Interim Measures of Shantou Industry Association
Chapter I General Provisions Article 1 In order to promote the healthy development of trade associations, standardize their organization and behavior, and give full play to their positive role in the construction of socialist market economy, these Measures are formulated in accordance with the Regulations of the State Council Municipality on the Administration of Registration of Social Organizations and relevant laws and regulations, and combined with the actual situation of this Municipality. Article 2 The term "trade associations" as mentioned in these Measures refers to non-profit trade associations, chambers of commerce and other economic and social groups voluntarily formed by economic organizations, economic entities and individuals in the same industry in this Municipality and registered according to law. Article 3 The purpose of a trade association is to standardize the market order of the industry, maintain fair competition, communicate the relationship between members and the government, safeguard the legitimate rights and interests of members, coordinate the relationship between members, provide services for members, improve the competitiveness of the industry and promote the economic development of the same industry. Article 4 Trade associations must abide by laws, regulations and rules, and may not harm the national interests, social public interests, members' interests and the legitimate rights and interests of other organizations and citizens. Article 5 The relevant departments and authorized organizations of the municipal government are the competent business units of the relevant industry associations in this Municipality, and are responsible for the preliminary examination of the application for the establishment, registration of establishment, registration of change, cancellation of registration and annual inspection of the industry associations, and guide and supervise the industry development and industry norms.

The Municipal Administration of Non-governmental Organizations is the registration authority of trade associations in this Municipality, and is responsible for the establishment, alteration and cancellation of registration of trade associations in this Municipality, and conducts annual inspection, supervision and management of trade associations. Article 6 Governments at all levels and their relevant departments shall support and promote the development of trade associations, transfer the functions that should belong to trade management to trade associations, give full play to the role of trade associations in economic construction and social development, and ensure their independent activities according to law. Chapter II Establishment of Trade Associations Article 7 Trade associations may be established according to the current national classification standards for industries or products, or according to the mode of operation, business contacts and service functions.

Only one trade association can be established in the same administrative region for the same industry or product, and the same or similar trade associations may not be established repeatedly.

For industries or products with concentrated enterprises in the same industry and regional economic characteristics, municipal industry associations can be established with district and county enterprises as the main body, and after registration by the Municipal Administration of Civil Organizations, they will assume the functions of city-wide industry associations. Article 8 To initiate and prepare a trade association, the following conditions shall be met:

(a) there are more than 5 promoters, who are enterprises, individual industrial and commercial households or other economic organizations that have obtained business licenses in this Municipality and have been operating continuously for more than 2 years;

(2) The industry association to be established shall be representative of the industry. Article 9 The establishment of a trade association shall meet the following conditions:

(a) there are more than 50 individual members or more than 30 unit members; The total number of individual members and unit members shall not be less than 50;

(2) Having a standardized name and corresponding organization;

(3) Having a fixed residence;

(4) Having full-time personnel suitable for business activities;

(five) there are more than 30 thousand yuan of activity funds;

(6) Having the ability to bear civil liability independently. Article 10 An application for establishing a trade association must go through two procedures: application preparation and application registration.

To apply for the establishment of an industry association, the promoters shall first apply to the competent business unit, and submit relevant documents and materials in accordance with the regulations of the State Council Municipality on the registration and administration of social organizations. The competent business unit shall, within 30 days from the date of receiving the application, conduct a review, and submit a written consent to those who meet the conditions; Do not meet the conditions, it shall explain the reasons in writing.

With the approval of the competent business unit, the promoters shall apply to the Municipal Administration of Non-governmental Organizations for preparation according to law with the approval documents of the competent business unit and the relevant materials stipulated in the Regulations on the Administration of Registration of Social Organizations in the State Council. After approval and completion of the preparatory work, they shall apply to the competent business unit and the Municipal Administration of Non-governmental Organizations for registration of establishment. The Municipal Administration of Non-governmental Organizations shall make a decision within the statutory time limit in accordance with the relevant provisions of the Regulations of the State Council Municipality on the Registration and Administration of Social Organizations. Article 11 Where a trade association needs to set up a branch or representative office, it shall go through the registration formalities in accordance with the provisions of the third paragraph of Article 10 of these Measures after being examined and approved by the competent business unit. Twelfth the establishment of a trade association shall formulate the articles of association of the trade association. The articles of association of the trade association shall specify the following items: the name and domicile of the trade association; Purpose, business scope and activity area; Members and their rights and obligations; Organizational management system, organizational structure formation procedures; Conditions for the person in charge, methods for the selection and recall of the person in charge and their terms of reference; Payment method of membership dues, asset management and use system; Procedures for amending the articles of association; Termination procedures and asset disposal; Other matters that need to be specified. Thirteenth industry associations to industry service, industry self-discipline, industry representatives, industry coordination as the basic functions, and undertake the following specific functions:

(1) Collecting, counting, analyzing and publishing industry information and early warning information;

(two) according to the provisions of laws and regulations or entrusted by the government, to participate in or be responsible for the examination of industry qualifications and market access qualifications;

(three) to carry out technical and vocational training, consultation and information exchange;

(4) Organizing commodity fairs and exhibitions;

(five) to participate in the identification of new products in this industry and organize the popularization and application of scientific and technological achievements;

(six) to organize investigation and study to provide decision-making basis for the competent departments of the industry;

(seven) to organize the investigation and evidence collection of industrial damage and the prosecution and response of dumping and anti-dumping cases;

(eight) to participate in the development of related industries, industry reform and government decision-making demonstration involving the interests of the industry, and to participate in the formulation of local or national standards for related industries and products;

(nine) to organize the formulation of rules and regulations, coordinate peer price disputes, and maintain fair competition in the industry;

(ten) to assist the competent departments of the industry to carry out market rectification, quality inspection, merit evaluation and other work;

(eleven) to organize corporate cultural activities and strengthen the construction of socialist spiritual civilization;

(twelve) to carry out economic and technological exchanges and cooperation at home and abroad;

(thirteen) to undertake other functions stipulated by laws and regulations and authorized or entrusted by the government.
