Other relevant administrative departments shall be responsible for the relevant price work within the scope of their respective duties. Chapter II Pricing Article 5 The prices of goods and services shall be regulated by the market in addition to the government-guided prices or government-set prices according to law, and shall be determined independently by the operators according to the production and operation costs and the market supply and demand situation, and following the principles of fairness, legality, honesty and credibility.
In accordance with the provisions of relevant laws and regulations, if the operator needs to go through the price filing procedures for independent pricing, it shall report to the competent price department for filing in accordance with the procedures. Article 6 The prices of commodities and services subject to government guidance and government pricing shall be determined by the municipal, district (city) people's government in accordance with the pricing authority and scope stipulated in the pricing catalogue, based on the social average cost and market supply and demand of related commodities or services, and taking into account the requirements of national economic and social development, social affordability, resource scarcity and ecological value.
For goods and services subject to government-guided and government-set prices, a differential price policy can be implemented according to the needs of safeguarding people's livelihood, saving resources, protecting the environment, technological innovation and industrial restructuring. Article 7 In formulating and adjusting government-guided prices and government-set prices, price (cost) surveys shall be conducted to listen to the opinions of consumers, business operators and relevant parties; Experts should also be organized to demonstrate the prices of goods and services with strong professional skills.
The decision to set and adjust prices shall be announced to the public. Article 8 The pricing cost shall be supervised and examined when formulating and adjusting the government-guided prices and government pricing that are legally included in the catalogue management of cost supervision and examination. Article 9 A price hearing shall be held when formulating and adjusting the government-guided prices and government-set prices listed in the price hearing catalogue according to law.
The price hearing shall follow the principles of openness, fairness, impartiality and efficiency. The competent pricing department shall make public the hearing plan, the conclusion of pricing cost supervision and examination, the list of participants in the hearing, the adoption of the main opinions of the participants in the hearing and the reasons. The competent department of price or the competent department of industry shall not influence the speech of the participants in the hearing by inspiring or hinting.
The specific procedures of the hearing shall be implemented in accordance with the relevant provisions of the state. Article 10 For the commodities and services subject to government guidance and government pricing, the competent pricing department shall conduct price tracking investigation and evaluation in accordance with regulations. Eleventh price departments can determine the prices of related goods and services according to the applications of units and individuals. Chapter III Price Behavior of Operators Article 12 When conducting price activities, operators shall abide by the following provisions:
(a) the implementation of government guidance and government pricing;
(two) the implementation of government price intervention measures, emergency measures and other price measures;
(three) the implementation of laws, regulations and rules to give special groups preferential prices;
(4) Cooperate with the price (cost) survey, supervision and examination of pricing cost and price monitoring carried out by the competent price department according to law, and provide true, accurate and complete relevant information;
(five) accurately record and classify the production and operation costs of goods and services subject to government guidance and government pricing. Article 13 Business operators shall clearly mark the prices of commodities and services, indicating the commodity name, place of origin, specifications, grades, pricing units, prices or service items, charging standards, etc. According to the regulations, ensure that the label content is true and accurate, the handwriting is clear, the label is eye-catching and the label is aligned.
If a service can be broken down into multiple items and charging standards, it shall be marked separately. Fourteenth operators shall not charge any unmarked fees in addition to the clearly marked price.
If the goods and services are settled after consumption, the business operator shall truthfully inform the other party of the price before selling the goods and providing the services, and issue a bill specifying the specific items and prices at the time of settlement.
Catering service operators shall not charge room fees, air conditioning fees, table fees, tableware use (disinfection) fees and other facilities and equipment use fees in addition to the catering price. Fifteenth operators shall not use the following false or misleading price means to trick others into trading with them:
(a) clearly marked in the price list, price list, the actual content, to deceive consumers or other business operators;
(2) Using two price tags or price lists at the same time for the same commodity or service to attract customers at low prices and settle accounts at high prices;
(three) using deceptive or misleading language, words, pictures, units of measurement and other pricing methods to induce others to trade with them;
(four) the marked market lowest price, ex-factory price, wholesale price, special price, preferential price and other prices are unfounded or incomparable;
(five) when the goods sold are processed products, the processed products and the prices of the processed products are not indicated;
(six) when taking the form of extra-price gift, the name and quantity of the gift items are not truthfully marked;
(seven) attached with additional price conditions, the additional conditions are not marked or marked vaguely;
(eight) fictional original price, false discounts, false claims of price reduction or price increase;
(nine) lied that the purchase and sale price is more favorable than other operators;
(10) Falsely stating that the prices of goods and services subject to market-regulated prices are government-guided prices or government-set prices;
(eleven) other acts prohibited by laws and regulations.
