Chapter II of the Regulations of Tianjin Municipality on Work Safety: Work Safety Guarantee of Production and Business Units
Thirteenth production and business units should have the conditions for safe production stipulated by laws, regulations, national standards or industry standards; Those who do not have the conditions for safe production shall not engage in production and business activities.

Fourteenth production and business units shall abide by the following provisions on safety in production:

(a) to formulate rules and regulations on production safety and operating procedures, and establish and improve the responsibility system for production safety;

(two) the production and business premises, equipment and facilities meet the requirements of safe production;

(three) the establishment of safety production management institutions or equipped with safety production management personnel;

(four) the main person in charge, the person in charge of production safety and the management personnel of production safety have the knowledge and management ability of production safety that are suitable for the production and business activities of the unit;

(five) employees have received safety education and training in their own units, and special operators have obtained special operation qualification certificates in accordance with relevant state regulations;

(six) measures to prevent and control occupational hazards, employees equipped with labor protection articles in line with national standards or industry standards.

Mines, construction units and production and business units of dangerous chemicals, fireworks and firecrackers, and civil blasting equipment shall obtain safety licenses.

Article 15 The principal responsible person of a production and business operation entity shall perform the duties of production safety stipulated by law, report the situation of production safety to the workers' congress, the workers' congress and the shareholders' congress at least once a year, and accept supervision.

Sixteenth units engaged in mining, road transport, construction, dangerous chemicals, fireworks and other production and business activities, in accordance with the following provisions, set up safety production management institutions, equipped with safety production management personnel:

(1) Where the number of employees exceeds 1000, a safety production management organization shall be set up, and full-time safety production management personnel shall be equipped according to the ratio of not less than five thousandths of employees, including at least three registered safety engineers or safety engineers;

(2) If the number of employees 100 is more than 1000, a safety production management organization shall be set up, with more than 2 full-time safety production management personnel, including at least 1 registered safety engineer or safety engineer;

(3) If the number of employees is less than 100, full-time safety production management personnel shall be provided.

Article 17 Other production and business operation entities other than those specified in Article 16 of these Regulations shall set up safety production management institutions and be equipped with safety production management personnel in accordance with the following provisions:

(1) Where there are more than 300 employees, a safety production management organization shall be established, with more than 2 full-time safety production management personnel, of whom at least 1 is a registered safety engineer or a safety engineer;

(two) employees 100 more than 300 people, should be equipped with full-time safety management personnel;

(3) If the number of employees is less than 100, it shall be equipped with full-time or part-time safety production management personnel.

Eighteenth production and business units can entrust the safety production service agencies or hire registered safety engineers to provide safety production services.

Nineteenth production and business units shall ensure the necessary capital investment for safe production conditions, and include the funds for safe production in the annual financial plan.

Twentieth this Municipality encourages mines, road transport, construction, dangerous chemicals, fireworks and other production and business units to participate in production safety liability insurance.

Where the production and business operation entities specified in the preceding paragraph are not insured with the liability insurance for production safety, they shall, in accordance with the provisions of the state, deposit them in a lump sum in risk of mortgage at the risk of mortgage agent bank designated by the municipal production safety supervision and management department and the municipal finance department for emergency rescue, disaster relief and after-treatment of production safety accidents of their own units.

Article 21 Employees shall enjoy the following rights in production and business activities:

(a) to ensure safety in production, prevent occupational hazards and industrial injury insurance and other benefits;

(two) to understand the dangers, occupational hazards and preventive and emergency measures in the workplace;

(three) to obtain and use labor protection articles that meet the national standards or industry standards;

(four) to participate in relevant safety knowledge and skills training;

(five) to carry out occupational health examination in accordance with the regulations;

(six) to put forward suggestions, criticisms and opinions on the work safety of the unit, and to report and accuse the illegal acts of production safety;

(seven) refused to illegal command and risky operations;

(8) Taking possible emergency measures to stop operation or evacuate the workplace in case of direct danger to personal safety;

(nine) to obtain compensation for damages caused by production safety accidents according to law;

(ten) other rights stipulated by laws and regulations.

Article 22 Employees shall perform the following obligations in their production and business activities:

(1) Abide by the safety production rules and regulations and operating procedures of the unit, obey management, and use labor protection articles correctly;

(two) to receive education and training in production safety, and to master the knowledge and skills of production safety required by their own work;

(three) timely discover and report the hidden dangers of accidents and unsafe factors;

(4) Other obligations stipulated by laws and regulations.

