Labor dispatch has overtime pay and is a special form of employment. According to the law, the labor dispatch unit is an employer in the legal sense, but it does not directly hire laborers, but sends laborers to work in other units, and the employer directly manages and directs laborers. The basis for sending workers abroad is the labor dispatch agreement signed between the labor dispatch company and the employing unit (this is the behavior between the two units, which is different from the labor contract signed between the labor dispatch company and the employees), and the labor dispatch unit shall inform the workers of the contents of the agreement, including the payment of labor remuneration. Overtime pay refers to the labor remuneration obtained by workers who continue to produce or work outside the prescribed working hours according to the needs of the employer's production work. It is not fixed, and it is impossible to stipulate the specific amount in advance in the labor contract and dispatch agreement. Article 63 of the Labor Contract Law stipulates that the dispatched workers have the right to equal pay for equal work with the employees of the employing unit. In addition to wages, the dispatched workers, like other workers in the employing unit, enjoy overtime pay, benefit bonus, welfare and so on, which are generally paid to the dispatched workers by the employing unit that accepts the dispatch. Article 62 of the Labor Contract Law also clearly stipulates that the employer shall perform the following obligations: inform the dispatched workers of their job requirements and labor remuneration; Pay overtime pay, performance bonus, and provide work-related benefits ... Labor dispatch companies, dispatched employees, and dispatched service providers should make agreements on overtime work in several agreements and clarify their responsibilities.

Legal objectivity:

Under any of the following circumstances, Article 44 of the Labor Law of People's Republic of China (PRC), the employing unit shall pay the wages higher than the normal working hours of the workers according to the following standards: (1) If the workers are arranged to extend their working hours, they shall pay the wages of One Happy and Fifty, which are not lower than the wages; (2) If workers are arranged to work on rest days but cannot be arranged for compensatory time off, they shall be paid a salary of not less than 200% of their wages; (3) If workers are arranged to work on legal holidays, they shall be paid no less than 300% of their wages.
