Chapter I General Provisions Article 1 In order to standardize the comprehensive agricultural development, strengthen the construction of agricultural infrastructure, ensure food security and effective supply of agricultural products, and increase farmers' income, these Regulations are formulated in accordance with the Agricultural Law of People's Republic of China (PRC) and other relevant laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to units and individuals engaged in comprehensive agricultural development activities within the administrative region of this province. Article 3 The term "comprehensive agricultural development" as mentioned in these Regulations refers to the activities of the government to comprehensively develop and utilize agricultural resources by using special financial funds and other relevant funds in order to support agricultural development, improve basic agricultural production conditions and improve comprehensive agricultural production capacity and comprehensive benefits. Article 4 Comprehensive agricultural development shall follow the principle of integrating economic benefits, social benefits and ecological benefits, persist in transforming low-and medium-yield fields, build high-standard farmland, and implement comprehensive management of Jingtian Road; Persist in promoting the industrialized operation of agriculture, promote the progress of agricultural science and technology, protect and improve the agricultural ecological environment, and steadily improve the grain production capacity and comprehensive agricultural benefits. Article 5 The comprehensive agricultural development adopts the management system of comprehensive agricultural development counties (hereinafter referred to as development counties). Development counties refer to counties (cities, districts) with comprehensive agricultural development conditions and approved by national or provincial agricultural comprehensive development institutions to implement comprehensive agricultural development. Article 6 The people's governments at or above the county level shall strengthen their leadership over agricultural development, incorporate comprehensive agricultural development into the national economic and social development plan of their respective administrative areas, and link it with the agricultural and rural economic development plans, and organize relevant departments to formulate medium-and long-term plans and annual implementation plans for comprehensive agricultural development. Article 7 The financial department of the people's government at or above the county level is the administrative department in charge of comprehensive agricultural development, and the comprehensive agricultural development institutions under its centralized management are responsible for the comprehensive agricultural development within their respective administrative areas. Eighth provincial agricultural comprehensive development institutions are responsible for: (1) to implement the laws, regulations and policies of the state on comprehensive agricultural development; (two) the formulation of the province's comprehensive agricultural development policies and projects, funds and financial management rules and regulations; (three) the preparation of the overall planning and annual plan for comprehensive agricultural development, and the examination and approval of the implementation plans of comprehensive agricultural development projects in various regions and departments; (four) unified management and overall arrangement of national and provincial agricultural comprehensive development funds; (five) in accordance with the overall planning to establish a comprehensive agricultural development project library; (six) to formulate and publish the annual declaration guide for agricultural comprehensive development projects in this province; (seven) supervision and inspection of the use of funds for comprehensive agricultural development; (eight) other specific work related to comprehensive agricultural development. Article 9 The addition, suspension, resumption, cancellation and cancellation of development counties shall be handled in accordance with relevant state regulations. Article 10 Departments and units of the people's governments at or above the county level that implement comprehensive agricultural development projects, such as agriculture, forestry, water conservancy, land resources, supply and marketing cooperatives, and land reclamation, shall do a good job in comprehensive agricultural development in accordance with the project management regulations of the national competent department for comprehensive agricultural development. The township (town) people's government of the development county shall cooperate with the comprehensive agricultural development institutions to do a good job in the comprehensive agricultural development projects. Eleventh development county people's government shall, in accordance with the principle of planning guidance and financial concentration, make overall arrangements for comprehensive agricultural development projects, implement scale development, and improve the comprehensive benefits of the use of funds. Twelfth provinces, cities (prefectures) and development counties (cities, districts) people's governments shall commend and reward the units and individuals that have made outstanding contributions in comprehensive agricultural development. Chapter II Project Management Article 13 Comprehensive agricultural development projects include land management projects, industrialized management projects, agricultural science and technology popularization demonstration projects and other comprehensive agricultural development projects stipulated by the state. Land management projects include: low-and medium-yield farmland