network system platform, make full use of the reported information, and establish a regular analysis and notification system for public health emergencies and infectious diseases. During routine monitoring, the epidemic situation shall be analyzed and reported at least three times a month, and in case of emergency, the epidemic situation shall be analyzed and reported daily.
Article 30 When the disease prevention and control institutions designated by the health administrative department at the place where the frontier port is located, the disease prevention and control institutions such as ports, airports and railways, and the frontier health and quarantine institutions find the quarantinable infectious diseases stipulated in the Frontier Health and Quarantine Law, they shall notify each other of the epidemic situation.
Article 31 When people and livestock are found to be suffering from infectious diseases, the local disease prevention and control institutions and the agriculture and forestry departments shall notify each other of the epidemic situation.
Article 32 The administrative department of public health in the State Council shall report and publish public health emergencies and infectious diseases in a timely manner, and the administrative department of public health of the people's governments of provinces (autonomous regions and municipalities directly under the Central Government) shall report and publish public health emergencies and infectious diseases in their respective administrative areas in a timely manner according to the authorization of the administrative department of public health in the State Council.
Public health emergencies and infectious diseases include:
The nature and causes of public health emergencies and infectious diseases;
(two) the occurrence and scope of public health emergencies and infectious diseases;
(three) the incidence of public health emergencies and infectious diseases, the number of casualties and the scope of personnel involved;
(four) measures and control of public health emergencies and infectious diseases;
(five) the termination of public health emergencies and infectious diseases.
Measures for communication and notification with Hong Kong, Macao and Taiwan, relevant countries and the World Health Organization shall be formulated separately.
Chapter VI Supervision and Administration
Article 33 The administrative department of public health of the State Council shall supervise and guide the management of the national monitoring information report on public health emergencies and infectious diseases.
The health administrative departments of the local people's governments at or above the county level shall supervise and guide the management of information reporting on public health emergencies and epidemic situation of infectious diseases within their respective administrative areas.
Thirty-fourth health supervision institutions at all levels under the leadership of the administrative department of health, specifically responsible for the supervision and inspection of the administrative area of public health emergencies and infectious disease epidemic monitoring information reporting management.
Thirty-fifth disease prevention and control institutions at all levels under the leadership of the administrative department of health, specifically responsible for the administrative area of public health emergencies and infectious disease epidemic monitoring information reporting management technical guidance.
Thirty-sixth medical and health institutions at all levels under the leadership of the administrative department of health, actively carry out the management of public health emergencies and infectious disease epidemic monitoring information report.
Article 37 Any unit or individual who discovers that the responsible reporting unit or responsible epidemic reporter has concealed, delayed reporting or lied about public health emergencies and infectious diseases shall report to the local health administrative department.
Chapter VII Punishment
Thirty-eighth medical institutions have one of the following acts, the local health administrative department at or above the county level shall order them to make corrections, and informed criticism shall give them a warning; If the circumstances are serious, in conjunction with the relevant departments, the principal responsible person, the responsible person in charge and other responsible personnel shall be given administrative sanctions of demotion and dismissal according to law; Whoever causes the spread and epidemic of infectious diseases or other serious harmful consequences to public health and constitutes a crime shall be investigated for criminal responsibility in accordance with the Criminal Law:
(a) the infectious disease reporting system has not been established;
(two) did not specify the relevant departments and personnel responsible for the management of infectious disease epidemic report;
(3) Concealing, delaying or making false reports about patients with infectious diseases, pathogen carriers and suspected patients.
Thirty-ninth disease prevention and control institutions have one of the following acts, the local health administrative department at or above the county level shall order it to make corrections, and informed criticism shall give it a warning; The main person in charge, the responsible person in charge and other responsible personnel shall be given administrative sanctions of demotion and dismissal according to law; Causing the spread and epidemic of infectious diseases or causing other serious harmful consequences to public health, which constitutes a crime, shall be investigated for criminal responsibility according to law:
(1) Concealing, delaying reporting or lying about the patients, pathogen carriers and suspected patients of infectious diseases found;
(two) did not establish a special epidemiological investigation team to carry out epidemiological investigation of infectious diseases;
(three) after receiving the report on the epidemic situation of infectious diseases, failing to send people to conduct on-site investigation according to the regulations;
(four) failing to report the epidemic situation or public health emergencies in accordance with the provisions.
Fortieth medical and health personnel who perform their duties conceal, delay reporting or lie about the epidemic situation of infectious diseases shall be given a warning by the health administrative department at or above the county level. If the circumstances are serious, it shall be ordered to suspend its practice activities for more than six months and less than one year, or its practice certificate shall be revoked.
Where the responsible reporting unit and the incident occurrence unit conceal, delay reporting, falsely report or instruct others not to report public health emergencies or infectious diseases, the main leaders, responsible persons and persons directly responsible shall be given administrative sanctions by their units or the competent authorities at higher levels, resulting in serious consequences such as the spread of the epidemic or the deterioration of the situation, and criminal responsibility shall be investigated by judicial organs.
Article 41 If an individual or private medical and health institution conceals, delays reporting or falsely reports the epidemic situation of infectious diseases or public health emergencies, the health administrative department at or above the county level shall order it to make corrections within a time limit and may impose a fine of more than 500 yuan 100 yuan; Causing public health emergencies and the spread of infectious diseases, it shall be ordered to suspend business for rectification, and may be fined more than 2,000 yuan in 200 yuan. Those who violate the criminal law shall be handed over to judicial organs for criminal responsibility.
Article 42 If the health administrative department at or above the county level fails to perform the duties of reporting public health emergencies and infectious diseases in accordance with the regulations, and conceals, delays reporting, falsely reports or instructs others to conceal, delay reporting or falsely reports, the principal responsible person shall be given administrative sanctions of demotion or dismissal according to law; Those who cause the spread and epidemic of infectious diseases or cause other serious harmful consequences to the public shall be dismissed; If a crime is constituted, criminal responsibility shall be investigated according to law. Chapter VIII Supplementary Provisions
