article 2 all hotels, restaurants, guesthouses, guest houses (including guest houses run by government agencies, organizations, military units, schools, enterprises and institutions), hotels, inns, bathrooms, resorts, etc. (hereinafter referred to as hotels) operating in the territory of our province shall be managed in accordance with the measures for the administration of public security in the hotel industry and these implementing rules.
Article 3 To run a hotel, the following safety conditions must be met:
(1) Building construction, fire-fighting equipment, passages, entrances and exits and sanitary conditions must comply with relevant regulations; The use of civil air defense projects to run hotels must have good ventilation and lighting equipment and more than two entrances and exits.
(2) having necessary anti-theft safety facilities.
(3) having a separate passenger room.
(4) conditions that meet the requirements of the public security management information system of the hotel industry.
article 4 to start a hotel, one should apply to the local public security department of the city or county (city, district) and obtain a special trade license, and then apply to the administrative department for industry and commerce for registration and obtain a business license before starting business. Where laws and regulations provide otherwise, such provisions shall prevail.
article 5 hotels shall establish public security organizations or be equipped with full-time or part-time public security personnel. Public security organizations and personnel shall regularly carry out safety education and legal education for their employees, check the implementation of various public security management systems, and assist public security departments in investigating and handling public security and criminal cases.
Article 6 Hotels must establish the following public security management systems:
(1) Accommodation registration system. Passengers must register for accommodation. The hotel shall designate a special person to be responsible for the registration. At the time of registration, the passenger's identity documents shall be checked, and the passenger shall fill in the Accommodation Registration Form according to the specified items.
Foreigners, overseas Chinese and compatriots from Hong Kong, Macao and Taiwan should check their passports or relevant certificates and fill in the Registration Form for Temporary Accommodation of Overseas Personnel. If there is no valid certificate or visa, it must be reported to the public security department or the relevant department in time.
the passenger accommodation registration form shall be bound into a book on a daily and monthly basis for future reference. The hotel shall enter the registration information of the accommodation passengers into the hotel industry public security management information system in real time.
(2) Implement a 24-hour duty system. The doorman on duty at the hotel should know the situation of people entering and leaving, and if necessary, he can ask the visitors to show their identity documents or ask their interviewees' names and room numbers. Other hotel staff on duty shall perform inspection duties in accordance with the provisions of the duty system, and safeguard the legitimate rights and interests of accommodation personnel and the normal order of the hotel. If the room key is managed by the room attendant, the door should be opened with the check number of the accommodation certificate.
(3) Property custody system. The hotel shall set up a storage room for passengers' luggage and articles, designate a special person to be responsible for the storage, implement the system of registration, handover and collection of property storage, and pay attention to the inquiry and discovery of suspicious and dangerous articles. Cash should be kept in a safe (box) separately.
(4) reporting system. If criminal suspects, suspicious persons, prohibited items and criminal and public security cases are found, they shall immediately report to the local public security department and take measures to protect the scene. Do not withhold information or connive, conceal or cover up.
Article 7 Accommodation passengers must abide by the following provisions:
(1) Abide by the rules and regulations of the hotel, obey the management of the hotel staff and take good care of the hotel property.
(2) The guns and ammunition carried by soldiers, people's policemen and full-time guards and escorts must be handed over to the military department or public security department where the hotel is located for safekeeping according to regulations.
(3) It is forbidden to bring inflammable, explosive, toxic, corrosive and radioactive dangerous goods and controlled knives such as daggers, triangular scrapers and spring knives into the hotel.
(4) illegal and criminal activities such as prostitution, whoring, drug abuse, gambling, spreading obscene articles and fighting are strictly prohibited in hotels.
(5) consciously assist the people's police in performing their official duties according to law and truthfully report the situation.
Article 8 The public security department shall perform the following duties in the public security management of the hotel industry:
(1) Review the safety conditions for opening hotels, issue the License for Special Trade, and establish the public security management files of the hotel industry.
(2) to guide and supervise the establishment and implementation of various public security management systems and safety precautions in hotels.
(3) assist hotels to train employees in safety business knowledge.
(4) summarize and promote the experience of public security work in the hotel industry and commend the advanced figures in public security work.
(5) investigating and handling public security and criminal cases.
article 9 when performing official duties, the people's police should show their valid law enforcement certificates, act in strict accordance with the law, and safeguard the normal business order of hotels and the legitimate rights and interests of hotel residents. When inspecting the rooms where passengers stay, they shall present the inspection certificate issued by the public security department of the people's government at or above the county level.
when the public security department summons or arrests a criminal suspect hiding in a hotel according to law, it shall inform the person in charge of the hotel or the hotel security personnel, except in special circumstances; The person in charge of the hotel or the hotel security personnel shall cooperate.
Article 11 The following units or individuals shall be commended and rewarded:
(1) Those who play a positive role in implementing the Measures for the Administration of Public Security in Hotel Industry and these Detailed Rules, implementing various public security measures, maintaining public order in hotels, and ensuring the safety of hotels and passengers shall be commended and rewarded by the higher authorities or their own units.
(2) The public security department shall commend and reward those who have provided clues to illegal crimes, assisted the public security department in investigating and handling cases, arrested suspects of illegal crimes or maintained public order in hotels.
Article 11 The public security department shall punish the acts that violate these Detailed Rules respectively according to the following provisions:
(1) Those who violate the provisions of Article 4 of these Detailed Rules and run hotels without obtaining the Special Trade License shall be fined and detained according to law, and ordered to go through the formalities or be banned.
(2) Those who violate the provisions of Item (1) and Item (4) of Article 6 and Item (3) and Item (4) of Article 7 of these Rules shall be fined and detained according to law. Among them, if the hotel fails to enter the registration information of the accommodation passengers into the hotel industry public security management information system according to the regulations, it shall be ordered to make corrections within a time limit; Overdue correction, punishable by a fine of more than 1111 yuan in 211 yuan.
(3) those who violate the provisions of Article 5, Item (2) and Item (3) of Article 6 and Item (1), (2) and (5) of Article 7 of these Rules shall be ordered to make corrections and be punished in accordance with the laws and regulations on public security administration.
(4) If the person in charge of the hotel is involved in illegal and criminal activities and other reasons, the hotel may be revoked its Special Trade License, and it is suggested that the administrative department for industry and commerce revoke its business license according to law.
Article 12 Theft cases reported by passengers shall be handled by the public security department. If the hotel safety measures are not implemented, the hotel shall compensate for the economic losses; The hotel is not responsible for the passengers' failure to abide by the hotel's public security management system.
article 13 these detailed rules shall come into force as of February 1, 2116. On August 31th, 1988, approved by Zhejiang Provincial People's Government and promulgated by Zhejiang Provincial Public Security Department, the Detailed Rules for the Implementation of the Measures for the Administration of Public Security in Zhejiang Hotel Industry shall be abolished at the same time.
