Article 5 The administrative department of tourism of the provincial people's government is responsible for the management of tourism in the province. The administrative department of tourism of the prefecture, state, city and county shall be responsible for the management of the tourism industry in the administrative area.
The administrative departments of tourism above the county level shall exercise the corresponding administrative enforcement powers in accordance with the relevant provisions of these Regulations.
Related administrative departments, in accordance with their respective responsibilities, with the administrative department of tourism to manage the tourism industry. Chapter II Protection of Tourism Resources and Construction of Tourism Facilities Article 7 The development and utilization of tourism resources must adhere to the principle of strict protection, unified planning, rational development and scientific management.

Article 8 The development and utilization of tourism resources and the construction of tourism facilities project, must implement the construction project environmental impact assessment system and environmental protection. Article 9 The administrative departments of tourism above the county level are responsible for organizing the investigation and evaluation of tourism resources under their jurisdiction, formulating plans for the development and utilization of tourism resources, and submitting them for approval in accordance with the relevant provisions.

Chapter III Tourism Operators Article 12 An applicant for engaging in tourism business activities shall apply for relevant licenses in accordance with the regulations, and shall have the following conditions:
(1) having its own name and organization;
(2) having a clear scope of operation of the tourism business;
(3) having the place, facilities and capital for operating the tourism business;
(4) having managers or technicians qualified by the administrative department of tourism;
(5) having the right to operate the tourism business;
(6) having the right to apply for a license or a certificate of registration of the tourism business; and administrative department of the assessment of qualified managers or technicians;
(e) other conditions stipulated by laws and regulations. Article 13 Tour operators must abide by the principles of honesty and credit, fair competition, operation in accordance with the law and standardized service. Article XIV tour operators shall improve the internal management system, maintain normal business order. Tour operators shall not transfer or disguise the transfer of tourism designated business qualification certificate or travel agency business license, shall not operate without a license or over the scope of business. Article XV of tourism operators selling tourism commodities and services should be truly marked quality of goods, prices and public services, to achieve quality and price, shall not entice, pester and coerce tourists to buy tourism commodities, accept services.
Tour operators shall not be unauthorized in the tourist attractions and their entrances, set up stalls, obstructing traffic, disturbing the tourist order. Article XVI tour operators shall be equipped with tourism safety facilities, equipment, the establishment of safety management responsibility system, strengthen the safety of tourists to prevent, when the discovery of the danger or the tourists' personal and property damage, should take timely protective measures to protect the tourists personal and property safety. Article 17 The tour operators shall protect the environment and resources, maintain the ecological balance, and strictly prevent and control pollution in accordance with the provisions of relevant laws and regulations. Article 18 The business autonomy of the tour operators are protected by law, any unit or individual shall not infringe.
Tour operators have the right to refuse the relevant departments to force the sale of their designated goods or forced placement of personnel; the right to refuse to violate the relevant provisions of the state and province of the charges and amortization. Article 19 travel agencies and tourists shall sign a written contract in accordance with the law, and strictly fulfill the contract.
Travel agencies shall apply for personal insurance for entry and exit travelers, voluntary insurance for domestic travelers for personal and property accident insurance.
