chapter I general provisions article 1 these regulations are formulated in accordance with the regulations of the people's Republic of China on the administration of river traffic safety and other relevant laws and regulations, and in combination with the actual situation of this municipality, in order to strengthen the management of water traffic safety, maintain the order of water traffic and ensure the safety of people's lives and property. Article 2 These Regulations shall apply to activities such as navigation, berthing and operation in navigable waters within the administrative area of this Municipality and activities related to water traffic safety in non-navigable waters.
the water traffic safety management of fishing vessels and fishing port waters within the administrative area of this municipality shall be implemented with reference to these regulations. Article 3 The management of water traffic safety shall be based on the principles of safety first, prevention first, convenience for the masses and management according to law, and comprehensive management shall be implemented to ensure the safety, order and smoothness of water traffic. Article 4 The people's governments of cities, districts and counties (autonomous counties) shall strengthen water traffic safety management, establish and improve the responsibility system for water traffic safety management, coordinate and solve major problems in water traffic safety management, formulate emergency rescue plans for water traffic safety accidents, implement personnel, equipment and funds, and ensure the normal development of emergency rescue work.
Township (town) people's governments and sub-district offices shall perform the following duties in the management of water traffic safety within their respective administrative areas:
(1) Establish and improve the responsibility system for ship safety of village (neighborhood) committees and ship owners and operators;
(2) Implement the responsibility system for safety management of ferry vessels, crew and passengers and the management system for passenger ferry vessels to sign a single voyage;
(3) To be responsible for the administration of the registration of ships for township use within their respective administrative areas;
(4) determine the specialized personnel for water traffic safety management;
(5) organizing safety publicity, safety inspection, rectification of potential safety hazards inspectors, and evaluation of safety management personnel;
(6) urging ship owners, operators and crew members to abide by the laws, regulations and rules on inland river traffic safety. Article 5 The traffic administrative department shall be responsible for the management of water traffic safety in navigable waters within the administrative area of this Municipality, and its maritime administrative agency shall specifically implement the supervision and management of water traffic safety in navigable waters under its jurisdiction.
the fishery administrative department is responsible for the safety supervision and management of fishing vessels and fishing port waters within the administrative area of this municipality.
The relevant administrative departments of public security, water conservancy, environmental protection, municipal administration, tourism, sports, gardens, etc. shall, according to their respective responsibilities, do a good job in the supervision and management of water traffic safety.
the Yangtze river maritime administrative agency shall, in accordance with its duties, supervise and manage the water traffic safety in the waters under its jurisdiction. Sixth water traffic safety management to implement the owner and operator responsibility system.
the owners and operators of ships and floating facilities should strengthen the safety management of ships and floating facilities, establish and improve the safety management system, engage in navigation, berthing and operations and activities related to water traffic safety in accordance with regulations, and be responsible for the traffic safety of their ships and floating facilities. Seventh reservoirs, scenic spots, nature reserves, urban gardens and other non navigable waters management agencies and operators are responsible for the daily management and maintenance of water traffic safety in the waters under their jurisdiction.
the management institution shall strengthen the supervision and management of traffic safety in the waters under its jurisdiction; On the water catering, entertainment and other business, but also should urge the water catering, entertainment operators to establish and improve the safety management system and emergency rescue plan, and regularly carry out drills.
Water catering and entertainment operators should implement safety measures, and set up obvious safety signs and isolation facilities in the waters where they operate to ensure the safety of water catering and entertainment activities. Chapter II Ships, Floating Installations and Crew Article 8 Ships and floating installations shall apply to the ship registration authority for ship registration in accordance with the Regulations of the People's Republic of China on Ship Registration.
sports and fishing vessels shall apply for registration with their competent authorities in accordance with relevant state regulations.
a ship for its own use in a township shall apply for registration with the township people's government where the ship owner has his domicile or habitual residence.
floating boats, boats (rafts) and other water catering and entertainment vessels in non-navigable waters such as reservoirs, scenic spots, nature reserves and urban gardens shall be registered with their management agencies. Article 9 The owners and operators of vessels and floating facilities shall perform the following duties:
(1) Establish and improve internal safety supervision institutions and equip them with safety management personnel;
(2) manning the crew according to regulations. Arrange the work on duty reasonably to ensure the rest time of the crew; Employ crew members with certificates of competency or other certificates of competency; Conduct regular safety education and technical training for crew members; Shall not instigate or force the crew to operate illegally;
(3) to formulate the dispatching, use, repair and maintenance system and operating rules of ships and floating facilities, and improve the safety production and labor protection measures;
(4) Supervise and inspect safety work, eliminate hidden dangers in production safety in time, and report accidents in production safety in water traffic according to regulations;
(5) to organize the formulation and implementation of safety emergency rescue plans and conduct regular drills;
(6) the necessary capital and technical investment to ensure safety production and safety management;
(7) Other duties as stipulated by laws and regulations. Article 11 The traffic administrative department shall implement the planning and management of setting up catering and entertainment barges in navigable waters.
When barges are set up in navigable waters for catering and entertainment, their owners and operators shall not only abide by the provisions of Article 9, but also the following provisions:
(1) Conduct navigation safety assessment in accordance with the Regulations of Chongqing Municipality on Waterway Management and other laws and regulations;
(2) berthing in accordance with the berthing areas and berthing methods stipulated by the port and shipping administration;
(3) according to the regulations of the traffic administrative department, equip with corresponding fire fighting, lifesaving and anti-pollution equipment, and set up auxiliary facilities for securing ships and facilitating the safe passage of personnel;
(4) prevent water pollution in navigable waters in accordance with the Regulations on Prevention and Control of Water Pollution in the Three Gorges Reservoir Area and Watershed of Chongqing Municipality.
