Article 2 These Measures shall apply to the production (including manufacture, installation, renovation and repair), sale, use, maintenance, inspection, supervision and management activities of elevators within the administrative area of this Municipality.

these measures are not applicable to the safety management of elevators used by individuals or single families. Article 3 The people's governments of cities, districts and counties (cities) shall strengthen the leadership of elevator safety management and establish a coordination mechanism for elevator safety management and major safety issues.

the municipal, district and county (city) market supervision and management departments are responsible for the elevator safety supervision and management within their respective administrative areas.

emergency management, housing and urban construction, natural resources and planning, development and reform, public security and other competent departments should do a good job in elevator safety supervision and management according to their respective responsibilities.

subdistrict offices and township (town) people's governments shall assist relevant departments in the safety supervision and management of elevators within their respective jurisdictions. Fourth elevator production, sale, use, maintenance and inspection institutions shall abide by the elevator safety technical specifications and related standards, establish and improve the elevator safety management system and responsibility system, and ensure the safe operation of elevators. Article 5 The market supervision and management department shall strengthen the publicity and education of elevator safety, popularize elevator safety knowledge, enhance the public's awareness of elevator safety and improve their self-protection ability.

encourage schools, news media and social organizations to carry out publicity and education on elevator safety, and advocate civilized elevator riding. Chapter II Production and Sales of Elevators Article 7 Elevator manufacturing units shall be responsible for the safety performance of elevators. The installation, modification and repair of the elevator shall be carried out by the elevator manufacturing unit or the unit entrusted by it to obtain the corresponding license according to law. Where an elevator manufacturing unit entrusts a unit that has obtained the corresponding license according to law to carry out elevator installation, renovation and repair, it shall conduct safety guidance and monitoring on its installation, renovation and repair, and conduct calibration and debugging according to the requirements of elevator safety technical specifications. Article 8 The elevator setting shall comply with the relevant national, provincial and municipal regulations and standards, ensure that the requirements of elevator selection, configuration and power supply are compatible with the building structure and use requirements, and comprehensively consider the functions of first aid, fire fighting and barrier-free access.

if the number, location, functional layout and other settings of elevators do not conform to the relevant national, provincial and municipal regulations and standards, the natural resources and planning departments shall not issue construction project planning permits. Ninth elevator shaft, machine room and other buildings and ancillary facilities related to elevator safety shall meet the requirements of construction engineering quality and elevator safety technical specifications. Tenth elevator installation, renovation and repair of the construction unit shall, before the construction, the proposed construction time, construction site, construction content, elevator parameters and elevator use managers and other information in writing to inform the municipal market supervision and management department. Eleventh elevator installation, renovation and repair is completed, the installation, renovation and repair of the construction unit shall, within thirty days after the acceptance, hand over the relevant technical data and documents to the elevator manager. The elevator use manager shall store it in the safety technical file of the elevator. Twelfth elevator sellers should establish and implement the system of inspection and acceptance of incoming goods and sales records, and report the catalogue of elevator products to the municipal market supervision and management department for the record.

it is forbidden to sell elevators that are produced without a license, elevators that have not been inspected and failed to pass the inspection, or elevators that have been explicitly eliminated and scrapped by the state. It is forbidden to sell defective elevator spare parts. Chapter III Use and Maintenance of Elevators Article 13 Elevator use managers refer to units or individuals with elevator management rights and obligations.

The elevator use manager is determined as follows:

(1) The owner of the elevator property is the elevator use manager. Among them, those who belong to multiple property owners can negotiate to clarify the elevator use manager; The elevator that has been entrusted to the realty service unit or other manager, and the entrusted realty service unit or other manager is the elevator use manager;

(2) After the elevator is installed and passed the supervision and inspection, if the construction unit has not handed it over, the construction unit shall be the elevator use manager;

(3) If a place equipped with an elevator is leased, the elevator use manager has been agreed in the lease contract, such agreement shall prevail; If there is no agreement or the agreement is unclear, it shall be determined according to the provisions in items (1) and (2) above. Fourteenth elevator use managers should go through the elevator use registration formalities with the municipal market supervision and management department in accordance with the regulations.

when the elevator has been out of service for more than one year or the period of suspension crosses the date of regular inspection, the elevator use manager shall stop the elevator, set up warning signs, and go through the formalities of suspension at the municipal market supervision and management department within 31 days. If the elevator is re-opened, it shall go through the formalities for opening. Article 15 The elevator use manager is responsible for the daily management of elevators and performs the following elevator safety management duties:

(1) Set up an elevator safety management organization or equip a corresponding number of elevator safety management personnel to clarify the post responsibilities of elevator safety management;

(2) Establish elevator safety technical files;

(3) keep the elevator emergency alarm device in effective contact with the personnel on duty at any time;

(4) Supervise the renovation, repair and maintenance of elevators and provide necessary conditions;

(5) Posting effective elevator use signs in the elevator car or in a prominent position at the entrance and exit;

(6) Put the safety precautions and warning signs in a prominent position that passengers can easily pay attention to;

(7) Other safety management responsibilities as stipulated by laws, regulations and rules and elevator safety technical specifications.

if the elevator use manager changes, the original use manager shall hand over the complete elevator safety technical files to the new use manager.
