Article 2 The term "catering industry" as mentioned in these Measures refers to the food production and operation industries that provide consumers with food or food consumption places and facilities by means of instant processing, commercial sales and service labor, including restaurants, snack bars, fast food restaurants, canteens, hotels, baths, dance halls and other units that provide catering services. Article 3 These Measures shall apply to the pollution prevention and control of catering industry and its related supervision and management activities within the administrative area of this Municipality. Article 4 The municipal environmental protection administrative department shall be responsible for the supervision and management of the prevention and control of environmental pollution in the catering industry in the whole city, and organize the implementation of these measures.
the competent administrative department of environmental protection of county-level cities and districts is responsible for the supervision and management of the prevention and control of environmental pollution in the catering industry within their respective jurisdictions.
if the laws, regulations and rules involve the supervision and management of sewage discharge from catering industry by the water administrative department, such provisions shall prevail.
planning, construction, real estate, urban management, health, industry and commerce, land, quality supervision and other departments shall, according to their respective responsibilities, do a good job in pollution prevention and control of catering industry. Article 5 The catering industry shall be rationally laid out in urban planning. Urban transformation and development shall, in accordance with the requirements of environmental functional zones, plan and build a commercial operation area with relatively concentrated catering industry.
buildings used in catering industry should be designed with special flue and sewage discharge facilities for catering industry, and the installation positions of pollution prevention facilities such as waste gas and noise should be arranged. Article 6 The location of newly-built catering business premises shall meet the requirements of environmental protection. It is forbidden to build or expand the catering industry in the following places (hereinafter referred to as newly-built catering industry):
(1) Residential buildings (including floors adjacent to residential floors in mixed commercial and residential buildings);
(2) the first-class protected area of drinking water surface source and the second-class protected area of drinking water surface source without centralized sewage treatment facilities;
(3) the water surface of lakes and rivers;
(4) Other areas that need special protection.

the environmental impact registration form and report form of catering industry projects shall be submitted to the competent administrative department of environmental protection for examination and approval, and construction or business shall not be carried out without approval. Article 8 The competent administrative department of environmental protection shall gradually implement the commitment system for the prevention and control of environmental pollution of catering operators according to the actual situation, and the specific items and scope shall be stipulated separately.
for a newly-established catering industry project that can implement the commitment system for the prevention and control of environmental pollution of catering industry operators, the competent administrative department of environmental protection that accepts the application shall inform the applicant in writing of the conditions, standards and requirements for the prevention and control of environmental pollution of the newly-established catering industry as stipulated in laws, regulations, rules and relevant technical specifications, and the responsibilities and obligations of the operators. If the applicant thinks that the catering industry project he has applied for conforms to the provisions of laws, regulations, rules and relevant technical specifications and is willing to undertake the responsibilities and obligations in the notification, he shall make a written commitment.
after receiving the written undertaking from the applicant, the competent administrative department of environmental protection shall complete the examination and approval of the newly-established catering industry projects that need to declare the environmental impact registration form within 2 working days, and the newly-established catering industry projects that need to declare the environmental impact report form shall complete the examination and approval within 5 working days.
the applicant is responsible for the authenticity of the letter of commitment, and the applicant and the environmental impact assessment unit are responsible for the authenticity and scientificity of the contents of the environmental impact registration form and the environmental impact report form. Article 9 Before examining and approving the environmental impact registration form or report form, the competent administrative department of environmental protection shall solicit the opinions of the operators and the direct stakeholders at the project location through announcements or hearings, etc. for the following catering projects:
(1) Newly-established catering projects within the strictly controlled areas specified in the second paragraph of Article 6 of these Measures;
(2) Other projects that the competent administrative department of environmental protection deems necessary to solicit opinions. Article 11 Pollution prevention and control facilities for newly-established catering projects shall be designed, constructed and put into use simultaneously with kitchen facilities. After the completion of pollution prevention and control facilities, it shall timely apply for completion acceptance. The competent administrative department of environmental protection shall, within 31 days from the date of receiving the application, complete the completion acceptance and issue an acceptance opinion.
if the pollution prevention and control facilities of the newly-built catering industry project have not been completed or have not passed the completion acceptance, they may not be opened. Article 11 Newly-established catering industry projects shall be equipped with the following pollution prevention facilities:
(1) Installation of oil fume and waste gas purification devices and special oil fume exhaust pipes that match their business scale, and the installation of oil fume exhaust pipes shall conform to relevant standards. If the height of the building where the catering project is located is 24 meters or less and there is no special flue, the outlet of the fume exhaust channel shall be 1.5 meters above the highest point of the building; The vent outlet shall not directly face the street and shall avoid residential buildings and other vulnerable buildings;
(2) If sewage is directly discharged into the environment, sewage treatment facilities shall be provided; To discharge catering sewage into urban sewage centralized treatment facilities, pretreatment facilities such as oil separation, grille and residue filtration shall be provided;
(3) Equipment that produces noise shall be equipped with sound insulation and noise reduction facilities.
