The financial funds mentioned in the preceding paragraph include budgetary funds and extra-budgetary funds. Article 3 The term "government procurement" as mentioned in these Measures refers to the behavior of the government to obtain goods, maintenance projects or services by means of purchase, lease, entrustment or employment in order to carry out daily government activities or provide services to the public. Article 4 Financial procurement shall adhere to the principles of openness, fairness, impartiality, merit and efficiency. The financial department of the people's government of the fifth autonomous region shall be responsible for the management and supervision of government procurement in the whole region.
The financial department of the people's government of the autonomous region entrusts its subordinate government procurement office to be responsible for the daily work of government procurement, and its main responsibilities are:
(a) the implementation of government procurement policies;
(two) to draw up the catalogue of government procurement;
(three) unified organization of large-scale project centralized procurement and government procurement of administrative institutions directly under the autonomous region;
(four) to examine and approve the qualifications of suppliers entering the government procurement market of administrative institutions directly under the autonomous region;
(five) to examine and approve the social intermediary institutions to obtain the agency qualification of the procurement business of the administrative institutions directly under the autonomous region;
(six) part or all of the social intermediary agencies entrusted to handle the procurement bidding of the government directly under the autonomous region;
(seven) entrusted by other procurement units, purchasing or organizing bidding matters;
(eight) to provide business guidance and personnel training for the city and county (District) government procurement work;
(nine) to accept questions or complaints about government procurement;
(ten) to handle other government procurement affairs assigned by the financial department. Article 6 Units that meet the following conditions may apply for the qualification of government procurement suppliers:
(1) Having the qualification of a legal person or the ability to bear civil liability independently;
(2) Abiding by national laws and regulations and having a good reputation;
(3) Having the ability to perform the contract and a good performance record;
(4) Good capital and financial status;
(five) other conditions stipulated by the state and the autonomous region. Article 7 Units that meet the following conditions may apply for the qualification of government procurement agency:
(a) established in accordance with the law, with legal personality;
(two) familiar with the laws, regulations and policies of the state on government procurement, and the proportion of personnel who have received business training from the financial sector has reached more than 20% of the institutional personnel;
(3) Having a certain number of professionals, among whom those with intermediate and senior professional and technical positions account for more than 60% and 20% of the total staff of this institution respectively;
(4) Good capital and financial status;
(five) have the ability to use modern scientific means to complete the work of government procurement agency;
(six) other conditions stipulated by the state and the autonomous region.
Units engaged in bidding for mechanical and electrical equipment and materials shall have the qualification grade of bidding for mechanical and electrical equipment approved by the state. Article 8 The scope of government procurement mainly includes:
(a) the unit price of equipment procurement is more than 654.38+10,000 yuan, or the price of a single unit is less than 654.38+10,000 yuan, but a batch purchase is more than 200,000 yuan;
(two) the maintenance project or equipment is more than 654.38 million yuan;
(three) other projects listed in the catalogue of government procurement. Article 9 Government procurement shall be conducted by means of open tender, invitation to tender, competitive negotiation, inquiry and single source. Article 10 Public bidding or invitation bidding shall be implemented for single or batch procurement that meets the quota standards stipulated in these Measures. Eleventh in accordance with the provisions of these measures, single or batch procurement, one of the following circumstances, with the approval of the financial department or the government procurement office under the financial department, you can use competitive negotiation to purchase:
(a) after the tender, there is no supplier to bid or there is no qualified target;
(two) there are unforeseen emergency procurement needs, which can not be obtained through bidding;
(3) It takes a long time to prepare the tender documents;
(four) other circumstances identified by the financial department. Article 12 If the spot of single or batch purchases that meet the quota standards stipulated in these Measures is standard specifications and the price elasticity is not great, they can be purchased by inquiry with the approval of the financial department or the government procurement office of the financial department. Thirteenth in any of the following circumstances, with the approval of the financial department or the government procurement office under the financial department, single-source procurement can be implemented:
(a) can only be purchased from a specific supplier, or the supplier has exclusive rights, and there is no other suitable alternative target;
(two) the follow-up maintenance, spare parts supply, replacement or expansion of the original purchase must be purchased from the original supplier;
(three) within the scope of the original tender, the supplementary contract price does not exceed 50% of the original contract price, and the original supplier must sign a contract;
(4) Declaring in advance that it is necessary to carry out subsequent expansion of the original procurement;
(5) There are sufficient reasons to believe that only purchasing from specific suppliers can promote the realization of relevant government objectives;
(six) from the disabled, charity and other institutions;
(seven) other circumstances identified by the financial department.
