Provisions of Hainan Province on the Administration of Tourism Safety
Article 1 These Provisions are formulated in accordance with the Tourism Law of the People's Republic of China and other relevant laws and regulations, combined with the actual situation of this province, in order to strengthen the management of tourism safety, standardize the order of the tourism market, timely prevent and deal with tourism safety accidents and emergencies, safeguard the legitimate rights and interests of tourists and tour operators, and promote the sustained and healthy development of tourism. Article 2 These Provisions shall apply to the management of tourism safety within the administrative area of this province.

Where laws and regulations provide otherwise for tourism safety, such provisions shall prevail. Article 3 The tourism safety work shall be based on the principle that the Party and the government share the responsibility, each post has two responsibilities, and the management of * * * shall be emphasized, and the work policy of putting prevention first and safety first shall be adhered to.

The people's governments at or above the county level shall, under the leadership of the Party committees at the same level, strengthen the organization and leadership of tourism safety work, establish and improve the comprehensive management mechanism of tourism safety and the information sharing mechanism of tourism safety, incorporate tourism safety management into the national economic and social development plan, and provide financial guarantee.

The people's governments at or above the county level shall, in accordance with the law, incorporate tourism emergency management into the government emergency management system, formulate emergency plans, promote the construction of tourism emergency rescue system, improve the emergency mechanism of tourism emergencies, enhance the emergency response and support capabilities of tourism, effectively prevent and timely organize the implementation of tourism emergency rescue. Article 4 The tourism authorities of the people's governments at or above the county level shall be responsible for the supervision and administration of tourism safety within their respective administrative areas. Other relevant departments of the Safety Production Committee shall be responsible for the corresponding tourism safety supervision according to their respective safety supervision and management responsibilities.

The tourism administrative department of the people's government at or above the county level shall take the lead in carrying out joint inspection of tourism safety supervision and management with relevant departments on a regular basis, timely discover and correct illegal acts of tourism safety, and improve the efficiency of tourism safety supervision. Article 5 People's governments at or above the county level and relevant departments shall strengthen the publicity, education and training of tourism safety management laws, regulations, rules and tourism safety knowledge, enhance the tourism safety awareness of tourism operators and the whole society, and improve the ability of tourism operators and tourists to prevent accidents.

Newspapers, radio, television, internet and other media should carry out publicity and education on tourism safety and strengthen public opinion supervision on tourism safety. Article 6 Professional safety production associations, tourism industry associations and other relevant industry associations shall guide the safety management of tourism operators, provide services such as tourism safety management and technical consultation, strengthen industry self-discipline, promote the construction of industry credit system and improve the level of tourism safety management. Article 7 Any unit or individual may report violations of tourism safety to the tourism authorities of the people's governments at or above the county level or other relevant departments.

The tourism authorities of the people's governments at or above the county level and other relevant departments shall establish a system for reporting complaints about tourism safety, make public the telephone number, mail box or e-mail box of complaints and reports, and accept complaints and reports about tourism safety. Article 8 Tourism operators are the main body responsible for tourism safety work, and should strengthen tourism safety management according to law, establish and improve the responsibility system for tourism safety, improve the conditions for tourism safety production, and accept inspections and tests conducted by relevant competent departments according to law to ensure the safety of tourism operations and services.

The main person in charge and the actual person in charge of the tour operator are fully responsible for the tour safety work of the unit, and other responsible persons are responsible for the tour safety work within their respective responsibilities. Ninth tour operators should strengthen safety management and take the following measures to ensure the personal and property safety of tourists:

(a) the establishment of internal safety management institutions or equipped with safety management personnel;

(two) equipped with the necessary tourist safety facilities and equipment;

(three) to establish and improve the rules and regulations of the tourism safety management of this unit;

(four) to organize the study and implementation of tourism safety laws, regulations and rules;

(five) accept the guidance, supervision and inspection of the tourism safety work by the tourism authorities at all levels and other relevant departments;

(six) responsible for tourism safety education, training and publicity, and establish tourism safety training files for employees;

(seven) to formulate and implement the overall safety management plan of the unit, all kinds of emergency preparedness plans and the assessment and inspection system of tourism safety management, and establish and improve the safety management files;

(eight) to carry out the safety inspection and hidden trouble investigation and management of this unit.

Tourism operators engaged in high-risk tourism projects such as high altitude, high speed, water, diving and exploration. Safety operation rules should be formulated, and the tourist facilities and equipment involving personal safety should be put into trial operation and daily safety inspection before being put into use every day, and the safety devices should be inspected and confirmed to ensure that the tourist facilities and equipment are in good condition. Tenth tour operators should explain or warn tourists in advance in an express way about the following matters in tourism activities:

(a) the correct use of related facilities and equipment;

(two) safety precautions, safety precautions, evacuation methods and other emergency measures;

(3) Business premises, facilities and equipment that are not open to tourists;

(four) groups that are not suitable to participate in related activities;

(five) other circumstances that may endanger the personal and property safety of tourists.
