Regulations of Fuxin Municipality on the Protection of Hot Spring Water Resources
Article 1 In order to strengthen the protection of hot spring water resources and realize the rational development and sustainable utilization of hot spring water resources, these Regulations are formulated in accordance with People's Republic of China (PRC) Water Law, People's Republic of China (PRC) Mineral Resources Law, People's Republic of China (PRC) Water Pollution Prevention Law and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the protection, development, utilization and management of hot spring water resources within the administrative area of this Municipality. Article 3 The term "hot spring water resources" as mentioned in these Regulations refers to geothermal water resources which are formed by geological processes, stored in the earth's crust, naturally overflowed from underground or collected artificially, and have a temperature above 25℃ and contain beneficial elements to human body. Article 4 The protection of hot spring water resources shall follow the principles of unified planning, giving priority to protection and paid use, and implement total control and planned water use. Article 5 The municipal water administrative department shall be responsible for the protection and management of hot spring water resources in the whole city, and the county and district water administrative departments shall cooperate with the municipal water administrative department to do a good job in the protection and management of hot spring water resources within their respective jurisdictions.

Development and reform, land resources, environmental protection, finance, housing and urban construction, public security, tourism, health and family planning departments shall, in accordance with their respective responsibilities, do a good job in the protection and management of hot spring water resources according to law. Article 6 The municipal development and reform department shall, jointly with relevant departments, prepare a plan for the protection, development and utilization of hot spring water resources and report it to the Municipal People's Government for approval. Seventh development and utilization of hot spring water resources to implement the system of protected areas. Hot spring water source protection areas shall be designated by the municipal development and reform department in conjunction with relevant departments and reported to the Municipal People's government for approval.

Liang Dong Hot Spring City gives priority to the development and utilization of hot spring water resources. The development and utilization of hot spring water resources outside the area of Liang Dong Hot Spring City shall be approved by the Municipal People's Government. Eighth hot spring water source protection zones prohibit the following acts:

(a) the construction of chemical industry, electroplating, leather, pulping, smelting, printing and dyeing, dyes, coking and other enterprises with serious pollution;

(2) discharging sewage that does not meet the environmental protection standards;

(3) Setting up warehouses for toxic and hazardous substances or discharging or dumping toxic and hazardous wastes;

(four) other acts prohibited by laws and regulations. Article 9 The people's governments of counties and districts where the hot spring water source protection zones are located shall strengthen the construction of centralized sewage treatment facilities and supporting pipe networks. The competent administrative department of environmental protection shall strengthen the supervision and management of sewage treatment. Article 10 The water administrative department shall formulate an annual water intake plan for hot spring water resources, verify the total amount of exploitation and the maximum daily water intake of water users, and collect water resources fees according to the actual water intake. Eleventh development and utilization of hot spring water resources shall comply with the following provisions:

(a) in line with the protection, development and utilization planning of hot spring water resources;

(2) Handling relevant examination and approval procedures according to law;

(three) in accordance with the national technical standards to install water metering facilities, and ensure the normal operation of metering facilities;

(four) to formulate efficient and intensive water use schemes and adopt water-saving technologies, equipment or facilities such as low water consumption and recycling water;

(five) hot spring tail water should be treated and meet the relevant provisions of environmental protection before discharge;

(6) It meets other conditions stipulated by relevant laws and regulations. Twelfth hot spring water resources are mainly used for bathing, as well as in the deep development and utilization of hot spring drinks, medical care, beauty research, biological engineering and so on. It should be approved according to law.

It is forbidden to directly use it for heating and commercial housing development. Thirteenth of the abandoned, idle or unfinished hot spring water intake project, the responsible unit shall take closed measures in accordance with the provisions. If the responsible unit fails to seal and fill according to the regulations, it shall be sealed and filled by the water administrative department according to law, and the sealing and filling expenses shall be borne by the responsible unit. Fourteenth transfer hot spring water to others or change the use of hot spring water without authorization, the water administrative department shall order it to make corrections and impose a fine of more than twenty thousand yuan and less than eighty thousand yuan; If the circumstances are serious, the water permit shall be revoked. Fifteenth hot spring water resources development and utilization, involving mineral resources, water resources, ecological protection and other illegal acts, shall be punished by the relevant departments according to law. Sixteenth hot spring water resources protection and management of the relevant units and their staff in any of the following circumstances, by the unit or the competent department at a higher level shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

(a) illegal issuance of water permits;

(two) illegal collection and unauthorized relief of hot spring water resources fees;

(three) to change the indicators of water intake plan without authorization;

(4) Failing to perform the duties of supervision and management;

(five) there are other acts of abuse of power, favoritism, dereliction of duty. Article 17 These Regulations shall come into force on June 20 19 1 day.
