To sum up, the competent department of public places should establish a health management system, be equipped with full-time or part-time health management personnel, regularly check the health status of their business units (including individual operators, the same below), and provide necessary conditions. Article 45 of People's Republic of China (PRC) Food Safety Law
Food producers and business operators shall establish and implement the health management system for employees. Persons suffering from diseases that hinder food safety as stipulated by the administrative department of health of the State Council shall not engage in direct contact with imported food.
Food production and marketing personnel engaged in direct contact with imported food shall undergo annual health examination and obtain health certificates before taking up their posts.
Article 7 of the Regulations on Hygiene Management in Public Places.
Personnel who directly serve customers in public places can only engage in their own work with the Health Certificate. Persons suffering from dysentery, typhoid fever, viral hepatitis, active tuberculosis, purulent or exudative skin diseases and other diseases that hinder public health shall not engage in direct customer service before they are cured.
Tenth health and epidemic prevention institutions at all levels shall be responsible for the health supervision of public places within their respective jurisdictions.
Health and epidemic prevention institutions of civil aviation, railways, transportation, factories (fields) and mines shall exercise health supervision over public places under their jurisdiction and accept the professional guidance of local health and epidemic prevention institutions.