Article 23 The principal persons in charge, persons in charge of production safety and personnel in charge of production safety of mines, road transport, construction, dangerous chemicals, fireworks and firecrackers and other production and business units must receive special education and training on production safety on a regular basis, and only after passing the examination by the relevant competent departments can they take up their posts. The assessment shall not be charged.

The principal responsible persons, responsible persons in charge of production safety and management personnel of production safety of other production and business operation entities other than those specified in the preceding paragraph shall receive training organized by the supervision and administration department of production safety.

Twenty-fourth production and business units shall conduct safety training for employees in accordance with the following provisions, and establish and improve training files:

(1) Conduct pre-job training for newly hired employees;

(two) to provide special training for employees who change jobs or adopt new technologies, new materials and new equipment;

(three) to resume work training for employees who have stopped work for more than half a year;

(4) Conduct safety education for all employees at least once a year.

Employees who are not trained and qualified are not allowed to take up their posts.

Article 25 A production and business operation entity with occupational hazards shall take protective measures against occupational hazards such as productive poisons, dust, noise, vibration, high temperature and radiation in the workplace in accordance with state regulations, and an institution with corresponding qualifications shall conduct occupational hazard factor detection at least once a year, and evaluate the present situation of occupational hazards at least once every three years. If the inspection and evaluation do not meet the occupational health standards, control measures must be taken in time.

Twenty-sixth production and business units with occupational hazards should have a special person responsible for the daily monitoring of occupational hazards in the workplace to ensure that the monitoring system is in normal working condition. Monitoring results should be announced to employees.

Production and business units with occupational hazards shall, in accordance with the relevant provisions of the state, make an annual declaration of occupational hazards to the safety production supervision and management department, and accept the supervision and inspection of the safety production supervision and management department.

Twenty-seventh production and business units to build, rebuild and expand the safety facilities of the project (hereinafter referred to as the construction project), must be designed, constructed and put into production and use at the same time with the main project.

The production and business operation entity shall, in accordance with the relevant provisions, organize the acceptance of the safety facilities of the construction project, and can put them into use only after passing the acceptance, and submit the acceptance report to the safety production supervision and management department for the record.

For major construction projects or construction projects with large risk factors, the production and business operation entities shall, in accordance with the relevant safety regulations, conduct safety pre-evaluation at the design stage, conduct safety evaluation at the acceptance stage, and timely report the safety evaluation report to the safety production supervision and management department for the record.

Twenty-eighth production and business units shall take the following measures for major hazard sources:

(a) to establish and improve the hazard management system;

(two) dynamic monitoring of the whole process of operation, timely eliminate hidden dangers;

(3) Regular inspection and evaluation;

(four) to formulate a special emergency rescue plan and organize a drill at least once a year. The production and business operation entity shall report the monitoring of major hazard sources and the implementation of corresponding safety measures to the local safety production supervision and management departments and relevant departments.

Twenty-ninth units engaged in mining, road transport, construction, dangerous chemicals, fireworks, metal smelting, large-scale commercial and other production and business activities. Safety assessment shall be carried out on the safety production conditions of the unit on a regular basis in accordance with relevant regulations, and the safety assessment report shall be submitted to the department responsible for the supervision and administration of production safety for the record.

Article 30 The workplaces of production and business operation entities shall comply with the following provisions on safety in production:

(a) Keep it clean, raw materials, semi-finished products and finished products shall be packed firmly, and wastes shall be removed in time;

(2) The roads in the factory (yard) area are smooth, and obvious traffic and warning signs are set at bends, intersections and dangerous operation areas. The erection and identification of pipelines and trestles meet the national standards;

(3) Pits, mouths, ditches and ponds required for production must be covered or fenced, and guardrails and warning signs should be set for pits and ditches excavated for construction;

(four) under the overhead transmission line, it is forbidden to lift machinery or build buildings and structures;

(5) It is forbidden to use beams as lifting supports;

(6) When working in places with poor air circulation, which are prone to produce toxic and harmful gases and may cause suffocation and poisoning, safety protection measures shall be taken and corresponding safety protection devices shall be equipped;

(seven) for the manual dredging operation of the blocked parts of large equipment, safety technical measures such as falling prevention and burying prevention should be taken, and monitoring personnel should be set up.

