article 1 in order to crack down on illegal drug-related activities, protect citizens' physical and mental health, and maintain social order, these regulations are formulated in accordance with the "Decision on Drug Control in the NPC Standing Committee" and the "Measures for Compulsory Drug Rehabilitation in the State Council" and combined with the actual situation of this Municipality. Article 2 The drugs mentioned in these Regulations refer to opium, heroin, methamphetamine (ice), MDMA (ecstasy), ketamine (K powder), morphine, marijuana, cocaine, narcotic drugs and psychotropic drugs that can make people addicted to drugs, such as Demerol and dihydroetorphine hydrochloride, which are controlled by the state. Article 3 These Regulations shall apply to all units and individuals within the administrative area of this Municipality. Article 4 The anti-drug work must adhere to the principle of combining education with punishment, and implement the policy of banning seeds, prohibiting trafficking, embargo, banning smoking, blocking the source and intercepting the flow, and treating both the symptoms and the root causes. Article 5 Whoever smuggles, sells, transports or manufactures drugs, regardless of the quantity, shall be investigated for criminal responsibility in accordance with the Criminal Law of the People's Republic of China. Article 6 People's governments at all levels shall be responsible for leading the drug control work within their respective jurisdictions. Public security organs are the departments in charge of drug control.
The departments of justice, civil affairs, finance, industry and commerce, health, culture, transportation, drug administration and customs shall, according to their respective responsibilities, assist the public security organs in drug control. Article 7 All state organs, social organizations, enterprises, institutions and neighborhood (village) committees are responsible for drug control work within their respective jurisdictions, departments and units, carry out anti-drug publicity and education for their staff or residents, and assist public security organs in banning drugs. Article 8 People's governments at all levels shall include anti-drug funds in the fiscal budget at the corresponding level and use them for special purposes. Article 9 The press and publication, radio and television, education, culture and other departments should do a good job in anti-drug publicity and education in various forms to raise the anti-drug awareness of the whole people. Article 11 All units and individuals have the obligation to report and expose illegal drug-related acts. The unit that accepts the report shall keep confidential the informants and the contents of the report. Those who take revenge on informants shall be dealt with severely according to law.
People's governments at all levels shall reward units and personnel who have exposed illegal drug-related activities and made meritorious service in drug control. Article 11 Units and individuals engaged in hotels, entertainment, catering services, bathing, medical treatment, medicine, transportation, renting houses and other industries should regard the prohibition of drugs as an important part of their management. If illegal drug-related activities are found in their operations, they should promptly report to the public security organs and cooperate with them to ban them. Article 12 Any unit or individual is prohibited from committing the following acts:
(1) taking or injecting drugs;
(2) illegal cultivation of opium poppy, cannabis and other original drug plants;
(3) illegal possession of drugs;
(4) illegally transporting, mailing, trading, storing and using poppy shells;
(5) illegally buying, selling, transporting, mailing, carrying, or holding the seeds or seedlings of the original plants of drugs that have not been inactivated;
(6) adding poppy shells (seeds) or potassium powder and ecstasy to foods and drinks;
(7) introducing others to take or inject drugs;
(8) coercing or inducing others to sell or issue prescriptions or certificates to defraud narcotic drugs and psychotropic drugs controlled by the state;
(9) producing or dealing in drugs for drug rehabilitation without the approval of the state drug supervision and administration department;
(11) engaging in advertising of drugs and devices for drug rehabilitation. Article 13 units that are approved to produce, manage, purchase, use, transport and store a class of precursor chemicals must abide by the following provisions:
(1) Enterprises that produce and manage a class of precursor chemicals must file with public security organs at or above the county level (including the county level, the same below). For the record, it is necessary to indicate the varieties, production capacity, annual production plan and main sales direction of precursor chemicals produced and operated.
(2) Units that purchase and use Class I precursor chemicals (except precursor chemicals business units) must apply to the public security organs at or above the county level for a certificate of purchase and use with a copy of the business license of an enterprise as a legal person (or the certificate of enterprise as a legal person and the registration certificate of an association as a legal person), a letter of introduction from the unit and an explanation of the purpose and annual use plan.
after purchasing a class of precursor chemicals, the user unit shall not sell or transfer them without authorization. If it is really necessary to adjust them, it must report to the public security organ at or above the county level for approval and issue a certificate.
individuals are prohibited from buying a class of precursor chemicals.
(3) When producing and operating enterprises sell a class of precursor chemicals, they must require the buyers to provide their business licenses (or certificates of public institutions and corporate registration) and certificates of purchase and use of a class of precursor chemicals or certificates of business record issued by public security organs at or above the county level.
(4) when conducting the warehousing business of a class of precursor chemicals, the warehousing unit must require the depositor to provide the record-keeping certificate or purchase certificate of a class of precursor chemicals issued by the public security organ at or above the county level.
(5) when transporting a class of precursor chemicals, transport units (including individual transport households) must require the consignor to provide the production and business registration certificate or purchase certificate of a class of precursor chemicals issued by the public security organs at or above the county level. If the above certificate cannot be provided, the transport unit shall not carry it. Fourteenth for drug addiction, drug addiction by injection, compulsory detoxification by the public security organs or ordered deadline. Fifteenth compulsory detoxification period is 3 months to 6 months, counting from the date of compulsory detoxification.
For drug addicts who have not given up drug addiction after the expiration of compulsory detoxification, compulsory detoxification can put forward opinions and report them to the public security organ that made the decision for approval to extend the period of compulsory detoxification; However, the actual period of compulsory detoxification is calculated continuously for no more than 1 years.
