(1) Tianjin Municipal Environmental Sanitation Administration is the competent authority for the management of muck disposal in this Municipality, and has a municipal muck management department, whose duties are: to implement the relevant provisions of the state and this Municipality, and to formulate specific policies and implementation measures for the management of muck disposal in this Municipality; Forecast the output of urban muck and make an annual disposal plan; Supervise, inspect and guide the discharge and disposal of muck in all districts and counties; Manage the fixed disposal site of muck; Coordinate the relationship between relevant departments and districts and counties to promote the implementation of muck disposal management; Unified printing and management of muck discharge permit.
(2) The district and county environmental sanitation bureaus (institutes) set up muck management departments to be specifically responsible for the management of muck disposal within their respective jurisdictions. Its duties are: to implement the relevant provisions of the state and municipal environmental sanitation administration, and organize the implementation of the management of muck disposal within its jurisdiction; Forecast the output of muck in the jurisdiction, and formulate the annual disposal plan; Units or individuals that produce muck shall issue muck discharge permits in accordance with the regulations, and collect muck discharge and disposal fees in accordance with the regulations (discharge permits shall not be charged separately); Manage the temporary disposal site of muck within the jurisdiction, and uniformly arrange the use of backfilled muck; Units or individuals who violate the regulations shall be corrected and punished in accordance with the relevant provisions of environmental sanitation. Article 4 All units and individuals that produce muck must, before the project starts, carry the construction permit and project plan approved by the planning department (individuals need to carry the private property ownership certificate), register with the muck management department in the jurisdiction, go through the formalities of muck discharge and disposal, and take the initiative to accept the professional management of the muck management department.
The muck management department shall issue licenses within three days from the date of registration. Fifth construction units and individuals shall, after obtaining the license issued by the muck management department, go through the formalities of muck consignment with the transport unit. When transporting muck, the transport unit must carry a discharge permit, transport and unload muck according to the transport route and disposal site designated by the muck management department, and affix a tarpaulin. No flying along the way. Article 6 Units or individuals that need to solve the problem of muck backfilling must register with the muck management department in their respective jurisdictions, and the muck management department is responsible for the unified arrangement. Seventh construction units and individuals shall pay a discharge and disposal fee of two yuan per ton when handling the procedures for the discharge and disposal of muck. In-situ backfill muck of various construction projects is exempt from discharge and disposal fees. Municipal public infrastructure construction projects such as roads, bridges, gardens, gas, water supply and drainage are exempt from sewage and disposal fees. The fees charged by the eighth district muck management department shall be turned over to the municipal muck management department for management according to the proportion of 15% of its income, and used for the construction and development of municipal urban sanitation infrastructure. Set aside part for the development of regional sanitation and management fees. Article 9 The management fee shall be issued with a special receipt for Tianjin construction waste and engineering muck discharge and disposal fee uniformly formulated by the Municipal Finance Bureau, and its income shall be deposited in the financial special account, and other bills shall be invalid.
The municipal, district, and county muck management departments shall go through the formalities for applying for charging licenses at the price departments according to regulations. Tenth in addition to the municipal muck management department to set up a fixed muck disposal site, each district can coordinate with relevant departments to set up one or two temporary muck disposal sites. Article 11 Fences shall be set up around the temporary disposal site of muck, and dust and pollution prevention measures shall be implemented. Article 12 No unit or individual may dump muck at will for any reason, set up a muck disposal site without authorization, or sell muck without authorization. Article 13 Units or individuals who violate these provisions shall be punished by the supervision and management personnel of city appearance and environmental sanitation in conjunction with the muck management department according to the relevant provisions of city appearance and environmental sanitation management. Article 14 The sanitation supervision and management personnel of the muck management department shall strictly implement these provisions. When performing official duties, they must show their certificates and enforce the law impartially. Obstructing law enforcement officers from performing official duties shall be dealt with by public security organs according to law. Fifteenth these Provisions shall be interpreted by the Tianjin Municipal Environmental Sanitation Administration. Article 16 These Provisions shall come into force as of June 1st, 1993.
