Regulations of Shantou Special Economic Zone on the Administration of Cultural Market
Chapter I General Provisions Article 1 In order to strengthen the management of the cultural market in Shantou Special Economic Zone, promote the healthy development of cultural undertakings, enrich the public's cultural life and promote the construction of socialist spiritual civilization, these Regulations are formulated in accordance with the relevant laws and regulations of the state and in light of the actual conditions of the Special Zone. Article 2 All units and individuals engaged in cultural business activities in Shantou Special Economic Zone must abide by these regulations. Article 3 The cultural market as mentioned in these Regulations refers to:

(a) the cultural and entertainment market, including the business activities of cultural and entertainment projects such as commercial song and dance entertainment places, commercial computer network entertainment places, entertainment places, film distribution and screening, and audio-visual products screening;

(2) The market of cultural products, including the publication, printing, reproduction, sale and lease of audio-visual products, books, newspapers, periodicals and electronic publications, as well as the business of cultural relics and artworks permitted by law;

(3) The commercial performance market refers to all kinds of commercial performance activities undertaken by commercial performance units (including commercial cultural performance groups, performance venues and performance brokerage institutions) or individual actors;

(four) other cultural business activities as prescribed by laws and regulations. Article 4 Cultural business activities must adhere to the direction of serving the people and socialism, and encourage and advocate civilized, healthy and beneficial cultural and artistic products and cultural business. Chapter II Management of Cultural Market Article 5 People's governments at all levels shall exercise unified leadership and comprehensive coordination over the management of cultural market.

The administrative department of culture is the competent department in charge of cultural and entertainment market, commercial performance market, audio-visual products wholesale, retail, rental, screening, film distribution and screening, and cultural relics and artworks management.

The administrative department of press and publication is the competent department in charge of the publication, production and reproduction of audio-visual products and the publication, printing, production, import, reproduction and distribution of books, newspapers and electronic publications.

The copyright administrative department shall manage the copyright matters involved in the publication, printing, import and operation of cultural products, and investigate and deal with infringement and piracy according to law.

The relevant administrative departments of public security, industry and commerce, taxation, price, health and environmental protection shall manage the cultural market according to their respective functions and powers. Article 6 To apply for a long-term cultural business project with a fixed place, the following basic conditions must be met:

(1) Having the necessary funds and corresponding equipment;

(2) Having a site that meets the requirements of public security, fire control, sanitation, environmental protection and labor safety;

(3) Having employees with professional knowledge;

(4) The business content is healthy and beneficial;

(five) the source of cultural products is legal;

(6) Other conditions required by laws and regulations. Article 7 The administrative department of culture or the administrative department of press and publication shall, within 30 days from the date of receiving the application for starting cultural business projects, issue business licenses to those who meet the requirements; If it is not approved, it must explain the reasons and inform the applicant. Article 8 Where laws and regulations stipulate that cultural business premises shall apply for safety certificates, site certificates, fire protection certificates or special trade licenses, the public security department shall apply.

Whoever obtains a business license, safety certificate, site certificate, fire protection certificate or special trade license shall apply to the administrative department for industry and commerce for registration and obtain a business license. Article 9 The administrative department for culture or the administrative department for press and publication shall implement the annual examination system for business licenses. Article 10 An operator whose business license has been revoked in violation of the provisions of these Regulations shall not be approved by the relevant administrative department to engage in cultural business activities within one year from the date of revocation of his business license. Eleventh cultural business units merger, division, contracting, closure, closure, relocation, change of name, change of legal representative, change of business projects, change of internal venue structure, etc. The operator shall apply for registration or cancellation to the original examination and approval department and the administrative department for industry and commerce 30 days in advance. Twelfth one of the following acts, the business license shall be cancelled by the examination and approval department.

(a) the cultural business unit has not carried out business activities for one year from the date of obtaining the business license;

(two) cultural business units to stop business activities for a full year. Thirteenth occupation of parks, squares, streets, hotels, restaurants, stadiums (gymnasiums) and other places to hold temporary cultural and entertainment business activities, business performances, the organizers must report to the cultural administration department for approval fifteen days in advance. If it is necessary to review the fire, traffic and safety conditions of the site, the organizer shall report to the public security department for review fifteen days in advance. Fourteenth commercial performance groups and individual actors engaged in commercial performances in this special zone shall apply to the municipal administrative department of culture and obtain a commercial performance license after examination and approval. Fifteenth foreign performing groups or individual actors who come to this special zone to perform for business must hold a business performance license issued by the local cultural administrative department at or above the county level. And report to the municipal cultural administration department for approval.

Commercial group (group) performances shall be undertaken by performance brokerage institutions. Sixteenth units engaged in the export of cultural relics must be approved by the municipal administrative department of culture and submitted to the state administrative department of cultural relics for approval. For the export of cultural relics, the list of export cultural relics must be filled in in advance and appraised by the Guangdong Provincial Cultural Relics Exit Appraisal Department.
