article 2 "public buildings" as mentioned in these detailed rules refers to buildings for people to engage in public activities (such as office buildings, shopping malls, government agencies, medical institutions, schools, airports, railway stations, buildings and structures engaged in industrial production sites, etc.).

The term "residence" as mentioned in these Detailed Rules refers to the buildings for families to live in (such as villas, apartments, dormitories for employees' families, etc.).

article 3 provincial, municipal and county (county-level cities, districts) construction administrative departments are responsible for the supervision and management of decoration industry within their respective administrative areas, and their subordinate decoration industry management institutions are responsible for the daily work of supervision and management of decoration industry and the guidance of decoration industry associations.

the provincial construction administrative department is responsible for the supervision and management of building decoration and decoration projects directly under the jurisdiction of the state or province, and other decoration and decoration projects are supervised and managed by the relevant institutions of the local construction administrative department.

Chapter II Qualification Management

Article 4 The first-class qualification of building decoration engineering design and integration of design and construction shall be submitted by the provincial construction administrative department to the the State Council construction administrative department for examination and approval in accordance with regulations.

if a building decoration major contracts for Grade I, Grade II, Grade B, Grade C of engineering design, Grade II and Grade III of design and construction integration, it shall apply to the construction administrative department where it is registered, and submit it to the provincial construction administrative department for examination and approval in accordance with regulations.

the licensing of professional contracting level 3 qualification shall be implemented by the municipal construction administrative department.

article 5 if the name, address, registered capital and legal representative of a building decoration enterprise change within the validity period of the qualification certificate, it shall go through the qualification certificate change procedures within 31 days after the industrial and commercial departments go through the change procedures.

if an enterprise needs to extend the validity period of the qualification certificate upon the expiration of the validity period of the qualification, it shall apply for the qualification extension 61 days before the expiration of the validity period of the qualification certificate.

building decoration qualification licensing authorities at all levels should regularly or irregularly check the qualification conditions of licensed construction enterprises, and the inspected units should truthfully provide information related to the qualification standards such as enterprise qualification certificates, enterprise financial statements, personnel data and performance data.

article 6 foreign building decoration enterprises (enterprises with independent legal person status, which have obtained decoration and decoration qualifications, and whose legal person industrial and commercial registration is not located in Henan) shall go through the qualification and project credit certification registration with the provincial construction administrative department.

if a foreign building decoration enterprise establishes a branch or office in the local area, it shall register with the local construction administrative department in accordance with the regulations; Those who re-register and establish a company shall apply for qualification in accordance with relevant regulations.

article 7 the qualification management of residential decoration enterprises shall be separately formulated by the provincial construction administrative department.

chapter iii professional training

article 8 the decoration and decoration industry management organization under the provincial construction administrative department is responsible for organizing, coordinating, guiding and supervising the vocational education and training of the decoration and decoration industry in the whole province. Provincial cities and counties (cities) decoration industry management agencies should do a good job in vocational education and training for building decoration employees, and cooperate with relevant departments to do a good job in building decoration employees with certificates.

Article 9 Professional management personnel engaged in building decoration enterprises must receive professional training and engage in building decoration activities within the specified professional scope. Building decoration construction enterprises shall strengthen the vocational education and training of construction personnel, and shall not use personnel without professional qualification certificates for construction.

article 11 skilled workers and personnel with special types of work engaged in building decoration and construction shall be trained and qualified by vocational skills training institutions recognized by the construction administrative department or the labor and social security department, and after obtaining professional qualification certificates, they shall engage in building decoration and decoration activities within the specified professional scope.

article 11 all kinds of certified personnel engaged in building decoration shall continue education according to regulations.

chapter iv contracting and contracting of building decoration and decoration projects

article 12 when the building decoration and decoration projects are contracted with the main building projects, they shall be contracted by construction enterprises with corresponding qualifications. The decoration and decoration projects independently contracted out shall be contracted by the building decoration and decoration enterprises with corresponding qualifications.

article 13 the tendering and contracting out of building decoration and decoration projects and the contracting out of new commercial housing decoration and decoration projects by real estate development enterprises shall be carried out in accordance with the provisions of article 17 of the regulations on the administration of construction market in Henan province.

Article 14 The decoration and decoration project subject to public bidding shall be reviewed and filed with the corresponding construction administrative department according to the provisions of Article 3 of these Detailed Rules, and be subject to the supervision and management of the bidding process.

