Article 3 The management of production safety shall adhere to the policy of safety first, prevention first and comprehensive management.

Article 5 Employees of production and business operation entities shall have the right to obtain the guarantee of safety in production according to law, and shall perform their obligations in respect of safety in production according to law. Article 6 Trade unions at all levels shall organize employees to participate in the democratic management and supervision of work safety in their own units, put forward suggestions to ensure work safety, urge the rectification of hidden dangers of accidents, participate in the investigation of work safety accidents, and safeguard the legitimate rights and interests of employees in work safety. Article 7 The people's governments at or above the county level shall strengthen the leadership over the work of production safety, incorporate the work of production safety into the national economic and social development plan, support and urge the relevant departments to perform their duties of supervision and administration of production safety according to law, and coordinate and solve major problems existing in the supervision and administration of production safety in a timely manner.

Article 8 The safety production supervision and management departments of the people's governments at or above the county level shall, in accordance with the law, implement comprehensive supervision and management of safety production within their respective administrative areas, and guide and urge other departments responsible for safety production supervision and management to perform their duties.

Article 11 The people's governments at or above the county level and their relevant departments shall commend and reward the units and individuals that have made remarkable achievements in improving the conditions for safe production, preventing production safety accidents, participating in emergency rescue, reporting hidden dangers of major accidents, and reporting illegal acts in production safety, etc. Chapter ii guarantee of safety in production of production and business operation entities article 12 a production and business operation entity shall meet the following conditions for safety in production:

(1) the production and business operation sites, equipment and facilities meet the provisions of relevant laws and regulations on safety in production and the requirements of relevant national standards, industrial standards or local standards;

(2) The rules, regulations and operating procedures for safe production are sound;

(3) capital investment necessary to ensure safety in production;

(4) having a safety production management organization as stipulated in Article 16 of these Regulations, or having or entrusting safety production management personnel;

(5) the main person in charge and the safety production management personnel have the knowledge and management ability of safety production that are suitable for production and business activities;

(6) Employees shall be qualified through safety education and training, and special operators shall receive special safety operation training according to law, and obtain special operation qualification certificates;

(7) equipping employees with labor protection articles that meet national standards, industrial standards or local standards;

(8) provide employees with occupational safety and health conditions that meet the requirements of the state, and conduct regular health examinations for those engaged in operations with occupational hazards;

(9) Other conditions for safe production as stipulated by laws and regulations.

production and business operation entities shall not engage in production and business operation activities if they do not meet the conditions for safe production as stipulated in the preceding paragraph. Article 14 The person in charge of a production and business operation entity shall perform the duties of safety production management according to law, accept the supervision and inspection of the safety production supervision and management departments and relevant departments, and accept the democratic supervision of the trade unions and employees on the safety production work. The main person in charge bears overall leadership responsibility for the safety production work of the unit, and the person in charge of safety production bears direct leadership responsibility for the safety production work; Other responsible persons shall bear corresponding leadership responsibilities for the work of safety in production within their business scope.
