Measures of Bengbu Municipality on the Administration of Residential Property
Chapter I General Provisions Article 1 In order to standardize residential property management activities, improve the level of property services, safeguard the legitimate rights and interests of owners, property users and property service providers, and create a good living environment, these Measures are formulated in accordance with the General Principles of the Civil Law of People's Republic of China (PRC), the Regulations on Property Management of Anhui Province and relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the use, maintenance and service of residential properties and their supervision and management activities within the administrative area of this Municipality.

The measures referred to in residential property management (hereinafter referred to as property management) refers to the activities of the owners of residential areas to maintain, conserve and manage the buildings, structures, supporting facilities and equipment and related venues within the property management area by hiring property service enterprises or the owners themselves, and to maintain environmental sanitation and related order. Article 3 Adhere to the principles of compartmentalization, territorial management, decentralization, and shifting the center of gravity, and establish a property management system that combines municipal supervision and guidance, county-level territorial management, sub-district offices (township people's governments) and neighborhood committees.

Promote property service enterprises and owners' committees to establish party organizations and give play to the leading role of party building. Article 4 The city, county and district governments shall establish a joint meeting on property management attended by property management departments such as housing and urban construction, urban management administrative law enforcement, development and reform, public security, emergency management, fire rescue, market supervision and management, civil air defense, etc., coordinate and solve major problems in property management, and establish a dispute resolution mechanism for property management. Fifth city housing and urban-rural construction department is responsible for the city's property management, its main responsibilities are:

(a) to study and formulate relevant policies on the management of the property industry in this Municipality and organize their implementation;

(two) to guide and supervise the county to carry out property management and assessment;

(three) the implementation of classified supervision of property service enterprises, the establishment of incentive and disciplinary system;

(four) to guide and supervise the collection, management and use of maintenance funds for buildings and their ancillary facilities in this Municipality (hereinafter referred to as special maintenance funds);

(five) guidance, supervision and management of property management bidding activities;

(six) to establish and improve the property management training system;

(seven) to formulate the rules of procedure of the owners' congress, temporary management regulations, management regulations, property service contracts and other model texts;

(eight) the establishment of the city's unified property management credit information, owners * * * decision information system;

(nine) to guide and supervise industry associations to carry out and implement industry self-discipline;

(ten) other duties as prescribed by laws and regulations. Article 6 The development and reform department shall be responsible for the formulation, adjustment and release of the charging standards for pre-residential property services in this city.

The public security department is responsible for guiding the car parking in the property management area, and standardizing the parking space setting and parking order within the red line of the roads around the community.

The fire rescue department is responsible for investigating and dealing with violations of fire laws and regulations according to law.

The market supervision and management department is responsible for accepting complaints about the change of residence to camp; Investigate and deal with price violations in property services; To supervise the safety of elevators, boilers and other special equipment in the property management area, and supervise the property service enterprises to assume the relevant responsibilities and obligations of elevator users.

Urban management administrative law enforcement departments are responsible for investigating illegal construction, setting up stalls, occupying roads, raising poultry and other illegal acts.

Civil air defense, finance, ecological environment, natural resources and planning, justice and other departments, in accordance with their respective responsibilities, cooperate with each other to do a good job in the supervision and management of property management. Seventh county property management administrative departments responsible for the administrative area of property management, its main responsibilities are:

(a) to supervise and manage the realty service enterprises, projects and employees within their respective administrative areas;

(two) to participate in the management of property management bidding activities within their respective administrative areas;

(three) responsible for the filing of property service enterprises;

(four) administrative mediation of property disputes according to law;

(five) to be responsible for the guidance, supervision and filing of property inspection and filing within their respective administrative areas;

(six) to guide and supervise the development and assessment of property management in the sub-district offices (Township People's governments) within their respective administrative areas;

(seven) responsible for the training of property management related personnel;

(eight) during the emergency response, to guide the property service project enterprises within their respective administrative areas to carry out the corresponding level of response work;

(nine) to establish a comprehensive law enforcement mechanism to investigate and deal with illegal acts in property management activities according to law;

(ten) other duties as prescribed by laws and regulations. Eighth street offices (Township People's Government) are the main body of property management in this area, and their main responsibilities are:

(a) to organize, coordinate and guide the establishment of the owners' congress and the general election of the owners' committee; Guide and supervise the work of the owners' congress and the owners' committee, and urge the owners' committee and the property service enterprises to implement the use and update of special maintenance funds; If the decisions made by the owners' congress and the owners' committee violate laws and regulations, they shall be ordered to make corrections within a time limit or be revoked.

(two) improve the mediation mechanism of property conflicts, and deal with contradictions, disputes and complaints in property management activities;

(three) to guide the neighborhood (village) committees to set up environmental and property management committees to coordinate and handle major issues of property management within their respective jurisdictions;

(four) responsible for the implementation of basic property services in old residential areas within their respective jurisdictions;

(five) to supervise and manage the property service enterprises, projects and employees within their respective jurisdictions;

(six) other duties as prescribed by laws and regulations.
