chapter I general provisions article 1 in order to strengthen the management of domestic waste, improve the living environment, promote the construction of national ecological civilization experimental zone, and ensure the sustainable development of economy and society, these regulations are formulated in accordance with relevant laws and regulations and combined with the actual situation of this province. Article 2 These Regulations shall apply to activities such as source reduction, classified management, resource utilization, harmless disposal and supervision and management of domestic garbage within the administrative area of this province. Article 3 The term "domestic waste" as mentioned in these Regulations refers to the solid waste generated in daily life or activities providing services for daily life and the solid waste regarded as domestic waste according to laws and regulations. Article 4 In order to realize the reduction, recycling and harmlessness of domestic waste, this province has established and improved the whole classification system of domestic waste classification, collection, transportation and disposal, and actively promoted the source reduction and resource recycling of domestic waste.
the management of domestic waste should follow the principles of government-led, national participation, market operation, urban and rural planning, territorial responsibility and gradual progress. Article 5 Domestic wastes shall be classified according to the following standards:
(1) Recyclable substances, mainly including waste paper, waste plastics, waste metal, waste glass products, waste fabrics and other domestic wastes suitable for recycling;
(2) harmful waste mainly includes waste batteries, waste lamps, waste medicines, waste pesticides, waste thermometers, waste paints and their containers, and other domestic wastes that directly or potentially harm human health or the natural environment;
(3) kitchen waste, mainly including household kitchen waste, kitchen waste and other kitchen waste and other perishable domestic wastes containing organic matter;
(4) Other wastes refer to other domestic wastes other than recyclables, harmful waste and kitchen waste.
if the national domestic waste classification standard is adjusted, its provisions shall prevail. Article 6 The people's governments at or above the county level shall strengthen their leadership over the management of domestic waste, establish a comprehensive coordination mechanism for the management of domestic waste, and improve the classification and treatment system of domestic waste. The funds required for the management of domestic waste shall be included in the fiscal budget at the corresponding level.
township people's governments and sub-district offices are responsible for the classified delivery, collection, transshipment, inspection and supervision of domestic garbage within their respective jurisdictions. Seventh provincial people's government environmental health department is responsible for the organization, coordination, guidance and supervision of the province's domestic waste management.
the environmental sanitation administrative departments of the people's governments of cities, counties and autonomous counties are specifically responsible for the supervision and management of domestic garbage within their respective administrative areas.
the competent department of development and reform of the people's government at or above the county level is responsible for drawing up the comprehensive utilization of domestic waste and the planning of facilities for harmless garbage treatment, formulating the implementation plan of the extended producer responsibility system, and establishing the charging mechanism for domestic waste treatment.
the competent commercial department of the people's government at or above the county level is responsible for establishing a recycling system coordinated with the utilization of domestic garbage recyclables, and rationally arranging recycling outlets for renewable resources.
the competent department of ecological environment of the people's government at or above the county level is responsible for the monitoring of pollutant discharge in places such as centralized domestic waste transfer facilities and terminal treatment facilities, as well as the supervision and management of pollution prevention during storage, transportation and disposal in harmful waste.
the people's governments at or above the county level, such as natural resources and planning, finance, market supervision and management, postal management, tourism culture, office affairs management and other relevant departments, shall, in accordance with the division of responsibilities, cooperate in the management of domestic waste. Eighth units and individuals should actively participate in the green living action, reduce the generation of domestic waste, fulfill the obligation of domestic waste classification, and bear the responsibility of domestic waste producers.
units and individuals shall pay the domestic garbage disposal fee according to the principle of "whoever produces pays" and the charging standard determined by the people's governments of cities, counties and autonomous counties. Where conditions permit, a domestic waste charging system with metering and classified pricing can be gradually established. The specific measures shall be formulated separately by the people's governments of cities, counties and autonomous counties. Ninth respect sanitation garbage disposal workers and their labor achievements, improve their working conditions, ensure the safety of operation, gradually improve labor remuneration and welfare benefits, do a good job in health care and technical training, and safeguard legitimate rights and interests. Chapter II Planning and Construction Article 11 When people's governments at or above the county level draw up plans for national economic and social development and master plans for land and space, they should take the reduction of domestic garbage at the source, the whole process of classification, resource utilization and harmless disposal as important contents.
the competent department of environmental health of the provincial people's government shall, according to the population, region, and total domestic waste control objectives, organize the preparation of a special plan for domestic waste treatment, and organize its implementation after being approved by the provincial people's government. Eleventh people's governments at or above the county level and their relevant departments shall incorporate the funds and land required for the annual construction plan of domestic waste treatment facilities into the annual investment plan and the annual land supply plan respectively.
the environmental sanitation administrative department of the people's governments of cities, counties and autonomous counties shall, according to the special plan for domestic waste treatment in their respective administrative areas, formulate the annual construction plan for domestic waste treatment facilities and organize their implementation.
the planned land for the construction of domestic waste treatment facilities shall not be changed without legal procedures. Article 12 The people's governments at or above the county level shall, according to the economic and social development of their respective administrative areas and the generation and treatment of domestic garbage, and in accordance with the requirements of urban-rural synchronization and regional overall planning, build * * * various domestic garbage treatment facilities across regions.
