chapter I general provisions article 1 [legislative purpose] these regulations are formulated in accordance with the price law of the people's Republic of China and other relevant laws and administrative regulations, combined with the actual situation of this province, in order to regulate price behavior, maintain market price order, and protect the legitimate rights and interests of consumers and business operators and the interests of the public. Article 2 [Scope of Application] These Regulations shall apply to price behaviors within the administrative area of this province. Article 3 [Government Responsibilities] The provincial people's government shall incorporate the price control objectives into the national economic and social development plan, strengthen the macro-control of prices, improve the price formation mechanism, and improve the price supervision system to maintain the overall market price level basically stable.
the provincial people's government can formulate and implement price policies and measures in areas determined by the state according to the principle of "try first".
people's governments at or above the county level should organize the implementation of price control targets, establish price coordination mechanisms, improve price control measures and enhance price control capabilities.
the people's governments at or above the county level shall include such funds as supervision and examination of pricing cost, pricing hearing and demonstration, price monitoring, price determination, price appraisal, and fee certificate verification in their fiscal budgets. Article 4 [Departmental Responsibilities] The competent price department of the people's government at or above the county level shall be responsible for the price work within its administrative area, and other relevant departments shall be responsible for the relevant price work within their respective functions and duties. Chapter II Price Behavior of Operators Article 5 The prices of commodities and services subject to market-regulated prices shall be determined independently by operators on the basis of production and operation costs and market supply and demand, following the principles of fairness, legality and good faith.
the provincial price department may, jointly with the relevant departments, formulate and publish rules of price behavior for the prices of important commodities and services that are closely related to the vital interests of urban and rural residents, so as to guide and standardize the operators to make their own decisions. Article 6 [Operator's Rights] Operators shall enjoy the following rights when conducting price activities:
(1) independently set prices that are regulated by the market;
(2) set specific prices within the range stipulated by the government guidance price;
(3) to set the trial sale price of new products within the scope of government-guided and government-priced products, except for specific products;
(4) Complaining, reporting and accusing the infringement of their right to make independent pricing according to law;
(5) put forward suggestions for adjustment of government guidance price and government pricing;
(6) ask the competent pricing department and other relevant departments for relevant pricing policies and relevant information.
when setting the trial sale price of a new product as stipulated in item 3 of the preceding paragraph, an operator shall file with the competent price department in accordance with the price management authority. The trial sale price shall not exceed two years. The scope of specific products shall be implemented in accordance with the provisions of the national and provincial price departments. Article 7 [Obligations of Operators] Operators shall perform the following obligations when conducting price activities:
(1) Implementing government-guided prices and government-set prices;
(2) implementing government price intervention measures, price emergency measures and other legal price measures;
(3) cooperate with the competent pricing department to carry out supervision and examination of pricing cost, price monitoring and price supervision and inspection according to law, and provide true, accurate and complete relevant information;
(4) Establish and improve the internal price management system;
(5) Other obligations stipulated by laws and regulations. Article 8 Business operators shall clearly mark the prices of goods and services in accordance with the provisions of the competent pricing department, so that the price tag is complete, the content of the price tag is true and clear, the handwriting is clear, the labels are aligned and the labels are eye-catching.
business operators are not allowed to sell goods at a higher price than the marked price, and are not allowed to charge any unspecified fees. If a service can be broken down into multiple items and standards, the operator shall clearly mark each item and standard, and shall not mix the prices or bundle them for sale.
when selling goods or providing services at reduced prices, business operators should use price tags and price lists to truthfully indicate the reasons for price reduction and the original and current prices, so as to distinguish them from selling goods and providing services at normal prices; And keep the records before the price reduction and the relevant information of the approved price for verification. Article 9 Operators shall not collude with each other to manipulate market prices, thereby harming the legitimate rights and interests of other operators or consumers. Article 11 [Prohibition of Price Monopoly] A competitive business operator, business operator and counterparty shall not violate the Anti-monopoly Law of the People's Republic of China and the provisions of the State on price monopoly and reach a price monopoly agreement. Operators with dominant market position shall not use price means to exclude or restrict market competition. Article 11 [Prohibition of Dumping at Low Price] Except for changing production and closing business, and dealing with fresh goods, seasonal goods and overstocked goods at reduced prices, operators shall not dump goods at a price lower than the cost in order to crowd out competitors or monopolize the market, thus disrupting the normal production and operation order and harming the national interests or the legitimate rights and interests of other operators. Article 12 [Prohibition of price gouging] Operators shall not engage in any of the following acts to push the prices of goods and services to rise too fast or too high:
(1) Fabricating and spreading price increase information to disrupt the market price order;
(2) hoarding a large number of commodities with tight market supply and abnormal price fluctuations beyond the normal storage quantity or storage period, and still hoarding after being warned by the competent price department;
(3) using other means to drive up prices and push the prices of goods and services to rise too fast or too high.
