article 1 in order to prevent and reduce fire hazards in public gathering places, protect citizens' personal lives, public property and the safety of citizens' property, and safeguard public safety, in accordance with the Fire Prevention Law of the People's Republic of China, the Provisions of the State Council on the Investigation of Administrative Responsibility for Extraordinary Safety Accidents, the Measures of Hunan Province for the Implementation of the Fire Prevention Law of the People's Republic of China and the State, and others. Article 2 The term "public gathering place" as mentioned in these Measures refers to the following places with a certain scale that are open to the public:

(1) theaters, video halls, dance halls, karaoke halls, music cafes, indoor amusement halls, auditoriums with performance and projection functions and other public entertainment places;

(2) hotels, restaurants, restaurants, guest houses and other public dining and accommodation places;

(3) public leisure places such as bars, Internet cafes, oxygen bars, coffee houses, beauty salons, and foot bathrooms;

(4) public sports and fitness places such as stadiums, bowling alleys, billiards halls, gymnasiums, roller skating rinks and indoor shooting ranges;

(5) foreign business places such as finance, insurance, telecommunications and postal services, and business places such as shopping malls, bazaars and securities trading places;

(6) Museums, art galleries, libraries, exhibition halls, youth palaces, cultural palaces, clubs, mass art museums and other places engaged in scientific and cultural activities;

(7) airports, stations, docks, parking lots and other public places;

(8) hospitals, nursing homes and boarding schools, kindergartens and nurseries;

(9) places for mass activities such as order fairs, exhibitions, trade fairs, expositions, material exchanges, large-scale gatherings, fireworks parties, lantern festivals and temple fairs;

(11) Other crowded public places. Article 3 A public gathering place of a certain scale as mentioned in these Measures refers to a public gathering place under any of the following circumstances:

(1) An indoor public gathering place with a building area of more than 51 square meters or a rated number of more than 51 people;

(2) an outdoor public gathering place with an area of more than 511 square meters and a rated number of more than 1,111 people;

(3) Public gathering places located in underground buildings.

if there are other provisions in laws and regulations on the scale of public gathering places, those provisions shall prevail. Fourth people's governments at all levels in this province should strengthen the leadership of fire control work in public gathering places.

the public security fire control institutions of the people's governments at or above the county level are responsible for supervising and managing the fire control work in public gathering places. The police station can be entrusted by the county (city, district) public security fire control institutions to supervise and manage the fire safety of public gathering places within its jurisdiction in the name of the competent public security fire control institutions.

the relevant administrative departments of the people's governments at or above the county level, such as construction, culture, health, sports, industry and commerce, economy and trade, education, radio, film and television, tourism, etc., shall do a good job in the fire safety management of public gathering places within their respective functions and duties. Fifth public security fire control institutions shall be responsible for the supervision and management of fire safety in public gathering places at different levels, and the public security fire control institutions at higher levels shall guide, supervise and inspect the fire control supervision and management of public security fire control institutions at lower levels. Supervision and management shall not be repeated. Sixth new construction, expansion, renovation, interior decoration and change of use of public gathering places, should be submitted to the public security fire control institutions for examination and acceptance.

before public gathering places are put into use, opened for business and mass activities are held, they shall apply to public security fire control institutions for fire safety inspection according to law. Among them, the large-scale activities organized by the state in this province, the large-scale activities organized by the provincial government and its subordinate departments, and the activities across cities and States apply to the provincial public security fire control institutions for fire safety inspection.

when the contents of fire control acceptance of the project mentioned in the first paragraph of this article are consistent with the contents of fire control safety inspection mentioned in the second paragraph of this article, they shall be handled at the same time.

public gathering places shall not be opened, held or put into use without passing the fire safety inspection of public security fire control institutions. The administrative departments of culture, health, sports, industry and commerce shall not handle relevant administrative licenses and business licenses, and the provincial tourism administrative departments shall not report or evaluate the star rating. Article 7 Public gathering places shall perform their duties of fire safety management according to law. The legal representative or principal responsible person is the person in charge of fire safety of the unit or place, who is fully responsible for the fire safety work of the public gathering place, and shall implement the fire safety responsibility system and post fire safety responsibility system step by step.

the person in charge of fire safety in the public gathering place shall determine the fire safety manager of this place according to the needs. The person in charge of fire safety and the manager of fire safety shall, after confirmation or change, file with the public security fire control institution within 15 days. Article 8 Where leasing, contracting or entrusted operation and management are carried out, the property right unit and the operator shall clarify their respective fire safety responsibilities. Fire truck passages, evacuation facilities involving public fire safety and other building fire control facilities shall be managed by the property right unit or the unit entrusted by it.

if the public gathering place is leased or contracted as a whole, the operator shall be responsible for the fire safety work during its operation; If it is owned by several companies or leased for use, the property right unit or leased unit * * * shall jointly determine a unit to be responsible for the fire control of the whole building, and the business users shall be responsible for the fire control safety within the scope of business use, and cooperate with the property right unit or the unit entrusted by it for unified management to do the relevant fire control safety work.
