article 1 these regulations are formulated in accordance with the provisions of the law of the people's Republic of China on the prevention and control of air pollution, the regulations of the State Council on the safety management of fireworks and firecrackers and other laws and regulations, combined with the actual situation of this municipality, in order to strengthen the management of the sale and discharge of fireworks and firecrackers, protect the environment, and ensure the safety of people and property. Article 2 These Regulations shall apply to the management of the sale and discharge of fireworks and firecrackers within the administrative area of this Municipality. Article 3 Fireworks and firecrackers are prohibited in urban built-up areas of cities and counties (districts). The specific scope of urban built-up areas shall be determined or adjusted by the people's governments of cities and counties (districts) according to law and announced to the public. Article 4 Fireworks and firecrackers are prohibited in the following places outside the areas specified in Article 3 of these Regulations:

(1) Cultural relics protection units and nature reserves, and first-class drinking water source protection areas;

(2) key fire prevention areas such as mountains and forests, and places where fireworks are strictly prohibited in factories and mines;

(3) state organs, medical institutions, kindergartens, schools and institutions for the aged;

(4) transportation hubs such as stations, docks and airports, and railway line safety protection zones;

(5) markets, stadiums, public entertainment places and other crowded places;

(6) high-rise buildings and underground buildings;

(7) places where inflammable and explosive dangerous goods are produced, managed, stored and used, and safety protection zones for power transmission and transformation facilities;

(8) Other places where fireworks and firecrackers are prohibited by the people's governments at or above the county level. Article 5 The sale of fireworks and firecrackers is prohibited in the areas where fireworks and firecrackers are prohibited as stipulated in Article 3 of these Regulations.

the municipal people's government shall timely release the warning information of heavy pollution weather and the announcement prohibiting the discharge of fireworks and firecrackers to the society through television, radio, newspapers, internet and other media. Article 7 If it is really necessary to hold a fireworks party or other large-scale fireworks display activities in major public events, the organizer shall apply to the public security organ for permission in accordance with the provisions on hierarchical management and obtain the Fireworks Display Permit.

if the public security organ makes a decision to grant permission, the organizer shall announce the time, place, type, specification and quantity of the permitted discharge to the public three days in advance.

fireworks parties and other large-scale fireworks display activities shall be set off in accordance with the safety regulations for fireworks display and the approved fireworks display operation plan. Article 8 Fireworks and firecrackers are set off in areas and places specified in Articles 3 and 4 of these Regulations and under circumstances specified in Article 6, and shall not endanger public safety and personal and property safety. Article 9 The people's governments of cities and counties (districts) shall strengthen their leadership and coordinate major issues in the management of sales and discharge of fireworks and firecrackers.

The public security organ is the competent authority for the management of fireworks and firecrackers, responsible for the safety management of fireworks and firecrackers, and investigating and handling illegal fireworks and firecrackers.

the emergency management department is the competent authority of fireworks sales management, responsible for the supervision and management of fireworks sales, and investigate and deal with illegal sales of fireworks.

relevant departments and units in charge of urban management, ecological environment, fire protection, meteorology, civil affairs, housing and urban and rural construction, market supervision and management, transportation, supply and marketing, etc. shall do a good job in the management of fireworks sales and discharge according to law within their respective functions and duties.

the development zone management Committee with administrative functions and its subordinate functional departments shall, in accordance with the provisions of the municipal people's government, undertake the management responsibilities of the sales and discharge of fireworks and firecrackers within their respective jurisdictions. Tenth township (town) people's government, street offices shall, in accordance with the requirements of the county (District) people's government and the Development Zone Management Committee, organize the management of fireworks sales and discharge in this area.

village (neighborhood) committees, owners' committees and other units shall assist township (town) people's governments, sub-district offices and relevant departments in the management of fireworks sales and discharge. Eleventh state organs, social organizations, enterprises and institutions, grassroots mass autonomous organizations and other units in this Municipality shall carry out publicity and education activities to comply with the regulations on the sale and discharge of fireworks and firecrackers.

TV, radio, newspapers, internet and other media should carry out public welfare publicity activities in compliance with the regulations on the sale and discharge of fireworks and firecrackers. Article 12 Operators who provide catering, accommodation, weddings, funeral ceremonies and other services in areas where fireworks and firecrackers are prohibited shall not provide services related to fireworks and firecrackers, and shall inform the clients that fireworks and firecrackers are prohibited in their management areas, and discourage illegal fireworks and firecrackers; If dissuasion is ineffective, it shall report to the public security organ in time. Article 13 A realty service enterprise that provides services in an area where fireworks and firecrackers are prohibited shall not provide relevant services for fireworks and firecrackers, and shall inform the owners that fireworks and firecrackers are prohibited in its management area, and discourage and stop illegal fireworks and firecrackers; If dissuasion or stop is ineffective, it shall report to the public security organ in time.