transformation projects, high-standard farmland demonstration projects, superior agricultural product base construction, improved seed breeding, land reclamation and other projects, small watershed management, ecological forest construction, grassland improvement, land desertification control and other ecological comprehensive management projects, and water-saving supporting transformation projects in medium-sized irrigation areas. Industrialization management projects include: construction projects of planting bases such as fruits, vegetables, seed production, economic forests and Chinese herbal medicines, construction projects of breeding bases such as livestock and poultry, aquatic products, processing projects of agricultural products, construction projects of circulation facilities such as storage and preservation, and construction projects of wholesale markets in producing areas. Demonstration projects of agricultural science and technology popularization include: excellent agricultural varieties, popularization and application of advanced and applicable technologies, transformation of scientific and technological achievements and other projects. Fourteenth units applying for comprehensive agricultural development projects shall, in accordance with the project application guidelines, submit the project application, project proposal or project feasibility study report prepared by qualified units to the development county agricultural comprehensive development institutions; After accepting the application, the agricultural comprehensive development institution of the development county shall conduct on-the-spot investigation, put forward the preliminary examination opinions, and report it in time according to the prescribed procedures. The provincial agricultural comprehensive development institution shall organize experts to review the project, and examine and approve it according to the prescribed procedures and authority or report it to the national agricultural comprehensive development institution for examination and approval. Fifteenth comprehensive agricultural development projects to implement the project legal person system, bidding system, project supervision system, capital and project publicity system. Article 16 The application for land control projects shall meet the following conditions: (1) It has been included in the comprehensive agricultural development plan of the development county; (two) the area where the proposed project is located has water resources that can be developed and utilized and backbone irrigation and drainage projects that can be relied on; (3) The land to be developed and managed conforms to the overall planning of local land use, and it is concentrated and contiguous, and meets the area standards stipulated by the state or the province; (four) the area to be developed and treated is a non-geological disaster area. The transformation projects of low-and medium-yield fields and comprehensive ecological management projects mainly based on terrace construction can meet the conditions in Items (1) and (3) of this article. Article 17 To apply for an industrialized operation project, the following conditions shall be met: (1) Conforming to the national industrial policy and industry development plan, and reflecting the advantages of local resources and regional characteristics; (2) The reporting entity has the qualification of an independent legal person; (3) The operating period of the reporting entity is more than 2 years, and the economic indicators and financial indicators meet the relevant requirements; (four) the reporting unit and the local farmers to establish a linkage mechanism of production, processing and sales. Article 18 To apply for a demonstration project of agricultural science and technology popularization, the following conditions shall be met: (1) Conforming to the national agricultural industrial policy and the management requirements of projects related to comprehensive agricultural development; (2) It has independent legal person qualification, scientific research promotion ability and technical support units; (three) the promotion of scientific and technological achievements should have regional adaptability, technological advancement and promotion benefits, and pass the appraisal of achievements at or above the provincial level. Nineteenth declaration of land management, industrial management, agricultural science and technology demonstration projects, should fully solicit the opinions of farmers, to protect farmers' right to land contractual management. Twentieth development county agricultural comprehensive development institutions shall, according to the investment control index, prepare the annual project implementation plan for the approved projects, and organize the implementation after the approval of the national or provincial agricultural comprehensive development institutions. Agricultural comprehensive development projects shall be organized and implemented in strict accordance with the approved planning and preliminary design, and shall not be changed without authorization; If it is really necessary to change, it shall be submitted for approval in accordance with the prescribed procedures. Twenty-first agricultural comprehensive development institutions in development counties shall employ farmers' supervisors to supervise the use of funds, construction content and project quality of land management projects for agricultural comprehensive development. Twenty-second provincial agricultural comprehensive development institutions are responsible for organizing the comprehensive spot check and acceptance of the annual completed projects of agricultural comprehensive development in the province. City (state) agricultural comprehensive development institutions shall be