Article 15 Subcontracting activities of building decoration projects must be carried out according to law.

the contractor of subcontracted projects must have corresponding qualifications and undertake business within the scope permitted by their qualifications. It is strictly forbidden for individuals to undertake subcontracted projects.

the subcontract works employer and the subcontract works contractor shall sign the subcontract according to law and perform the agreed obligations in accordance with the contract. The subcontract must clearly stipulate the time for payment of the project funds and labor wages, the settlement method, and the corresponding measures to ensure the recent payment, so as to ensure the payment of the project funds and labor wages.

illegal subcontracting of contracted projects is prohibited. The following acts are illegal subcontracting:

(1) The subcontractor subcontracts a professional project to a subcontractor who does not have the corresponding qualifications;

(2) The employer subcontracts some professional projects in the contracted projects to others without the agreement in the general construction contract and the approval of the construction unit.

article 16 the contracting parties and contractors engaged in building decoration engineering shall sign the contract by using the model texts of the building decoration engineering construction contract and the family room decoration engineering construction contract uniformly printed by the provincial administrative department for industry and commerce and the construction administrative department.

article 17 the employer shall not harm the interests of the contractor and force the contractor to purchase decoration materials and equipment other than those agreed in the contract.

Chapter V Application for Construction and Permit of Building Decoration and Decoration Project

Article 18 Where a public building decoration and decoration project is contracted, the construction unit shall apply to the construction administrative department for a construction permit; Without obtaining the construction permit according to law, no work may be started. Except for building decoration and decoration projects below the limit prescribed by the state.

article 19 for a public building decoration project with an investment of less than 311,111 yuan or a construction area of less than 311 square meters, the construction unit or the construction unit shall register with the construction administrative department where the project is located before the project starts.

The following materials must be submitted when registering for the record:

(1) Qualification certificate, business license and safety production license of the construction enterprise;

(2) construction contracts, drawings and budgets;

(3) certificates of all kinds of personnel participating in the renovation and decoration project.

article 21 the construction unit shall, in accordance with the relevant provisions on the supervision and management of engineering construction quality and safety, go through the supervision procedures for the quality and safety of building decoration engineering at the corresponding provincial, municipal and county levels, and go through the building construction permits at the construction administrative department at or above the county level.

materials to be submitted for handling the construction permit:

(1) a copy of the business license and qualification certificate of the design unit;

(2) the business license, qualification certificate, safety production license, builder's certificate and a copy of the construction unit;

(3) construction drawings;

(4) the bid-winning notice of the construction and supervision unit and its copy;

(5) construction contracts, construction supervision contracts and various subcontracts;

(6) the construction organization design of the construction unit and the supervision rules of the supervision unit;

(7) if the structure is demolished and modified, a change plan issued by the original design unit or a design unit with corresponding qualifications shall be provided;

(8) audit opinions of the fire department;

(9) project quality supervision and safety filing procedures;

(11) proof of project funds;

(11) other conditions required by laws and regulations.

Chapter VI Quality and Safety of Building Decoration Engineering

Article 21 The construction unit, building decoration design, construction and supervision unit must follow the procedures of capital construction management, and strictly implement the relevant standards and regulations such as quality inspection and evaluation standards of building decoration, construction safety technical specifications and acceptance specifications.

Article 22 When carrying out building decoration construction, the construction unit shall implement the technical specifications, technical requirements and mandatory standards for building decoration promulgated by the state and this province, and abide by the following provisions:

(1) The design scheme or drawings approved according to law shall not be changed without authorization;

(2) The load-bearing walls, beams, plates, columns and other structures shall not be dismantled or destroyed without authorization;

(3) No building decoration and construction shall be carried out for dangerous buildings;

(4) It shall not affect the normal use of fire control facilities and evacuation passages;

(5) The construction site shall meet the fire safety requirements;

(6) If heating, water supply, drainage, power supply and gas pipelines are dismantled or rebuilt, relevant management regulations shall be implemented respectively;

(7) The facade of the building shall conform to the planning requirements;

(8) check and record the quality of concealed works;

(9) Abide by the safety construction operation specifications, and ensure the personal safety of operators and adjacent personnel and the safety of public and private property;

(11) Personnel exposed to toxic and harmful substances shall take effective occupational disease protection measures according to law;

(11) Take effective measures to reduce the emission of dust, odor and noise;

(12) All kinds of wastes generated from construction shall be piled up in the location, manner and time designated by the relevant departments and removed in time.

article 23 if the quality of the main structure of newly-built buildings and structures is unqualified or the existing buildings and structures have structural safety hazards, they shall not be decorated.

