Regulations of Xinyu Municipality on Nursing Home
Article 1 These Regulations are formulated in accordance with the Law of the People's Republic of China on the Protection of the Rights and Interests of the Elderly, the Measures for the Implementation of the Law of the People's Republic of China on the Protection of the Rights and Interests of the Elderly in Jiangxi Province and other laws and regulations in order to promote the development of nursing homes, meet the needs of aged care services, and improve the quality of life of the elderly. Article 2 These Regulations shall apply to the construction, operation and management of nursing homes and their facilities within the administrative area of this Municipality. Article 3 The term "nursing home" as mentioned in these Regulations refers to the public welfare service mode for the aged, which is led by the government and managed by village (neighborhood) committees and provides services such as diet, entertainment, day care and spiritual comfort for the elderly. Article 4 Nursing homes follow the principles of government-led, social participation, family responsibility, moderate inclusiveness, voluntary choice and convenience nearby, and promote the healthy development of nursing homes in accordance with the requirements of replicability, popularization, sustainability and popularization. Article 5 The people's governments of cities and counties (districts) shall strengthen the overall planning for the work of nursing homes, study and formulate supporting policies for the sustainable development of nursing homes, and incorporate special funds for nursing homes into the financial budget.

High-tech Industrial Development Zone, Fairy Lake Scenic Area and Xinyi Economic Cooperation Demonstration Zone shall, in accordance with the requirements of the Municipal People's Government, do a good job in helping the poor in their respective regions.

Township (town) people's governments and sub-district offices shall organize and implement the work of nursing homes within their respective jurisdictions.

The village (neighborhood) committees shall assist the township (town) people's governments and neighborhood offices in the daily management of nursing homes. Article 6 The civil affairs departments of the people's governments of cities and counties (districts) shall be in charge of the work of nursing homes within their respective administrative areas.

The development and reform, public security, finance, human resources and social security, natural resources, housing and urban and rural construction, agriculture and rural areas, cultural tourism, sports, health, emergency management, fire rescue, auditing, state-owned assets management, market supervision and management, medical security and other departments of the people's government of the city and county (district) shall, according to their respective functions and duties, do a good job in the related work of nursing homes. Seventh support rural collective economic organizations to develop and expand the collective economy, increase the income of village collectives, and promote the development of nursing homes. Article 10 The people's governments of cities and counties (districts) shall integrate social resources and encourage enterprises, institutions and individuals to transform idle places and facilities near residential areas into facilities for nursing homes; Guide rural areas to rely on administrative villages and natural villages, and use idle places owned by rural collectives to build old-age facilities.

Rural collective economic organizations can use collectively owned land according to law to build facilities for nursing homes for their members. Eleventh facilities should use a unified logo, logo should be hung or embedded in the lintel, wall eye-catching position.

The sign of the nursing home is designed by the civil affairs department of the Municipal People's Government. Fourteenth the relevant units shall charge water, electricity, gas, cable TV, fixed telephone, broadband network and other fees. Seventeenth nursing home facilities managers should establish and improve the management system of fire protection, food hygiene, safety on duty, facilities and equipment, and conduct regular safety inspections to eliminate potential safety hazards in time. Eighteenth home facilities managers should regularly clean and disinfect the living and activity places and articles used by the elderly. Nineteenth canteens and enterprises that provide catering services for the elderly at home shall abide by relevant laws and regulations and food safety standards, and implement systems such as raw material control, cleaning and disinfection of tableware and drinking utensils, and food sample retention. Twentieth nursing home staff should hold a valid health certificate, and conduct a health check every year. Twenty-first nursing home staff should respect the personal dignity of the elderly who enter the nursing home, and shall not infringe upon their personal rights, property rights and other legitimate rights and interests.
