" The administrative department for industry and commerce shall, when implementing the provisions of this article and determining the illegal income, calculate the total income according to the provisions of Article 6 of the Measures for Determining the Illegal Income of Administrative Punishment Cases by the Administrative Department for Industry and Commerce that "the illegal income that violates the provisions of laws and regulations and provides convenience for illegal acts shall be calculated according to the total income of the parties concerned", without deducting the expenses directly used by the parties for business activities. However, the relevant taxes and fees stipulated in Article 9 of the Measures for Determining the Illegal Income of Administrative Punishment Cases by the Administrative Department for Industry and Commerce shall be deducted. The amount of illegal income from confession shall not be used unilaterally as the basis for conviction and sentencing. The law stipulates that if only the defendant confesses and there is no other evidence, the defendant cannot be found guilty and punished; If there is no confession from the defendant and the evidence is true and sufficient, the defendant may be found guilty and punished.
