Legal analysis: It is the consistent policy of the CPC Central Committee and the State Council to prohibit the party and state organs and cadres from running enterprises through business. Retired cadres engage in business activities, which is easy to promote the separation of politics and business, make some people take advantage of their original working relationship and influence to participate in reselling activities, harm the interests of the state and the masses and breed corruption. It must be resolutely stopped. In order to maintain the integrity of the party and government organs, ensure the smooth progress of managing the economic environment, rectifying the economic order and comprehensively deepening the reform, and give full play to the exemplary role of veteran cadres, according to the instructions of the CPC Central Committee and the State Council, the relevant departments of the central government have made the following provisions on the issue of running enterprises by retired cadres at or above the county level:

(1) Retired cadres of the Party and state organs are not allowed to set up commercial enterprises, to hold positions in commercial enterprises, to receive remuneration in the purchase and sale of commodities, to participate in the reselling of means of production and commodities in short supply in any form, to ask relevant units for state materials and to engage in financial activities.

(two) retired cadres of the party and state organs shall not hold any leadership positions (including honorary positions) or other management positions in enterprises owned by the whole people and foreign-invested enterprises (companies), and enterprises shall not employ them. Those who have served must resign.

(3) Retired cadres of the Party and state organs may apply for posts in non-commercial enterprises that are not owned by the whole people, but they must go through retirement formalities for two years before they can take posts in the industries and enterprises in charge of the original organs. To work in these enterprises, you need to obtain the approval of the retired cadres management department of the institution where you work, and sign a contract with the employer.

(four) retired cadres of the party and state organs engaged in aquaculture, planting production, technology development, consulting, service, lectures, writing, translation and business service activities such as canteens, laundry rooms and barbershops. Improve the logistics service of the organs, continue to implement the relevant regulations in accordance with Zhong Fa [1984] No.27, get reasonable remuneration, and pay taxes in strict accordance with the regulations.

(5) The Party and state organs should strengthen the management of retired cadres. For retired cadres who violate the regulations, their original organs shall promptly correct them; If it is not corrected according to the regulations, the main person in charge of the organ shall be investigated for responsibility. Retired cadres management departments and industrial and commercial administration, taxation, supervision, discipline inspection and other departments should always check the implementation of these provisions. Party organizations in organs and enterprises should earnestly shoulder the responsibility of supervision.

(6) The above provisions also apply to retired cadres of trade unions, women's federations, youth leagues, literary and art federations and various associations, societies and other mass organizations at or above the county level.

Legal basis: According to Article 14 of the Regulations on Inner-Party Supervision of Producers in China, Committee member the Political Bureau of the Communist Party of China (CPC) Central Committee should strictly implement the eight central regulations, consciously participate in the life of dual organizations, and truthfully report personal important matters to the CPC Central Committee. Take the lead in establishing a good family style, strengthen the education and restraint of relatives and staff around them, and strictly require spouses, children and their spouses not to run businesses in violation of regulations, and not to hold positions or take part-time jobs in violation of regulations.
