Demolition Policy of Zhuanqiao Town, Minhang District, Shanghai

The compensation and resettlement for the demolition of this project is based on the Provisions of Shanghai Municipality on Compensation and Resettlement for House Demolition by Expropriating Collectively Owned Land (Hu Fu Fa (2002)No. 13), Min Fu Fa (2002) No.8 Notice on Implementing the Compensation Standard for House Demolition by Expropriating Collectively Owned Land in Minhang District and Min Fu Fa (2004)No. 12.

First, the demolition compensation and resettlement methods:

People who have been demolished can choose monetary compensation, or they can choose property houses with the equivalent monetary compensation for exchange.

1. Select monetary compensation:

According to the standards stipulated in the relevant documents of the municipal government and the district government, the demolisher will make monetary compensation to the demolished person. The monetary compensation amount is: (the unit price of the demolished house is combined to form a new multi-storey commercial house with the same area+the benchmark price of land use right per square meter of construction area+price subsidy) * the construction area of the demolished house.

The replacement unit price of the demolished house is merged into a new one (hereinafter referred to as the old house evaluation unit price), and the evaluation report made by a qualified real estate appraisal agency shall prevail.

The benchmark price (hereinafter referred to as the benchmark price of land use right) and price subsidy standard of new multi-storey commercial housing per square meter of construction area in this area are determined as follows according to Fu Min (2004) 12:

1) The benchmark price of land use right is 1820 yuan/m2;

2) Price subsidy standard: (benchmark price of land use right+unit price of old house evaluation) * 25%;

Payment method: Pay the compensation in one lump sum within 20 working days after the demolished person signs the agreement, moves out of the original site and hands over the key of the old house.

2. Select the property right exchange house with the same monetary compensation amount:

1) For the part with an effective construction area of 85% of the demolished houses, the preferential price for ordering resettlement houses is 3,850 yuan/m2 (the reserve price of the 6th floor) for the high-rise buildings, and the prices vary from level to level;

2) For the part with the effective construction area of the demolished house 15%, the preferential market price for ordering resettlement houses is 5040 yuan/square meter (the floor price of 6 floors), and the price is graded;

3) Floor collocation method: each household must order a large set (except incomplete households);

4) matching floors are allocated according to the floor matching corresponding to the freely selected floor;

5) Compensation for temporary resettlement:

A) The transitional period of temporary resettlement is 24 months, counting from the date when the demolished person hands over the key of the old house to the date when the notice of delivery of resettlement house is issued;

B) If it is less than 24 months, it shall be paid according to the actual transition period;

C) If the period exceeds 24 months, the temporary resettlement subsidy shall be paid according to document No.024 (2002) of Shanghai Price Merchants. For more than 3 months (including 3 months), the temporary resettlement subsidy will be increased by 50%; If the term exceeds 3 months, the temporary resettlement subsidy will be increased100%;

D) During the transition period, the demolisher shall pay temporary resettlement subsidies to the demolished, and the payment standard shall be calculated according to the 8 yuan per square meter of effective construction area of the demolished house. If the monthly income of each household is lower than that of 600 yuan, it will be paid in 600 yuan;

E) 2 months after the resettlement house enters the house, it shall be calculated from the date of notification, and be responsible for and pay the transition fee for the renovation period. If you don't enter the house without reason, you will stop the transition fee and cancel the transition fee for the renovation period of 2 months;

F) Payment method: the monetary compensation amount of the demolished house and the compensation amount of the resettlement house shall be settled according to the difference. If the amount of compensation for resettlement housing is greater than the monetary compensation for the original house, the person to be demolished shall make a one-time payment when the resettlement house moves in. If the monetary compensation for the original house is greater than the payment for the resettlement house, it shall be paid in one lump sum within 20 working days after the demolition person hands over the key to the old house. Appendage compensation fee, relocation allowance, equipment relocation fee, basic incentive fee, etc. , in the demolition signed an agreement, move away from the original site, hand over the old house keys within 20 working days after a one-time payment;

Second, the determination of compensation construction area:

1. The determination of the construction area of the house to be demolished shall be based on the legal and effective real estate license, the rural homestead use certificate or the records of the building approval documents.

2. Demolition of buildings built without the approval of government functional departments, no compensation area is calculated, only appropriate compensation is made, and the compensation standard is the construction area of 40 yuan/square meter.

3. According to the regulations of Zhuanqiao Town People's Government, if the original building area of the demolished person (formerly agricultural registered permanent residence) is lower than the building standard, the replacement price will be 200 yuan/m2, and the benchmark price and price subsidy of the land use right will be taken care of. The identification standard is that each household is less than 2 16 square meters, including toilet 16 square meters; If the effective construction area of the original house exceeds 200 square meters, it is not approved to build a toilet, and it can be built 16 square meters, but the total construction area shall not exceed 300 square meters.

4. According to the regulations of the municipal government on rural housing construction, families that do not meet the conditions of rural housing construction (non-agricultural families and families with homesteads in other places) do not enjoy the compensation for insufficient area, and compensation and resettlement are carried out according to the original housing construction area.

Three. Incentive fees and other relocation expenses:

1. Incentive fee:

1) If the construction area of the ordered resettlement house is less than 85% of the effective construction area of the demolished house, it will be awarded separately 12 10 yuan/m2;

2) For the residents who choose monetary compensation and have not subscribed for resettlement houses, they will be rewarded with 12 10 yuan /m2 according to 85% of the effective construction area of the demolished houses.

2. Moving allowance:

Demolition in accordance with the provisions of the demolition to pay the relocation allowance, the payment standard is calculated by the demolition of housing per square meter certified construction area 10 yuan, each household is lower than 500 yuan, calculated by 500 yuan. The allotment of the auction house shall be issued in two installments.

3. Household equipment removal fee:

1) Telephone relocation fee: 150 yuan/department/time;

2) Air conditioning transfer fee: 400 yuan/unit/time;

3) Water heater disassembly and assembly fee: 300 yuan/unit/time;

4) Cable TV: 480 yuan/household/time;

5) Broadband installation fee: 380 yuan/household/time;

Fourth, other related issues:

5. If the demolition is ruled or enforced, the rewards and other preferential policies stipulated in this scheme will not be enjoyed, and all of them will be implemented according to the Provisions of Shanghai Municipality on Compensation and Resettlement for House Demolition with Collectively Owned Land.

6. This scheme is only applicable to this base.

7. Matters not covered in this plan shall be implemented in accordance with the Provisions of Shanghai Municipality on Compensation and Resettlement for House Demolition by Expropriating Collectively Owned Land.