responsible for organizing the comprehensive acceptance of the annual completed projects of agricultural comprehensive development within their respective administrative areas. Development county agricultural comprehensive development institutions shall be responsible for organizing the acceptance of completed projects of single agricultural comprehensive development within their respective administrative areas. The main contents of the acceptance include: the implementation of national and provincial agricultural comprehensive development policies, the availability of funds and villagers' financing and labor, the use and reimbursement of funds, the completion of project construction tasks and main economic and technical indicators, the quality of project construction, expected economic, social and ecological benefits, project operation management and data archiving management, etc. Twenty-third comprehensive agricultural development projects to implement the whole process of audit supervision. Development county agricultural comprehensive development institutions shall promptly notify the audit department at the same level of the approved agricultural comprehensive development projects, and the audit department at the same level shall organize the audit. Article 24 Agricultural comprehensive development institutions in development counties shall clarify the property rights of land management projects that have passed the completion and acceptance, determine the subject of management and protection according to the scope of benefits and beneficiaries, clarify the responsibility of management and protection, and handle the transfer procedures. The subject of management and protection can be determined by means of bidding, leasing and contracting, and a contract can be signed according to law. Article 25 After the infrastructure such as small reservoirs, irrigation and drainage canals (pipes), bridges and culverts, dams, irrigation and drainage stations, electromechanical wells and tractor roads constructed by land control projects are qualified, the subject of management and protection shall be determined according to the following conditions: (1) The projects in the village are villagers' committees or village collective economic organizations; (2) Cross-village projects are related management institutions of villages and towns; (three) cross township projects determined by the development county people's government. Where there are other provisions of the state and province on the management and protection of rural water conservancy projects, those provisions shall prevail. Twenty-sixth land management project management subject should establish and improve the management system to ensure the long-term benefits of the project. The subject of management and protection determined by auction, lease, contract, etc. It is necessary to conscientiously perform the contract, provide services for farmers in the project area, and obey the unified dispatch of the government for flood control and drought relief, and accept the supervision of township organizations at all levels in the project area and agricultural comprehensive development institutions in the development counties. Article 27 Agricultural comprehensive development institutions in development counties shall, jointly with the people's governments of townships (towns) where the projects are located and the departments in charge of industries, formulate and improve the standards and specific systems for the management and protection of land management projects, and strengthen the guidance and supervision of the management and protection of land management projects. Twenty-eighth land management project management and protection funds should be raised in accordance with the principle of "who benefits, who bears", "to support the project" and financial subsidies. Management and protection funds are insufficient, can apply for the development of county agricultural comprehensive development institutions from the extraction of project management and protection funds and provincial, municipal (state) financial arrangements for special project management and protection fees to give subsidies. Chapter III Fund Management Article 29 Financial funds for comprehensive agricultural development shall be used within the prescribed scope, managed by special personnel, accounted for separately, and used for special purposes, and managed in accordance with the financial accounting system for comprehensive agricultural development. Article 30 Funds for comprehensive agricultural development include: (1) special funds for comprehensive agricultural development arranged by the central finance; (two) the special funds for comprehensive agricultural development arranged by the local financial budget; (3) Agricultural production and operation organizations and individuals raise funds by themselves, invest in labor or convert capital into commodities; (four) financial and social funds attracted by financial subsidies, interest subsidies and other forms; (five) the use of loans, donations and loans from foreign governments or international organizations; (6) Other funds. Thirty-first people's governments at or above the county level shall include special funds for comprehensive agricultural development projects in the fiscal budget at the corresponding level. After the comprehensive agricultural development project is approved, the project funds shall be fully and timely allocated according to the project plan and construction progress. Thirty-second agricultural comprehensive development financial funds to implement free investment. No unit or individual may occupy, misappropriate or defraud the financial funds for comprehensive agricultural development, and may not convert the financial funds for comprehensive agricultural