Article 2 These Measures shall apply to the generation, collection, transportation, disposal and related management activities of kitchen waste within the administrative area of this province. Article 3 The term "kitchen waste" as mentioned in these Measures refers to food residue and waste edible oil and other wastes generated in food processing, catering service, collective feeding and other activities other than residents' daily life.

Article 7 The collection, transportation and disposal expenses of kitchen waste shall be charged in the municipal solid waste treatment fee, and the insufficient part shall be appropriately subsidized by the local people's government, and the overall solution measures shall be formulated. Article 8 The catering industry association and the city appearance and environmental sanitation association shall play a guiding role in the industry, formulate relevant standards, standardize industry behaviors, popularize methods for reducing kitchen waste, and incorporate the management of kitchen waste into the rating of catering enterprises and the scope of environmental sanitation standards. Chapter II Planning and Construction Article 9 The special environmental sanitation plan prepared by the competent department of city appearance and environmental sanitation of the people's government of a city or county (city) divided into districts shall include the contents of kitchen waste treatment, and make overall arrangements for the layout, land use and scale of kitchen waste collection, transportation and disposal facilities.

Chapter III Collection and Transportation Article 14 The collection and transportation of kitchen waste shall be approved by the competent department of city appearance and environmental sanitation of the city divided into districts and the county (city) directly under the jurisdiction of the province, and the license certificate shall be obtained, and the following conditions shall be met:

(1) The applicant is an enterprise legal person registered according to law with a registered capital of not less than RMB 3 million;

(2) having a fully enclosed special collection container with classified collection function;

(3) There are more than ten special vehicles for transporting kitchen waste with the functions of preventing odor from spreading, spilling and dripping;

(4) having a fixed office and parking place for machinery, equipment and vehicles;

(5) Other conditions stipulated by laws and regulations.

Article 15 The competent department of city appearance and environmental sanitation of the people's government of a city or county (city) divided into districts shall, in principle, determine the kitchen waste collection and transportation enterprises through fair competition such as bidding, and sign an agreement on kitchen waste collection and transportation with them. The kitchen waste collection and transportation agreement shall clearly stipulate the operating period, service standards, liability for breach of contract, etc. Article 16 A kitchen waste generating unit shall abide by the following provisions:

(1) Categorize and store kitchen waste;

(2) Set up kitchen waste collection containers that meet the standards and keep them in normal use;

(3) If waste edible oils and fats are produced, install pollution prevention facilities and equipment such as oil-water separators or grease traps that meet the relevant technical requirements;

(4) establish a ledger for the generation of kitchen waste, and report the types and quantities of kitchen waste to the local city appearance and environmental sanitation department at the end of each month;

(5) Kitchen wastes shall not be dumped or piled up at will, and shall not be put into or discharged into municipal facilities such as domestic garbage collection facilities, sewage drainage pipes, rainwater pipes, rivers, channels, lakes, reservoirs and other places;

(6) The kitchen waste shall not be sold or transshipped;

(7) sign a written agreement with the kitchen waste collection and transportation enterprise, and hand over the kitchen waste to the kitchen waste collection and transportation enterprise that signed the agreement within 24 hours after the kitchen waste is generated, and shall not hand over the kitchen waste to other enterprises or individuals for collection and transportation.
