Regulations of Xiangyang Municipality on the Treatment of Rural Domestic Waste

article 1 these regulations are formulated in accordance with relevant laws and regulations and the actual situation of this municipality in order to strengthen and standardize the management of rural domestic garbage, improve the rural living environment and promote the construction of beautiful countryside. Article 2 These Regulations shall apply to activities such as cleaning, classification, delivery, collection, transportation, disposal, supervision and management of village (community) domestic garbage outside the urbanization management area of this Municipality.

the term "rural domestic waste" as mentioned in these regulations refers to the solid waste generated by villagers, units and individuals stationed in rural areas (hereinafter collectively referred to as "units and individuals stationed in villages"), daily life or activities providing services for daily life, and solid waste regarded as domestic waste according to laws and regulations.

if there are provisions in laws and regulations on the management of solid waste such as hazardous waste, medical waste and construction waste, those provisions shall prevail. Article 3 The treatment of rural domestic garbage shall follow the principles of government leading, social participation, urban and rural planning, territorial management, source treatment and classified treatment, and promote the reduction, recycling and harmlessness of rural domestic garbage. Fourth, the establishment of financial security, village collective subsidies, villagers to pay, social capital participation in the combination of rural domestic waste control funds investment mechanism.

the municipal people's government should increase financial investment in the treatment of rural domestic waste, and can set up incentive funds for the assessment and reward of rural domestic waste treatment.

the people's governments of counties (cities, districts) and townships should include the funds for rural domestic waste treatment in the annual fiscal budget, which will be used to ensure the infrastructure construction and management of rural domestic waste treatment, the transportation and terminal disposal of rural domestic waste, and the treatment of village (community) cleaners.

The village (neighborhood) committee can charge the villagers, resident units and individuals for the disposal of domestic waste according to the principle of "who benefits, who pays" and the village rules and regulations, or through discussion and decision at the village (neighborhood) meeting and the village (neighborhood) representative meeting, draw a certain proportion of funds from the village collective economic income to subsidize the collection of domestic waste and the allocation of transportation equipment in the village (community).

the people's governments of cities and counties (cities, districts) should formulate relevant policies, encourage and guide social capital to participate in the collection, transportation and disposal of rural domestic waste through bidding and franchising, and encourage and support scientific and technological innovation and application of achievements in rural domestic waste control. Article 5 The Municipal People's Government shall co-ordinate the treatment of rural domestic waste in the whole city, incorporate the treatment of rural domestic waste into the national economic and social development plan, clarify the standards for ensuring county-level financial funds, determine the treatment objectives, and improve the coordination, assessment, supervision and incentive mechanisms.

the municipal urban and rural construction department is the competent department of rural domestic waste treatment in the city, and is responsible for the overall planning, comprehensive coordination, assessment and supervision of rural domestic waste treatment in the city. Article 6 The people's governments of counties (cities, districts) and the administrative committees of development zones shall be responsible for the treatment of rural domestic garbage within their respective administrative areas, and incorporate the treatment of rural domestic garbage into the national economic and social development plan, and perform the following duties:

(1) Determine the local competent departments for the treatment of rural domestic garbage, and clarify the responsibilities of relevant departments;

(2) Implement the financial funds for rural domestic waste treatment according to the standards;

(3) to formulate a special plan for local rural domestic waste treatment;

(4) overall planning and construction of township (street) domestic waste transfer stations and county-level domestic waste disposal facilities to provide technical and professional support for the construction of village-level domestic waste collection and classification facilities;

(5) Arrange purchasing outlets reasonably, and support and guide market players to participate in the recycling of low value-added recyclable garbage such as waste plastics, waste glass and waste fabrics;

(6) establish a comprehensive assessment system for rural domestic waste management, and incorporate it into the performance evaluation system for various functional departments and township people's governments (street offices);

(7) Other matters stipulated by laws and regulations. Article 7 Township People's governments and sub-district offices shall organize and implement the work of rural domestic waste control within their respective jurisdictions, and specifically perform the following duties:

(1) Formulate the work plan for rural domestic waste control;

(2) assist in promoting the construction of domestic waste transfer stations;

(3) To be responsible for organizing the transfer of rural domestic waste and ensuring the normal operation of domestic waste transfer stations;

(4) Supervise, guide and evaluate the domestic waste treatment work of village (neighborhood) committees;

(5) Other matters stipulated by laws and regulations. Article 8 the village (neighborhood) committee shall organize the cleaning, sorting and collection of domestic garbage in the village (community), and perform the following duties:

(1) Incorporate the treatment of domestic garbage into the village rules and regulations through the village (neighborhood) meeting or the village (neighborhood) representative meeting, publicize and guide the village (neighborhood) people, resident units and individuals to consciously carry out garbage sorting, and actively participate in domestic garbage sorting.

(2) Establish a domestic waste classification management system and formulate a domestic waste classification reduction plan;

(3) set up a team of cleaning staff to carry out the responsibility of classified collection of domestic garbage;

(4) Equip domestic garbage cleaning, collection and transportation equipment and tools, and build domestic garbage collection and transfer rooms (points), classified temporary storage places and organic garbage centralized composting points;

(5) Organize regular environmental sanitation rectification to keep the village clean and tidy;

(6) to guide and supervise the villagers, units and individuals in the village to put domestic garbage in different categories, and to discourage the non-compliance with the provisions;

(7) Other matters stipulated by laws and regulations.

in areas where the market-oriented operation of rural domestic waste treatment is implemented, the village (neighborhood) committees can determine the relevant market entities to undertake the responsibilities related to rural domestic waste treatment according to the actual situation.
