Legal analysis: urban living garbage refers to solid waste generated by the urban population in their daily lives or by providing services for urban daily life, as well as solid waste (including construction garbage and slag, excluding industrial solid waste and hazardous waste) that are regarded as urban living garbage as stipulated by laws and administrative regulations. The municipal domestic waste disposal fee is a business service fee and serves to compensate for the cost of waste collection, transportation and disposal. It is collected by the municipal domestic garbage operation and service unit. Specific collection and utilization management methods are formulated separately.

Legal basis: "urban household garbage management measures"

Article 1 In order to strengthen the management of urban household garbage, to improve the cityscape and environmental sanitation, according to the "People's Republic of China *** and the State Law on the Prevention and Control of Environmental Pollution by Solid Wastes", "Regulations on the Management of Urban Amenities and Environmental Sanitation" and other laws, administrative regulations, the formulation of these measures.

Article 2 These Measures shall apply to the sweeping, collection, transportation, disposal and related management activities of urban household garbage within the territory of the People's Republic of China*** and the People's Republic of China.

The state adopts economic and technological policies and measures conducive to the comprehensive utilization of municipal household waste, improves the scientific and technological level of municipal household waste management, and encourages the full recycling and rational utilization of municipal household waste.
