Article 1 In order to protect and improve the living environment and ecological environment of this Municipality and prevent the environmental pollution caused by disposable non-degradable plastic tableware, these Provisions are formulated in accordance with the provisions of the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Wastes and other laws and regulations, combined with the actual situation of this Municipality. Article 2 Disposable non-degradable plastic tableware as mentioned in these Provisions refers to disposable non-degradable food containers such as lunch boxes, cups, plates and bowls made of expanded polystyrene, polyethylene or polypropylene. Article 3 Since the implementation of these Provisions, the production, sale and use of disposable non-degradable plastic tableware are prohibited within the administrative area of this Municipality. Article 4 The administrative department of environmental protection of Guangzhou Municipality shall be responsible for the implementation of these Provisions.

Technical supervision, health and epidemic prevention, industrial and commercial administration, commercial administration and other departments should coordinate the implementation according to their duties. Fifth people's governments at all levels and relevant departments of environmental protection, science and technology should take measures to encourage and support the scientific research, development and business activities of disposable tableware that can be degraded and meet the requirements of environmental protection. Article 6 The production and sale of disposable tableware shall be included in the certification management of "green products" for environmental protection.

Anyone who produces, sells and uses disposable tableware shall meet the requirements of environmental protection and food hygiene.

Enterprises producing disposable degradable plastic tableware should apply for certification and registration to Guangzhou "Green Products" Certification Office.

Disposable degradable plastic tableware sold should be certified by the manufacturer. Seventh hotels, hotels, restaurants, food stalls and other catering business units or individuals that need to use disposable tableware should use disposable degradable plastic tableware or paper and plant fiber tableware that meet the requirements of environmental protection and are certified.

Production enterprises of disposable packaged foods such as bowls and noodles should use materials that meet the requirements of environmental protection to make food containers. Eighth in violation of the provisions of any of the following circumstances, shall be punished by the competent administrative department of environmental protection or in conjunction with the relevant administrative departments:

(a) the production and sale of disposable non-degradable plastic tableware, shall be ordered to make corrections within a time limit, impose a fine of 3000 yuan to 20000 yuan or impose a fine of more than 0 times and less than 3 times the illegal income, but the maximum shall not exceed 30000 yuan.

(two) the production and sale of unauthorized disposable tableware, given a warning or impose a fine of more than 3000 yuan 10000 yuan.

(three) the use of disposable non-degradable plastic tableware for business activities, given a warning or fined 1000 yuan to 1000 yuan. Article 9 These Provisions shall come into force on 1 September 19971day.