development into paid use. Thirty-third the use of financial funds for comprehensive agricultural development shall implement the county-level reimbursement system. The project implementation unit shall handle the reimbursement in time according to the prescribed procedures. The disbursement of reimbursement funds adopts transfer settlement, and cash expenditure is strictly controlled. Thirty-fourth domestic and foreign loans for comprehensive agricultural development should be repaid by the project legal person. Thirty-fifth local agricultural comprehensive development institutions at all levels shall, in accordance with the evaluation standards and methods stipulated by the state, organize the performance evaluation of agricultural comprehensive development projects, and take the evaluation results as an important basis for the allocation of financial funds for agricultural comprehensive development. Chapter IV Supervision and Inspection Article 36 The financial department and the agricultural comprehensive development institution shall establish and improve the supervision and inspection system of agricultural comprehensive development, and strengthen the supervision and inspection of the construction, capital use and operation management guarantee of agricultural comprehensive development projects. Thirty-seventh agricultural comprehensive development institutions at all levels shall promptly announce the comprehensive agricultural development projects and funding arrangements to the public, announce the project establishment, fund raising and use, main contents and completion of project construction to the people in the project area, and accept social supervision. Article 38 The auditing and supervision departments of the people's governments at or above the county level shall, according to their respective functions and duties, supervise the management of agricultural comprehensive development projects and the use of funds according to law, and investigate and deal with illegal acts according to law. Thirty-ninth any unit or individual has the right to report illegal acts in the work of comprehensive agricultural development. The relevant government departments shall, in accordance with their respective duties, find out the facts of the reported matters, handle them according to law, and keep confidential the informants. Chapter V Legal Liability Article 40 In case of any of the following acts in violation of the provisions of these Regulations, the provincial agricultural comprehensive development institution shall order it to make corrections within a time limit; Overdue reform, in accordance with the relevant provisions of the state deduction of the next year's agricultural comprehensive development financial special fund investment index; If the circumstances are serious, the principal responsible person and other directly responsible personnel shall be given administrative sanctions according to law: (1) failing to implement the construction standards and extending the construction period; (2) changing the annual project implementation plan without authorization; (3) Holding up financial funds; (four) misappropriation of financial funds; (five) the use of financial funds for free into paid use; (six) to expand the scope of fiscal expenditure, improve expenditure standards; (seven) false project price, completed investment, or accounting for false economic and business matters and information; (eight) cash payment of financial reimbursement funds, the use of substandard invoices or IOUs accounted for. Article 41 If an agricultural comprehensive development institution in a development county commits one of the following acts, it shall be disqualified as a development county in accordance with the provisions: (1) The county-level reimbursement system is not applied to the use of financial funds for agricultural comprehensive development; (two) the financial funds for comprehensive agricultural development are not managed by special personnel, and are accounted for separately and earmarked according to the financial accounting system for comprehensive agricultural development. Forty-second development counties will be paid for the use or misappropriation of special funds for agricultural comprehensive development, according to the provisions of the deduction of the development county next year's special funds for agricultural comprehensive development investment indicators; If the circumstances are serious, suspend or cancel the qualification of the development county; If a crime is constituted, criminal responsibility shall be investigated according to law. Article 43 If the project applicant defrauds the special financial funds for comprehensive agricultural development, the financial administrative department shall recover the defrauded financial funds, confiscate the illegal income and impose a fine of 10% to 50%; If a crime is constituted, criminal responsibility shall be investigated according to law. Article 44 If the staff of agricultural comprehensive development institutions and relevant departments abuse their powers, neglect their duties or engage in malpractices for selfish ends in the work of agricultural comprehensive development, they shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law. Forty-fifth in violation of the provisions of this Ordinance, laws and regulations have provisions on punishment and handling, in accordance with its provisions. Chapter VI Supplementary Provisions Article 46 The implementation of comprehensive agricultural development projects by provincial state-owned farms approved by provincial comprehensive agricultural development institutions shall be carried out in accordance with the provisions of these Regulations. Article 47 These Regulations shall come into force as of 20 13 12 1.
