The labor and social security departments (bureaus), finance departments (bureaus), health departments (bureaus) and safety production supervision and management departments of all provinces, autonomous regions and municipalities directly under the Central Government:

In order to implement the Regulations on Work-related Injury Insurance, reasonably determine the rate of work-related injury insurance, promote work-related injury prevention, and realize the social economy of work-related injury insurance expenses, with the approval of the State Council, the rate of work-related injury insurance is hereby notified as follows:

I. Industrial division of labor

According to the degree of industrial injury risk in different industries, referring to the National Economic Industry Classification (GB/T 4754—2002), the industries are divided into three categories: the first category has less risk, the second category has moderate risk and the third category has greater risk. Three types of industries implement three different work-related injury insurance payment rates respectively. According to the industrial and commercial registration and main production and operation of the employer, the social insurance agency in the overall planning area shall determine the industry risk categories of each employer respectively. See the annex for the classification of industry risks.

Second, about the determination of the rate

In principle, the average contribution rate of work-related injury insurance premiums in all provinces, autonomous regions and municipalities directly under the Central Government should be controlled at about 1.0% of the total wages of employees. Under this overall level, the benchmark rates of the three industries in the overall planning area should be controlled at about 0.5%, 1.0% and 2.0% of the total wages of the employees of the employer respectively. Overall regional labor and social security departments, in conjunction with finance, health, safety supervision and other departments, according to the use of work-related injury insurance premiums, the incidence of work-related injuries, the degree of occupational hazards, etc., put forward specific standards for the classification of industry benchmark rates. , reported to the people's government of the overall planning area for approval before implementation. The specific standard of the benchmark interest rate can be adjusted regularly.

Thirdly, about the floating exchange rate.

If the employer belongs to a class of industries, it shall pay the fees according to the industry benchmark rate, and no rate fluctuation shall be implemented. If the employer belongs to the secondary and tertiary industries, the rate shall be floating. The employer's initial payment rate is determined according to the industry benchmark rate, and will fluctuate every 1 to 3 years from now on according to the employer's use of work-related injury insurance premiums, the incidence of work-related injuries, the degree of occupational hazards and other factors. On the basis of the industry benchmark rate, it can float up and down by two grades: the highest grade is 120% of the industry benchmark rate, the highest grade is 150% of the industry benchmark rate, the first grade is reduced to 80% of the industry benchmark rate, and the second grade is reduced to 50% of the industry benchmark rate. The specific measures for the floating rate shall be formulated by the administrative department of labor and social security in the overall planning areas in conjunction with the departments of finance and health.

All localities should conscientiously do a good job in calculating the relevant data of work-related injury insurance, reasonably determine the industry benchmark rates, and scientifically formulate specific measures for floating rates. It is necessary to strengthen the monitoring of the operation of industrial injury insurance, regularly analyze the influence of industrial injury insurance rate on the operation of industrial injury insurance system, and report major problems in time. Regularly understand the income and expenditure of the industrial injury insurance fund, put forward a plan to adjust the industry differential rate and industry rate grade in time, and report it to the State Council for approval before promulgation and implementation.