The parts of the house that have been decorated, which affect the use safety and normal use function after demolition, shall not be demolished without authorization.

article 24 the construction administrative departments at all levels shall, in accordance with the relevant regulations and standards of the state and this province, supervise and inspect the main decoration materials, decoration components and equipment entering the project site. Decoration materials used by decoration enterprises must meet the mandatory standards stipulated by the state, and it is forbidden to use decoration materials that have been explicitly eliminated by the state or do not meet the environmental protection requirements and product quality standards. The main materials, components and equipment should be re-examined when entering the construction site.

the use of decoration materials shall conform to the relevant provisions and requirements of Code for Fire Prevention Construction and Acceptance of Interior Decoration of Buildings.

article 25 a real estate development enterprise shall mark the building facilities and structures such as load-bearing walls, waterproof layers and various pipes of the commercial houses sold in a prominent position in the residential instruction manual; When selling houses, explain the building use safety regulations to the buyers; In the "Interim Management Statute", the matters needing attention in house decoration and building use safety regulations should be indicated.

Decoration decorators and decoration enterprises must carry out decoration in accordance with the provisions of the Residential Instruction Manual and the Temporary Management Statute.

article 26 a decorator can decorate a house by himself, except for the decoration involving the layout, installation or transformation of the main structure of the house and facilities such as water, electricity, heating and gas.

article 27 the indoor environmental quality inspection of decoration works shall be conducted at least 7 days after the completion of the works and before the works are put into use. Decoration decorators should entrust testing institutions with corresponding qualifications to carry out indoor environmental quality testing. The public * * * building decoration project can only be completed and accepted after passing the inspection. If it fails to pass the inspection, the responsible party will rework and repair it, and it can only be completed and accepted after passing the inspection. Residential decoration engineering can be delivered only after passing the test.

air quality control units should accept the supervision and management of the construction administrative department in accordance with the relevant provisions of the state and the province, and carry out control according to the relevant provisions of the state and the province.

article 28 in order to standardize the market behaviors of all parties and employees in the decoration industry, accelerate the establishment of the decoration market credit system, improve the decoration market supervision system, and improve the bad behavior record system of construction enterprises, the decoration management agency is responsible for collecting, reviewing, summarizing and recording the credit information of all parties and employees in the decoration industry, and reporting it to the provincial construction administrative department.

Article 29 The construction site of the public building decoration project shall be equipped with certified full-time safety management personnel in accordance with the regulations, and the construction site shall be equipped with professional fire prevention and rescue equipment in accordance with the regulations. The construction site shall formulate the safety production responsibility system at all levels and various safety production responsibility systems, and the hazard sources on the construction site shall establish preventive monitoring measures and emergency rescue plans. Construction administrative departments at all levels should establish and improve the long-term supervision and inspection mechanism of safety production, and establish and improve the reward and punishment system of zero safety production construction site.

article 31 intermediary services refer to the services provided by intermediary enterprises engaged in decoration and tendering, engineering supervision, consultation and testing, and shall be implemented in accordance with chapter 6 (articles 38 to 42) of the regulations on the administration of construction market in Henan province.

article 31 in the event of a major accident in a building decoration project, the person in charge of the construction unit shall promptly and truthfully report to the department in charge of production safety supervision and management, the construction administrative department or other relevant departments, and the decoration industry management institution shall have the responsibility to assist the relevant departments in investigation and handling.

Chapter VII Completion Acceptance

Article 32 After the completion of the public building decoration project, the construction unit shall organize relevant units such as design, construction and project supervision, and conduct completion acceptance under the supervision of the corresponding decoration administrative department.

The completion acceptance of the building decoration project shall meet the following conditions:

(1) Complete the design of the construction project and the contents agreed in the contract;

(2) having complete technical files and construction management data;

(3) Having the inspection report of the main building materials, building components and equipment used in the project;

(4) There are quality qualification documents signed by design, construction and engineering supervision units respectively;

(5) a project warranty signed by the construction unit;

(6) having an air quality test report;

(7) having the approval document issued by the public security fire department;

(8) the project quality supervision report issued by the decoration quality supervision department.

the building decoration engineering can only be delivered if it has passed the acceptance test.

article 33 the construction unit shall submit the completion acceptance report and relevant materials to the administrative department in charge of decoration and decoration industry for the record within 15 days after the completion acceptance of the building decoration and decoration project.

if the filing authority finds that the construction unit has violated the relevant national regulations on the quality of construction projects during the completion acceptance, it shall, within 15 days after receiving the filing documents for completion acceptance, order it to stop using it and reorganize the completion acceptance.

Chapter VIII Supplementary Provisions

Article 34 These Detailed Rules shall be implemented as of the date of promulgation.

Article 35 The Ministry of Housing and Urban-Rural Development of Henan Province shall be responsible for the interpretation of these Detailed Rules.
