Penalties:

If Article 118 violates the provisions of this Law, and the operator of a catering service that emits oil smoke fumes fails to install oil smoke purification facilities, does not use the oil smoke purification facilities normally, or does not take other oil smoke purification measures to make the oil smoke emitted in excess of the emission standards, the supervisory and management department determined by the local people's government at or above the county level shall order rectification, and impose a fine of not less than 5,000 yuan but not exceeding 50,000 yuan. Fines; refusal to make corrections, shall be ordered to suspend business rectification.

In violation of the provisions of this Law, where new construction, alteration or expansion of food and beverage service projects generating oily smoke, odor or exhaust gas is carried out in residential buildings, commercial and residential complexes not equipped with special flues, or commercial floors in commercial and residential complexes adjacent to residential floors, the supervisory and management departments determined by the local people's governments at or above the county level shall order corrections to be made; and in case of refusal to make corrections, they shall be closed down, and shall be fined from 10,000 yuan to 100,000 yuan or less. the fine.

If a person violates the provisions of this Law by barbecuing food in the open air during the hours and in the areas prohibited by the local people's government or by providing a site for barbecuing food in the open air, the supervisory and management department determined by the local people's government at or above the county level shall order the person to make corrections, confiscate the barbecuing tools and the unlawful proceeds, and impose a fine of not less than five hundred yuan and not more than twenty thousand yuan.

Residential buildings can not be under the catering business license