Thirty-first mechanical and electrical equipment production and business units shall comply with the following provisions on safety in production:

(a) electrical equipment, power tools and electrical lines must be well insulated and equipped with leakage protection devices. The metal shell of electrical equipment and electric tools should be protected by zero connection or grounding, and the working zero line and the protective zero line should be laid separately;

(2) Sealed electrical equipment should be used in wet workplaces where dust, steam and corrosive gases are generated;

(3) Temporary power lines needed in production and business premises shall be laid by electrical professionals in accordance with relevant regulations and removed in time after use;

(four) all kinds of mechanical exposed transmission, rotation and compression parts, should have safety protection devices, and keep them in good condition;

(five) mechanical equipment maintenance, troubleshooting, cleaning and other operations, must be in accordance with the operating procedures and cut off the power supply, hanging warning signs.

Thirty-second flammable and explosive workplaces shall comply with the following provisions on safety in production:

(a) the equipment and facilities must comply with the relevant provisions and be kept in good condition;

(2) It is forbidden to wear and use clothes, shoes, hats and tools that are easy to generate static electricity and sparks;

(three) the use of explosion-proof electrical equipment and facilities;

(4) Equipment and facilities shall be equipped with safety monitoring systems such as over-limit alarm, explosion-proof and pressure relief, insurance control and anti-static, and ensure their normal operation;

(five) hot work should strictly implement the hot approval system.

Thirty-third metal smelting workplaces shall comply with the following provisions on safety in production:

(a) in the gas transportation, storage and other places prone to gas leakage, gathering, set up a monitoring and early warning system, establish and improve the maintenance system of gas facilities and equipment;

(2) Smelting equipment shall meet the safety standards of relevant countries and industries, and those that do not meet the standards shall not be used;

(3) No gathering place shall be set within the influence range of high-temperature liquid metal lifting.

Thirty-fourth it is forbidden to use prefabricated mobile homes that do not meet the national fire control standards as centralized accommodation places. Assembled mobile homes that meet the national fire protection standards should be used as centralized accommodation places, and safe voltage should be used, and no fire should be made for heating in winter.

Thirty-fifth in the production of dangerous chemicals that may lead to fire, explosion and poisoning, as well as phosgene, chlorine, hydrogen sulfide, ammonia and other toxic and harmful gases, identification operations should be carried out; Units that produce, store and use hazardous chemicals shall be equipped with corresponding chemical professionals and electricians.

Thirty-sixth production and business units to develop new dangerous chemicals, should organize experts with corresponding qualifications to carry out pilot and industrial production process safety appraisal.

Thirty-seventh new gas stations, filling stations around the safety protection distance, should comply with the relevant provisions of the state. If the original gas station and filling station cannot meet the requirements of safety protection distance, safety technical measures such as explosion prevention and oil and gas recovery shall be taken to meet the requirements of safety protection.

Thirty-eighth production and business units carry out dangerous operations such as blasting, hoisting, building demolition and earthwork excavation. , should formulate safety protection plan and site emergency plan, and arrange special personnel to be responsible for site safety management.

For construction projects such as deep foundation pit, underground excavation project, tall formwork project, gas jacking, etc., a construction safety plan shall be formulated, and the reliability of the safety guarantee measures of the construction plan shall be demonstrated by experts, and the safety management personnel shall implement on-site safety monitoring.

Article 39 Where a production and business operation entity rents out a factory building, premises, facilities and equipment to other units to engage in production and business operation activities, both parties to the lease shall sign an agreement on safety production management, and stipulate the responsibilities for safety production management.

Fortieth units engaged in external wall cleaning, advertising facilities maintenance, air conditioning equipment installation and other high-altitude suspension operations shall be equipped with safety production management personnel, responsible for the safety production management of their own units and the safety inspection and monitoring of the job site. Operators shall, in accordance with the categories of special operations stipulated by the state, receive special safety operation training and obtain corresponding special operation qualification certificates before taking up their posts.

High-altitude suspension equipment such as slings and hanging baskets used in the operation shall have product certificate, instruction manual and other relevant materials. Lifting machinery and hanging baskets must be equipped with safety ropes and safety locks that meet safety standards, and can only be used after inspection.

Forty-first it is forbidden for catering service operators and unit canteens to use more than 50 kilograms of pressurized canned fuel as cooking heat source; When two or more kinds of pressurized canned fuels with a weight less than 50 kg are used, they should be dispersed and safety protection measures should be taken.
