The term "domestic waste" as mentioned in these Regulations refers to the solid waste generated in daily life or activities providing services for daily life and the solid waste identified as domestic waste by laws and administrative regulations. Article 3 The management of urban and rural domestic waste shall follow the principles of government leading, participation of the whole people, overall planning of urban and rural areas, territorial management, local conditions and classified treatment. Article 4 The local people's governments at or above the county level shall strengthen their leadership over the management of urban and rural domestic waste, incorporate it into the national economic and social development plan of their respective administrative regions, establish a coordination mechanism for major issues, improve the classification and treatment system of urban and rural domestic waste, and incorporate the management of urban and rural domestic waste into the scope of government target responsibility assessment. The funds needed for urban and rural domestic waste management should be included in the fiscal budget at the corresponding level.
The township (town) people's government and street offices shall be responsible for the specific implementation of the classified delivery, collection and transshipment of domestic garbage and related supervision and disposal work within their respective jurisdictions.
Encourage village (neighborhood) committees to formulate village rules and regulations or management protocols, and urge and guide village (neighborhood) people to participate in domestic garbage disposal democratically. Fifth provincial people's government housing and urban and rural construction departments responsible for the supervision and management of urban and rural domestic waste.
The supervision and management of urban and rural domestic waste by the people's governments of cities and counties with districts shall be organized and implemented by the departments determined by the people's governments at the corresponding levels (hereinafter referred to as the supervision and management departments of urban and rural domestic waste of the people's governments of cities and counties with districts).
The relevant competent departments of the local people's governments at or above the county level, such as development and reform, education, industry and information technology, finance, natural resources, ecological environment, agriculture and rural areas, commerce, market supervision and management, urban and rural planning, etc., shall, in accordance with the division of responsibilities, cooperate in the management of urban and rural domestic waste. Article 6 Respect sanitation workers and their labor achievements, improve working conditions, ensure labor safety, gradually improve labor remuneration and welfare benefits, do a good job in health care and technical training, and safeguard legitimate rights and interests. Seventh, advocate the whole society to practice a low-carbon lifestyle and reduce the generation of domestic garbage.
Units and individuals shall, in accordance with the relevant provisions and requirements of garbage classification, fulfill the obligation of domestic garbage classification, take the initiative to carry out domestic garbage classification activities, and cultivate the habit of domestic garbage classification. Eighth to encourage and support the development of scientific and technological innovation of domestic waste treatment, promote the research and development and transformation and utilization of advanced technologies and processes for reducing, recycling and harmless domestic waste, and improve the scientific and technological level of domestic waste resource utilization.
Encourage the government to purchase services and cooperate with social capital. Select qualified, powerful and reputable market entities to undertake the collection, transportation and treatment of domestic waste. Chapter II Planning and Construction Article 9 The provincial people's government shall, according to the national and provincial population, geographical and urban and rural domestic waste treatment targets, and in combination with the production and treatment of domestic waste, organize the preparation of special plans for urban and rural domestic waste treatment.
The people's governments of cities and counties (cities) divided into districts shall, jointly with the relevant competent departments of urban and rural planning, organize the preparation of special plans for urban and rural domestic waste treatment in their respective administrative areas on the basis of special provincial plans, and organize their implementation after approval by the people's governments at the corresponding levels.
The special plan for the treatment of urban and rural domestic waste should be linked with the national economic and social development plan, the national land space plan and the ecological civilization construction plan of the administrative region, and the phased objectives should be defined, so as to increase the proportion of incineration power generation and biochemical disposal of domestic waste and reduce the amount of domestic waste landfill. Tenth cities and counties (cities) divided into districts shall organize demonstrations and hearings before submitting the special plan for urban and rural domestic waste disposal for examination and approval.
The approved special plan shall be published on the website of the people's government at the same level and the local major news media. Eleventh districts of the city and county (city, district) people's government of urban and rural domestic waste supervision and management departments shall, according to the administrative area of urban and rural domestic waste treatment special planning, formulate the construction plan and annual construction plan of domestic waste treatment facilities, and organize their implementation. Twelfth districts of the city and county (city, district) people's government shall incorporate the annual construction plan of domestic waste treatment facilities into the annual land use plan to ensure the construction land of domestic waste treatment facilities.
The competent department of urban and rural planning of the people's government of a city or county (city) divided into districts shall incorporate the land for the construction of domestic waste treatment facilities determined by special planning into the detailed planning of national land and space, and announce it to the public according to law.
The planned land for the construction of domestic waste treatment facilities shall not be changed without legal procedures. Thirteenth domestic waste treatment facilities should adhere to the principles of scientific and rational layout, energy saving and environmental protection, and easy management.
The site selection of domestic waste treatment facilities should avoid areas with important ecological position or fragile ecological environment, such as ecological protection red line area and drinking water source protection area.
Conditional places can explore the establishment of rural collective economic organizations to collectively operate construction land and invest in domestic waste treatment facilities, and participate in the distribution of operating income.
