chapter I general provisions article 1 these regulations are formulated in accordance with the provisions of the food safety law of the people's Republic of China (hereinafter referred to as the food safety law), the regulations on the implementation of the food safety law of the people's Republic of China and other relevant laws and regulations in combination with the actual situation of this province. Article 2 Those engaged in the production and business activities of food, food additives and food-related products and food safety supervision and management activities within the administrative region of this province shall abide by these regulations.

Article 3 Food producers and business operators shall engage in production and business operations in accordance with laws, regulations and food safety standards, establish and improve the food safety management system, be responsible for the food safety of their production and business operations, accept social supervision and assume social responsibilities. Article 4 The people's governments at or above the county level shall be responsible for, lead, organize and coordinate food safety supervision and management within their respective administrative areas, and perform the following duties:

(1) Incorporate food safety into the national economic and social development plan, and include food safety sampling expenses, risk monitoring expenses and supervision and management expenses in the fiscal budget at the corresponding level;

(2) establish and improve the working mechanism of the whole process supervision and management of food safety, which combines administrative supervision, self-discipline of producers and operators and social supervision;

(3) Unified leadership and command of food safety emergency response;

(4) Improve and implement the responsibility system for food safety supervision and management;

(5) establish a food safety information sharing mechanism;

(6) Strengthen the capacity building of food safety supervision and management, and establish a team of personnel suitable for food safety supervision and management;

(7) incorporate food safety supervision and management into the government's annual work target assessment.

township (town) people's governments and neighborhood offices (communities) should do a good job in food safety supervision and management in accordance with these regulations and the provisions of the people's governments at higher levels, and should hire food safety coordinators to assist in the social supervision of food safety in rural areas, rural primary and secondary schools (kindergartens), urban communities and construction sites.

the village (neighborhood) committees shall assist the local people's governments in food safety supervision and management, and report the food safety situation in time; The food safety supervision and administration department shall give guidance and support. Article 5 the people's governments at or above the county level shall set up food safety committees to undertake the following duties:

(1) to analyze the food safety situation in the region, study and deploy, coordinate and guide the food safety work in the region as a whole;

(2) put forward policies and measures for food safety supervision and management;

(3) Establish and improve the coordination and linkage mechanism and comprehensive supervision and management system;

(4) supervise and inspect the implementation of food safety supervision and management responsibilities;

(5) Other duties as stipulated by the people's government at the corresponding level.

Article 6 The administrative department of health shall be responsible for the supervision and management of food safety risk monitoring, formulation of local food safety standards, publication of food safety information, organization of investigation and handling of major food safety accidents and centralized disinfection of tableware.

the quality supervision department is responsible for the supervision and management of food production activities.

the administrative department for industry and commerce shall be responsible for the supervision and management of food circulation activities.

the food and drug supervision and administration department shall be responsible for the supervision and administration of catering service activities.

agriculture, urban management, entry-exit inspection and quarantine, commerce, food, salt industry, housing and urban and rural construction, transportation, public security, education, environmental protection, tourism and other departments should do a good job in food safety supervision and management within their respective responsibilities.

if there are no specific provisions on the responsibilities of food safety supervision and management in laws and regulations, they shall be determined by the people's governments at or above the county level and announced to the public. Article 7 The food industry association shall assist the food safety supervision and management department to standardize and strengthen the food safety work in the industry, establish and improve various self-discipline management systems, strengthen the self-discipline of the industry, publicize and popularize food safety knowledge, promote the construction of industry integrity, and guide food producers and operators to produce and operate according to law. Eighth people's governments at or above the county level shall establish and improve the communication mechanism of news media. The news media should carry out public welfare publicity on food safety laws and regulations, food safety standards and knowledge, report food safety information in a timely, comprehensive and accurate manner, and conduct public opinion supervision on violations of food safety laws and regulations. Article 9 People's governments at all levels shall organize publicity and education on food safety laws, regulations, food safety standards and knowledge, so as to raise the awareness of food safety of the whole society and enhance citizens' self-protection ability.

encourage consumer organizations, trade associations and other social groups and village (neighborhood) committees to carry out various forms of food safety publicity and popularization, and do a good job in food safety supervision.

schools should strengthen the publicity and education of students' food safety knowledge, and improve students' awareness of food safety. Tenth people's governments at or above the county level shall establish and improve the reward system for reporting food safety, set up special reward funds, and encourage reporting violations of food safety laws and regulations in food production and operation; Protect the lawful rights and interests of informants, and reward those who provide clues about illegal acts and verify them.
