The county (district) environmental sanitation administrative department is responsible for the supervision and management of the generation, collection, transportation and disposal of kitchen waste within its jurisdiction.
Development and reform, public security, environmental protection, industry and commerce, commerce, food and drug supervision and other relevant departments shall, according to their respective functions and duties, do a good job in the supervision and management of kitchen waste. Article 6 The municipal environmental sanitation administrative department shall, jointly with relevant departments, prepare a special plan for environmental sanitation in the whole city.
The special plan for environmental sanitation shall include the contents of kitchen waste disposal, and make overall arrangements for the layout, land use, scale and facilities of kitchen waste disposal and operation. Article 7 The Municipal People's Government shall provide financial support for the collection, transportation and disposal of kitchen waste. The specific measures shall be formulated separately by the Municipal People's Government. Eighth any unit or individual has the right to report and complain to the municipal administrative department of city appearance and environmental sanitation or the relevant administrative departments in violation of these measures. Article 9 The people's governments of cities and counties (districts) shall reward the units and individuals that have made remarkable achievements in the resource utilization and harmless treatment of kitchen waste. Chapter II Declaration, Collection, Transportation and Disposal of Kitchen Wastes Article 10 The collection, transportation and disposal of kitchen wastes shall be franchised. Units and individuals that have not obtained the franchise license qualification shall not engage in the collection, transportation and disposal of kitchen waste. Eleventh implement the classification of kitchen waste, and promote the integrated operation of kitchen waste collection, transportation and disposal. Twelfth units engaged in the collection, transportation and disposal of kitchen waste shall meet the following conditions:
(1) Having the qualification of an enterprise legal person;
(2) Having a fixed office space, mechanical equipment and vehicles;
(3) Having corresponding funds, equipment and facilities;
(four) the use of closed special collection containers, and has the function of classified collection;
(5) Fully enclosed automatic unloading truck is adopted, which has the function of preventing odor from spreading and leaking;
(six) there are perfect plans for the treatment of wastewater, waste gas, waste residue and other discharge standards;
(seven) there are facilities to monitor the flow of kitchen waste;
(eight) the technology and technology adopted meet the requirements of the relevant national standards and have passed the professional examination. Thirteenth units engaged in kitchen waste collection, transportation and disposal services shall comply with the following provisions:
(a) in accordance with the standards and norms of environmental sanitation operations, timely collect and transport kitchen waste to the designated disposal site at the specified time and according to the specified route;
(2) Containers and vehicles for the collection and transportation of kitchen waste shall be sealed, intact, tidy and uniformly marked;
(three) in accordance with the relevant provisions of environmental protection, take effective measures to prevent and control pollution;
(four) the establishment of safety institutions and their full-time safety management personnel, improve and implement the safety management system, supporting safety facilities, to ensure the safe operation of disposal facilities;
(five) to ensure the sustained and stable operation of kitchen waste treatment facilities and equipment, without the consent of the municipal environmental sanitation administrative department, shall not be closed down or closed. If the normal treatment of kitchen waste is affected by equipment maintenance, it shall report to the municipal environmental sanitation administrative department 15 in advance; If it is really necessary to suspend business, it shall report to the municipal environmental sanitation administrative department three months in advance, and suspend business after approval;
(six) signed a collection and transportation agreement with the kitchen waste generating units and individuals, and reported to the municipal environmental sanitation administrative department for the record;
(seven) in accordance with the relevant provisions, the flow of kitchen waste recycled products shall be registered with the relevant departments for the record. Article 14 Food processing enterprises, catering enterprises, unit canteens, individual industrial and commercial households and other kitchen waste generating units and individuals shall hand over the kitchen waste to enterprises with franchise qualifications for unified collection, transportation and disposal:
(a) the kitchen waste and other garbage classified storage, to ensure the recycling of kitchen organic waste;
(two) set up a standard kitchen waste collection container to ensure that the kitchen waste collection container is intact, airtight and clean;
(3) Install a professional oil-water separation device to collect waste edible oil, and do not discharge kitchen waste into rainwater pipes, sewage pipes, drainage ditches, public toilets or reservoirs, rivers and lakes.
