The first-class protected area covers the reservoir area below 2008 meters above sea level.
The scope of the secondary protection zone is the reservoir runoff area, reservoir supporting projects and water conveyance projects outside the primary protection zone south of Fuyuan Budu-Mohong-Shiyi Highway.
The third-class protected area covers the reservoir runoff area north of Fuyuan Budu-Mohong-Shiyi Highway. Article 4 The protection and management of reservoirs shall follow the principles of scientific planning, rational utilization, pollution prevention, water source protection and sustainable development. Fifth Qujing Municipal People's Government is responsible for the protection of water sources in Dumu Reservoir. According to the overall urban planning of Qujing City, the water source protection of Dumu Reservoir will be incorporated into the national economic and social development plan, and economic support for the reservoir protection area will be increased to promote water source protection and management.
Units or individuals that have made outstanding contributions to the reservoir protection work shall be commended and rewarded. Article 6 The people's governments of Qilin District, Fuyuan County and Luoping County of Qujing City shall return farmland to forests and grasslands in a planned way, plant trees and grass, strengthen the construction of water conservation forests, protect natural vegetation, prevent soil erosion, improve the ecological environment and improve the self-purification ability of water bodies.
The relevant units in the reservoir protection area shall build sewage treatment facilities to properly handle pollutants such as production and domestic garbage. Seventh any unit or individual has the right to stop and report acts of destroying reservoir facilities and polluting reservoir water quality. Article 8 The Qujing Municipal People's Government shall set up the Dumu Reservoir Management Organization. The management institution of Tumu Reservoir shall perform the following duties:
(a) to publicize and implement the relevant laws and regulations of the state and these regulations;
(two) to coordinate and urge the relevant departments and counties (districts) to protect the reservoir according to law;
(three) to organize the formulation of reservoir protection, development and utilization planning, comprehensive improvement plan and supporting measures for protection and management, and report to the Qujing Municipal People's Government for approval, and be responsible for supervising the implementation;
(IV) In the reservoir protection area, exercise part of the administrative punishment power of the relevant functional departments of the municipal government on the reservoir protection and management according to law, and its implementation plan shall be drawn up by the Qujing Municipal People's Government and submitted to the provincial people's government for approval;
(five) to participate in the examination and approval of reservoir runoff development and pollution control projects, and supervise the implementation of the projects;
(six) other relevant duties as prescribed by laws and regulations. Ninth set up public security institutions in the reservoir area to maintain public order. Tenth Qujing Municipal People's government and relevant administrative departments shall, in accordance with their respective responsibilities and authorities, do a good job in reservoir protection and management. Article 11 The water quality of reservoir protection areas shall be implemented in accordance with Class II standard in National Environmental Quality Standard for Surface Water (GB3838-2002) and Hygienic Standard for Drinking Water Sources in National Hygienic Standard for Drinking Water (GB 5749-85).
Sewage discharge in reservoir runoff area shall be implemented in accordance with the first-class standards in relevant national standards.
The establishment of reservoir water quality monitoring system, water quality monitoring according to law, published regularly. Article 12 Boundary markers shall be buried on the dividing line between the first-class protected area and the second-class protected area, and it is forbidden to move or destroy boundary markers.
In violation of the provisions of the preceding paragraph, the public security organ of the reservoir shall order it to make restitution, and may impose a fine of not more than 500 yuan. Thirteenth in the reservoir level protection zone to prohibit the following acts:
(1) Construction of projects other than water conservancy or water supply projects;
(two) the discharge of waste water, waste liquid, piling up or dumping soil, coal, coal gangue, tailings, waste residue, etc. ;
(3) sailing without approval;
(4) Reclaiming cultivation and breeding, slaughtering and discarding dead livestock and poultry, piling up livestock and poultry manure and dumping garbage;
(five) swimming, cleaning vehicles, clothing and other activities that may pollute the water body;
(six) poisonous fish, fried fish, electric fish, stealing fish.
In violation of the provisions of items (1) to (5) of the preceding paragraph, the reservoir management institution shall order it to stop the illegal act and make rectification within a time limit. In violation of the provisions of items (1) to (3), the unit may be fined 10000 yuan to 50000 yuan, and the individual may be fined 1000 yuan; In violation of the provisions of items (4) and (5), a fine below 200 yuan may be imposed. In violation of the provisions of item (6), the reservoir public security organ shall order it to stop the illegal act, confiscate fishing nets and other tools, and impose a fine of 1000 yuan. Fourteenth in the reservoir two protected areas prohibit the following acts:
(a) new construction, renovation and expansion of reservoir water pollution projects;
(two) excessive discharge of waste water and excessive discharge of water pollutants;
(three) the discharge of toxic gases and radioactive substances, and the establishment of warehouses and stacking places for toxic and harmful chemicals;
(4) indigenous coking and zinc smelting;
(five) the application of highly residual and highly toxic pesticides;
(6) Illegal exploitation of coal and other mineral resources;
(seven) mining coal seams and other sulfide mineral resources with ash content higher than 40% and sulfur content higher than 3%;
(eight) deforestation, burning, earth, sand, shovel turf, dig roots;
(nine) without the consent of the reservoir management agency, motor vehicles are not allowed to leave the reservoir dam.
In violation of the provisions of the preceding paragraph, the reservoir management institution shall order it to stop the illegal act and make rectification within a time limit. In violation of the provisions of items (1) to (5), the unit may be fined between 2,000 yuan and 50,000 yuan, and the individual may be fined between 65,438 yuan and 0,000 yuan in 200 yuan; In violation of the provisions of items (6) and (7), the illegal income shall be confiscated and a fine of not less than 0 times but not more than 5 times of the illegal income may be imposed; In violation of the provisions of item (8), a fine of per square meter 10 yuan shall be imposed; In violation of the provisions of item (9), a fine of not more than 200 yuan shall be imposed, and if losses are caused, it shall be liable for compensation according to law.
